R. B. Nixon. Overseer of Tern escal Road District, appeared before and stated to the Board that that por uon ex tne san raoio road extending from the Temescal bridge to the charter line of Oakland City needed to be repaired, and, on motion, the matter of repairing the same waa referred to Mr. Woolsey ana Overseer Nixon with power to act.

Mr. bmith reported that the irou rafters for the Hall of Records had been received from the East, and that they were not exactly in accordance with the plans and spicifications. The con tractor, Mr. Nutting, offers to rivet iron atrapa which will remedy the defect and make tbeni heavier and stronger. The order was sent Eavt and the mill manufacturing them had made a slight mistake in reversing the flanges on them.

The said iron rafters were accepted on condition that the contractor shall strengthen them as above suggested. LINDEN LANE MATTER. The report of viewers in road survey No. 1931 (Linden Lane) was called up, and A. A.

Moore asked that an order be entered rejecting said report and dismissing proceedings hereio. J. V. Martin, attorney for Beebe, tiled bis objections to the approval of said report and opposed the rejection of the report for the reason, as he argued, that it could not be legally rejected until the report had been con sidered, testimony heard and the road found not to be a necessity. Air.

rlart, attorney for Wallace minors, also objected to the rejection of the report of the viewers, and filed bis objections with the Clerk. Mr. Moore urged that the report should be rejected on the ground that the report of viewers was informal and rregular, and, if approved, would not support a judgment of the District Court in case condemnation proceedings were instituted therein. Mr. Martin said that he desired the Board to judicially determine that this road was not needed.

Mr. Moore reohed that this the Board could not do. Mr. Smith thereupon moved that said report of viewers be rejected and proceedings dismissed, which motion was carried. BRIDGE AT DUBLIN.

Mr. Green stated that a small bridge was needed on the public road in front of Mr. Dougherty's house, in Dublin. The old bridge was built of rails and earth, and the rails having decayed, the bridge has collapsed. On motion, the matter of building a new bridge there, to be ten or twelve feet wide, was referred to Mr.

Green with power to act. Mrs. Burton, formerly of Grayson, Stanislaus county, and for the past three months a resident of Oakland, and who has three small children, asked for relief. She was willing to work if she could find anything to do. She said she could make a living by washing if she had the necessary apparatus.

Mr. smith moved that Mr. Myers be- authorized to rig her out with these articles, which motion waa lost. The Board adjourned to Monday, November 3, 1879. REDUCED RATES.

The New Schedule for Cheaper Telejfraphy The Cable Between Oakland and San Francisco. On Saturday next, the first of No vember, the new system of half rates for night messages, goes into effect on the Western Union lines. By this ystem messages may be left at any office during the day or evening for transmission during the night to be delivered early next morning at one "half the usual rates. This reduction extends throughout the Coast as well as to the Jastern States. Messages to New York which cost two dollars during the day can be sent at night for one dollar.

Messages to Oregon which now cost one dollar will then cost but riftv cents. There will be no rate however less thau 25 cents, though a message of twenty words can be sent at night for that amount to places where tbe regu lar rate is 2o cents. While not cheapening the rate in the immediate vicinity, it gives the public the benefit of double the ordinary number of words. On the first of the month there will also be a reduction in the regular rates to a number of points on the Pacific Coast, there being then no rate higher than $1 50. This effects places like Victoria, B.

which has heretofore been $2. Three new wires have lately been connected between Oakland and San Francisco by tbe new cable, making six wires between the two cities. In tbe spring four additional wires will be ready to connect with the cable, which has seven conductors, so that Oakland will be well supplied with telegraph facilities, TAKING POSSESSION. Squatter Fence In a Portion of the Water Front. Yesterday and to-day men were at work engaged in building a fence around a portion of the Oakland Water Front extending some six hundred feet along the line of the proposed ship channel, west from Clay street.

It is understood that O. H. Burnham and H. D. Hougham are the principal movers in the matter.

The alleged ground of their taking possession is said to be that the lands in question belong to the Government; that the Carpen tier, or Water Front Company's title is null and void by reason of these facta, viz: That it is based upon the transfer of the marsh lands by the Government to the State, bv the State to the city, and by the latter to Car pen -tier et al. That the- United States Government never disposes of or cranta or gives away its title to the channel of navigable stream, or to tbe banks thereof; that by Act ot con- press San Antonio Creek was declared to be a navigable stream; hence, the alleged transfer of the lands adjacent to that stream by the Government were, in the first place, null and void, consequently the subsequent transfers by the State to the city of Oakland, and by the city to Carpentier were also null and void, and tbe land is still property of tbe General Government. It is atated that the design is to ask from the Oakland City Council a franchise for a wharf which those who have taken possession will build. Hl-Trw tna mt Mat Harris. Edwards, stating to his brother's family, as well as to hia own, that she had been badly treated by tbe woman An examination showed that the child had severely whipped and braised. Despite them it entered the grounds, and found fuel in the thick layer of fine, dry grass, spreading with great rapidity. The fire reached the pine trees, ran up them and made them cones of fire, leaving them but blackened skeletons. It passed over the Eucalyptus like a flash, seeming to consume the gummy surface.

It was only when it had reached the carriage-way running through the upper part of the Univer sity grounds, that it became manageable and was stopped. All the trees above are probably destroyed. Tbey represent the growth of some eight years, and it will be a matter of time, as well as money, to replace them by as nourishing a growth. Work has begun in the excavation of the bank to the north of the main build- ne. A width of about thirty feet be tween these buildings and the site of the prospective Art Gallery Building, is to be lowered to the level of the ground upon which the north and south nails tand. 1 be dirt removed is utilized itj completing the terracing on the south side. At the creen houses a boiler is being put up for heating during the winter. It will be poewible by it to preserve a more equable temperature than heretofore attainable.

In fact, it will add much to the efficiency of these house, they being before this of but partial utility from tbe impossibility of preventing extremes of temperature. HAYWARDS ITEMS. from our special correspondent J. C. Sabine Bros, have concluded that this town is the place to invest their earnings.

Saturday they closed bargain with Mr. Khodehammel, the agent of the Atherton estate, for a farm. Heretofore they have been sending their money East. A building on the Palomares Creek, known as "the Brophy barn," was burned Saturday night, together with 50 tons of baled hay, and some farm ing implements. Une man naa nis hands terribly burned while trying to save some of the tools.

Grogan was in town Monday. The Graham residence is already under cover of shingles. Miss Lizzie Senile of San Fran cisco, is visiting the Misses crick el. Harry Jessup, a nephew of W. H.

Jessup of this place, is visiting his uncle. Tuesday was the eleventh anniver sary of the great earthquake. Nobody celebrated it. Sawyer will try to organize a musical society in town soon. The idea is a laudable one.

The squash harvest has commenced. Thousands of tons of this feed have been grown about here this year. Chickens with a good business ca pacity are better than a gold mine as ong as eggs are quoted at ov cents per dozen. Wm. Meek has just returned home from a two weeks' visit to the Bartlett Springs, and appears to be in more substantial health than duriug any time in the last year.

Bit. Eden. H. Meininger is already busy re pairing cultivating implements. Mr.

Willie's tank-house is finished and is quite an ornament to the place. H. Petermann has a petition for the purpose oi bunding a new nan on shares. F. B.

Granger, of Alvarado, is now running a stage Irom tne luversiae Hotel to Hay wards. C. Bothsow has been very sick for some time. From last accounts he is said to be slowly recovering. Wild ducks are setting numerous now and large numbers of them will be killed during tbe moonlight nights.

The party known as the "Pelican Club" has again leased the extensive marsh south of Alvarado this season for hunting. LEGAL NOTES. A plea of "Not Guilty" was entered to-day in the case of John Warner vs. His Creditors in the County Court, as to accusation of fraud. The case of John D.

Thompson vs. James J. McDonnell et was decided to-day in the Third District Court by a decree ordering the case dit missed aa to defendants, Joseph Corley et al. down to Edwin Block, and in favor of plaintiff against others, and for $475 counsel's fees. To-day in the suit of 0.

Boss vs Cornelius Yerzer, et in the Third District Court, on motion of Geo. L. Morgau, attorney for defen dant! E. Green, it waa ordered that demurrer of said defendant be with drawn, and by consent of all parties, decree ordered entered in favor of plaintiff in accordance with the prayer of the complaint. In the Third District Court to-day in the suit of the Oakland Bank of Savings vs.

Mary E. Bee man, on motion of plaintiff's attorney, the default of Mary E. Beeman was ordered entered, and it was also ordered that the original answer of Mary J. Gracey may stand as answer to the supplemental complaint, and by consent of all parties a decree was ordered in favor of plaintiff in accordance with prayer of the complaint, and in favor of Mary J. Gracey, in accordance with her answer and cross complaint.

Mason was called to the Chair. The minutes of the previous meeting were read and ap proved. August Moore, Pound Mister of Pound District No. 11, in Murray Township, presented his report from January "st to October 13, 1879, which was ordeted on tile. MALONEY'S TAXES.

The District Attorney reported upon the matter of taxes alleged to have been assessed twice upon lands of Maloney. The facts of the oase appear to be as follows: In the fiscal year, 1 877 -8, Maloney's property was assessed for the fiscal years, 1876-7 and 1877-8. This double assessment was anriarentlo made under the belief that Maloney's property had not been assessed for that year; wnereas, Maloney naa paid taxes on said property for the fiscal year 1876-7, and has his receipts therefor. On February 23, 1878, his said prop erty was sold for delinquent tax for the fiscal year 186-7 to one Macartney, Maloney has paid his taxes once only. and therefore is Dot entitled to have any money refunded to him.

Mecart-ney, who purchased Maloney's property at the tax sale, is presumed to have done so advisedly and to have been at the time acquainted with the titlo thereto, and must suffer the conse quences of hia negligence. Mr. Gibson gave his opinion as follows: "The difficulty seems to have arisen from a mistake of the Tax-Collector in rexrt-ing the tax delinquent when it had been paid, and while the plain principles of justice require that the county should furnish Maloney full compensation for the injury done to him and restore the title to his said land as unclouded and perfect as it was before the erroneous assessment was made, yet I am of the opinion that under the existing law the Board cannot grant the relief asked for." Leake, oo behalf of Mr. Maloney, made a statement to the Board, whereupon the report of the District Attorney, ou motion of Mr. Dusterberry, was adopted by the fol lowing vote, viz: Ayes Dnsterberry, Green, Mason, Myers and Woolsey. rno Smith. OTHER ROAD MATTERS.

The following was adopted: The District Attorney having heretofore re ported that certain encroachments on Old Telegraph Road (Road Survey No. 1801) in Oakland township, are unlaw ful and should be removed, on motion of Mr. Woolsey, it is ordered that the Overseer of Peralta Road District be and is hereby directed to notify the parties maintaining said obstructions or encroachments in said road, to remove them within ten days after the service on them of the passage of this order, and failing to do so, that the said Overseer thereupon proceed to re move said encroachments himaell. Mr. Smith offered the following res olutions, which was adopted, viz: Re-solved, That the matter of erecting guide-posts and placing sign boards thereon be the same is hereby referred to the several Supervisors with power to direct the road Overseers in their respective districts to place fhem at the forks and crossings of all public highways in their respective districts where tbe same may be deemed necessary.

SUIT AGAINST MtTLLIKIN. Mr. Woolsey offered Jthe following which was adopted, viz: Whereas, An order was passed by this Board September 29, 1879, directing J. D. Mnllikin, late Overseer of Temescal Road District, to pay over certain moneys collected by him and unaccounted for in his reports, and the Sheriff having served notice on him of the passage of said order, and more than ten days having elapsed since said service of notice was made, therefore, Resolved, That the District Attorney be and is hereby directed to institute suit against said J.

Mulli- kin, late Overseer of lemescal Koad District, to recover the amount due from him as shown by a report presented by the Clerk, and adopted September 29, 1879, together with the penalty prescribed in Section 2,683, for a failure to pay over moneys upon the order of the Board of Supervisors. ANOTHER REDUCTION. Mr. Dusterberry offered the following resolution, which was adopted, viz: "Whereas, The Board of Supervisors, on May 18, 1874, and at various times subsequently, fixed the compensation of copyists employed in the Recorder's office at seven cents per folio of 100 words, and the compensation for copying indices never having been fixed by said Board, therefore.

Be-Bi-lved, That from and after November 1, 1879, all copyists employed in tbe County Recorder's office shall receive not to exceed six cents per folio of 100 words, and for copying indices they shall receive but one cent per line. Tax Collector Palmer was authorized to publish his annual notice to taxpayers in all the official papers of the county for a period of two months. Applications having been heretofore made therefor by Architect Stokes, it was ordered that iron instead of brick pedestal shall be placed on the Hall of Kecorda upon the conditions then stated by him. INDIGENT CASES. Indigent cases were reported and disposed of as follows, viz: Mrs.

Mr. Cuff appeared before the Board and made a statement regarding the grade of Ashby avenue as established by Luis Caatro, County Surveyor. He said that th last report differed very much from the one made by him nearly a year ago and that the grade had been established and built In accordance with hia former report, and was com plete.
