The borough's unexpected action should facilitate the long-stalled sale of the property to Second Baptist Church of Homestead and repayment of several dozen people burned in an investment scheme run by Grace Christian's former minister.

"It's a great Christmas present to the members of the church," said Jon Pushinsky, an attorney assisting in the American Civil Liberties Union's federal discrimination lawsuit against West Mifflin on behalf of Second Baptist. The ACLU has scheduled a news conference for 1 p.m. today. The borough said it was issuing the occupancy certificate because Second Baptist provided it with new information about its plans for the building. In a letter mailed by the borough Friday to Thomas B.

Earhart, Second Baptist's attorney during its efforts to buy the property, solicitors representing both the borough and its zoning board asked that the church "seriously reconsider termination of any and all litigation it instituted immediately." She received her Teaching Degree from Oberlin College and taught for several years in the Pittsburgh area. She married Thomas Clinton Pears III in 1935. She was an active member of Waverly Church and in several civic organizations. Mrs. Pears, along with her husband, was a founding member of the Pittsburgh Bibliophiles, a member of the College Club, and a long-time book reviewer in Western PA.

Mrs. Pears is survived by her son Thomas Clinton Pears IV of Boston, a sister Jane Hartman of Baltimore and two granddaughters. Michael J. Simpko, 88, of Rill-ton, died Thursday, December 12, 2002, in his home. He was born March 12, 1914, in East Pittsburgh, a son of the late Michael and Anna (Hudak) Simpko.

Prior to retirement, he was a machine operator for the Elliott Co. in Jeannette, where he worked for 23 years. Prior to that, he was a coal miner for 16 years at various coal mines in the area and worked 10 years for West-inghouse at the Trafford Works. He was a member of the Czechoslovak Society of America and a lifetime social member of Rillton VFW Post 8518. In addition to his parents, he was preceded in death by his wife, Mary P.

(Zemba) Simpko, in 1967; a son, George Simpko, in 1990; two brothers, John and Andrew Simpko; and five sisters, Ann Peters, Rose Laich, Helen Walster, Veronica Roman Zaiack and Mary Rodak. Surviving are a son, Michael J. Simpko, Jr. of Rillton; three daughters, Rose Marie Ostrowsky of Alexandria, VA, Mrs. Dale (Kathleen) Babiakof Great Falls, VA and Veronica Par-tin of Longview, TX; a granddaughter, Leisa Brewer of Alexandria, VA; four gransdons, Kevin, Craig and Shawn Partin of TX and Brian D.

He was a member of the: Pittsburgh Rotary Club, the Harvard Yale Princeton Club of Pittsburgh, and Valley Brook Country Club. Memorial celebrations are Planned for Santa Fe and for Pittsburgh, PA.
