APRIL 12, 2003 LOCAL NEWS CITY EAST STATE LOCAL NEWS BRIEFS to Smithfield streets will be closed to traf-fic tomorrow from 7 a.m. to 5 p.m. The street is being closed to allow for as-1 sembly of heating, ventilation and air-condi- tioning equipment at Point Park College. The Boulevard of the Allies is suggested as an alternate route.

Derry Township, pleaded guilty to reckless endangerment and child endangerment charges last week and was sentenced to time served, 256 days, as part of a plea bargain. Abigail Piper has been placed in foster care with her maternal grandmother. NORTH BRADDOCK Distressed status ends State Community and Economic Development Secretary Dennis Yablonsky signed a department order yesterday lifting North Braddock's distressed status. North Braddock was declared a distressed borough in May 1995 and implemented a financial recovery plan. The borough needed a $700,000 emergency loan from the state Department of Community Affairs to pay off long-standing debts and a projected deficit.

Over the last eight years, the borough improved its financial and management practices, with the help of Joseph Hohman, the borough's financial recovery plan coordinator. The borough received 11 grants totaling $240,000 to implement various recovery plan recommendations, including the hiring of an outside agency to collect nearly $2 million in delinquent taxes. The state will continue to work with the borough. EAST LIBERTY Pharmacy robbers sought Pittsburgh robbery detectives are looking for two men who robbed an East Iibertyphar-macy yesterday morning and made off with money and the addictive painkiller Oxycontin. Sgt.

Carl Metz said that two men brandishing handguns and their faces covered with bandanas and hoods on their heads, entered the Stanton-Negley Pharmacy at 804 N. Neg-ley Ave. and took an undetermined amount of money from the register and about $20,000 worth of the drug. Four employees were not hurt. The robbers are described as black men in their mid-20s.

One is approximately 5 feet 11 inches tall and weighs 160 pounds with a thin build; the other is more stocky, standing approximately 5 feet 7 inches and weighing 180 pounds. Anyone with information is asked to call the robbery squad at 412-665-4317. DOWNTOWN Fourth Avenue restrictions A portion of Fourth Avenue from Wood WESTMORELAND COUNTY Father acquitted A young father accused of physically abusing his 7-week-old daughter was found not guilty on all charges by a Westmoreland County jury yesterday. State police had accused James Sanfilip-po of abusing Abigail Piper after doctors who treated the girl at Children's Hospital in the fall of 2001 reported that she had two broken legs, two broken ribs and bruised ears. The doctors said the injuries were consistent with child abuse, and Sanfilippo, 23, was charged with aggravated and simple assault, reckless endangerment and child en-dangerment.

Sanfilippo, of Latrobe, testified that he did not harm the girl and he did not know how she was hurt. "Nobody had ever seen him do a single thing to that child," defense attorney Robert Johnston said after the four-day trial. "We believe the prosecutors simply didn't know what happened." Even prosecution witnesses, including the girl's mother, testified that Sanfilippo was a good father, Johnston said. The mother, 20-year-old Tonya Piper of SOUTH WHITE OAK Robbery suspect arrested A second suspect has been arrested in connection with the attempted armed robbery of a family pharmacy last year in White Oak. Dale Terrance Cooper, 20, of Glassport, surrendered after learning from a television news report Thursday night that White Oak police had obtained a warrant for his arrest, officers said.

Police said Cooper evaded officers from Glassport and White Qak who searched for him at his home Thursday, but surrendered hours later and was jailed on $10,000 bond. Cooper and Nicholas Uhren, 19rwho has addresses in both Duquesne and Glassport, are charged with trying to rob Manns Pharmacy on Lincoln Way in May. White Oak police arrested Uhren Wednesday. ALTOONA Candy company trustee named A judge removed the chief executive officer of the troubled Boyer Candy Co. as trustee yesterday, ending for the moment a two-year legal battle for control.

The ex-wife of the company president has sought to oust CEO Roger Raybuck since her ex-husband's death following open-heart surgery. The fight has pitted her against two of her children, who wanted Raybuck to run the Altoona company. Deborah Forgione said she was forced by her husband to give up her position as trustee before he died, a position that gives the holder control over a company that has roots dating back to the Great Depression. Judge Timothy McCarthy of the 15th Judicial Circuit Court in Palm Beach County, named Ligonier businessman Roy Mollomo, Forgione's pick to run Boyer, as interim trustee yesterday. He was to take control immediately.

(Jonf. from Page D-3 DARBY WILLIAM THOMAS Age.93 of Charleroi died Friday, April-11, 2003, after a lengthy ill ness. He was born Dec. 21, 1909 in Charleroi, the oldest of four sons of the late Mr. W.W.

and Sarah Garletts Darby; a grandson of Mr. W. M. Darby, long time Borough of Charleroi Health Officer. Mr.

Darby was a graduate of Charleroi High School, Grove City College and the University of Pittsburgh for Water and Sewage Treatment and Authori- ty Administration. He was a retired Superintendent of the Authority of "the Borough of Charleroi, starting when it was Tri-Cities Water Com- pany in the 1920's. He was a past president of the Pennsylvania Municipal Authorities Association in 1960; a life member of the Sahli Award of P.M.A.A. Mr. Darby was a life time member of the Presbyterian Church of charleroi, former Elder, Chariman of Trustees, a member of the Building Committee, Men's Bible Class and Church Choir.

He was a 65-year member of the Charleroi Lodge 615 a 32nd Degree Mason, a life member of Syria Temple of Pittsburgh and past president of the Mon-Val-ley Caravan. Mr. Darby was The Initial Recipient in 1982 of theCon-gressional District 22 of The Penn-sylvanis House of Representatives Award for Distinguish Service to State and Nation; a Past Exalted of B.P.O.E. Charleroi Lodge 494; a Charter Member, former secretary and past president of the Charleroi Lions Club; a member of the former Charleroi Male Chorus that was instrumental in form- ing the Charleroi Library and the Y.M.C.A.; past president of the Mon- Valley Y.M.C.A. and in 1987 received the President's Service Award.

Mr. Darby was active in the Boy Scouts of America for more than 60 years holding the second highest B.S.A. award having served as assistant Scot Master in 1931, continuing as Scout Master of Troop 124 Charleroi; presented Scouting Award in 1953 for keeping scouting alive in the Mon-Valley; active at Camp Anawanna; accompanied scouts at International Jamborees; a member of the Charleroi Hunting Camp at Benezette, PA, for more than 40 years; an active sportsman he served as Project Engineer for Charleroi Tennis Courts; served many years on the Charleroi Recreation Board. Mr. Darby was a 20-year member of the Monongahela Cemetery Board; the Charleroi Area School Authority Board; assisted at the Charleroi Food Bank.

Mr. Darby was selected as "Man of the Year" in 1982 by the Americn Legion Charleroi Post 22 for his Community and Youth Service. Surviving is his wife of 67 years, Ruth Mounsey Darby; two sons William Charles Darby of Charleroi, Thomas Paul Darby of San Jose, CA; a brother Richard Harold Darby of Benezette. In addition to his parents Mr. Darby is preceded in death by two brothers Charles Howard Darby and Robert Grant Darby.
