PITTSBURGH POST-GAZETTE 8 WEDNESDAY, JANUARY 29, 2003 LOCAL NEWS iFayette district attorney weighing charges in Ellerbe case summary, saying the jury should have been allowed to simply listen to the two statements and make its own decision. He also blasted Reilly for failing to question Melvin and other witnesses in person and accused Reilly of "aiding and abetting" a state police cover-up by failing to subpoena other witnesses that Sansone maintained could have provided pertinent testimony. His cover-up allegation, at the end of the inquest, provoked Curry's attorney, the soft-spoken, usually unflappable William Manifesto, to rise to his feet and raise his voice to be heard over Sansone. "You cannot make a circus of this," Manifesto said. "If you have something to say, make a closing statement.

Yet, Sansone inexplicably refused to do so. Nor did he question Nas-san, Curry or other witnesses himself when Reilly gave him the opportunity. Sansone said he opted not to question the troopers because he did not believe their accounts and chose "to let them hang themselves." He did not seek information from other witnesses because he considered the coroner's jury to be a body without power and preferred to wait until he and Michigan trial attorney Geoffrey Fieger file a planned civil lawsuit on behalf of Ellerbe's family. SEE SHOOTING, PAGE B-7 jury about state laws governing justifiable and unjustifiable homicide, but he did not appoint him to handle the rest of the inquest. "It was a very nice offer, but I thought I had done the background work already," Reilly said.

"I have presided over three to seven in- auests every month for 19 years and lataddsup." Sansone maintained that the way the hearing proceeded allowed investigators to manipulate evidence by deciding what to include and what to leave out. In particular, he objected to testimony from Trooper David Davison, who presented statements from Melvin Duley a 10-year-old boy who said he saw the shooting from his bedroom windows. The boy has contradicted Nassan's admission of shooting Ellerbe once, and told police instead that Curry shot Ellerbe three times. Melvin testified only briefly during the inquest, after Davison read aloud the two statements he'd taken from the boy. Davison also read a list of differences in the two statements.

Notable in those contradictions were Melvin's initial statement in which he said he heard Curry laughing and telling an ambulance crew that Ellerbe was dead; the boy subsequently told Davison that he didn't hear Curry laughing or talking because his bedroom windows were closed. Sansone objected to Davison's ing officer or an assistant district attorney led to rambling or self-serving testimony. Ellerbe family attorney Joel San-sone repeatedly objected to testimony that began as an explanation of training procedures and regulations from state police Sgt Clifford Jobes but evolved into what Sansone called "a self-serving epistle" of general praise for state troopers. Others, including Sansone, complained that state police investigators should not have been permitted to shape and present a case that involved questions about other troopers' role in Ellerbe's death. Fayette County NAACP President Clinton Anderson said he asked Reilly, an elected county official, to turn the case over to Wecht or call in another impartial hearing officer to eliminate any potential conflicts of interest, but Anderson said Reilly refused.

"It was all one-sided evidence, presented by one side," he said after the jury issued its decision late Monday. "It was a complete railroad job." Reilly acknowledged that Allegheny County District Attorney Stephen A. Zappala Jr. also offered to allow First Assistant District Attorney Edward Borkowski to act as hearing officer in the case to provide both an impartial ear and longtime experience as a homicide prosecutor. Reilly asked Borkowski to attend the inquest and to address the Some Pennsylvania coroners rely on juries picked from the same pool used to assemble juries in Common Pleas Court trials; others preside themselves or appoint a hearing officer.

Some coroners don't schedule many open inquests, preferring to leave investigative work tq police. Others, like Reilly, hold them routinely to review every suspicious or motor vehicle death in their county. In Allegheny County, open inquests are structured proceedings held in a courtroom in the Coroner's Offices on Ross Street. Allegheny County Coroner Dr. Cyril H.

Wecht has not used a jury since 1996, and instead assigns attorneys to act as impartial hearing officers. An assistant district attorney usually is invited by Wecht to question witnesses, but hearing officers generally allow other interested parties or their attorneys to submit questions to witnesses and also may do so themselves. But hearing officers, who often are chosen because of their field of expertise, usually run the proceedings with some formality and will rein in witnesses whose testimony becomes too opinionated or wanders too far afield. By contrast, Reilly allowed state police who'd investigated Ellerbe's shooting to take on much of the responsibility for summoning witnesses and presenting evidence. Some participants and observers griped that the lack of either a hear family have suggested that Ellerbe, who was black, would not have been shot had he been white.

A federal civil rights investigation is now under way at Vernon's request and Assistant U.S. Attorney A. Elliot McLean also attended the inquest to monitor testimony. "Usually, the district attorney would take on more input and present the witnesses. But I removed myself because of the sensitivity of this case," Vernon said.

"I wanted to be an impartial party and to put myself in the position of hearing everything just like the jury and seeing everything fresh." No one involved in the case attorneys for the Ellerbe family or the troopers, their supporters or the NAACP found fault with that decision. What some observers and participants did fault, however, was the free-form, wide-ranging and occasionally combative inquest format that resulted. Rules of evidence that govern court procedures in Pennsylvania don't apply to coroner's inquests because they are investigative tools, rather than hearings with binding outcomes. Rulings of a coroner's jury or hearing officer are advisory and can be followed or disregarded by prosecutors. Unlike criminal trials, hearsay evidence is permitted and written statements can be presented as evidence rather than requiring people to testify in person.

Such inquests unlike instances in which a per-Isori. already has been accused of a crime are held by coroners to determine how someone died and if someone else is criminally responsible. Reilly usually does not ask a judge or hearing officer to preside 'over them. In the Ellerbe inquest, however, state troopers who investigated the shooting called the witnesses. Then witnesses spoke extemporaneously or read from reports directly, rather than being questioned. In a few instances, they responded to questions from lawyers, jurors or Reilly but the typical give-and-take of courtroom proceedings did not take place. Vernon said her staff was not involved in presenting the case because she wanted them and herself to remain impartial in the event that her office might eventually be prosecuting someone involved in the case.

Mike was one of nine siblings, raised in Pittsburgh, PA by Greek immigrant parents, and he also leaves behind his baby sister, Anna Psilos, baby brother, Louis Glaros, and sister-in-law, Joy Glaros. A graduate of Carnegie Tech, Mike was the youngest engineer of bridges and buildings to work at Union Railroad, after which he went on to be an inventor, held several patents, an entrepreneur, and an owner of a manufacturing company. In retirement, Mike was an active member of the Greek Orthodox Church in Oakmont, PA, assisting them through a maior building program, and later chaired the building committee at St. Mark Greek Orthodox Church in Boca Raton, FL, committing all of his resources to the project of building a new sanctuary. Mike will also be greatly missed by his large Greek family, and by all of the people for whom he was a mentor, a father figure, and a friend, who remember his stories, his efforts to teach everyone the importance of hugging, his great intelligence and wit, his willingness to be silly, and his sense of humor that stayed with him through everything, to the end.

26, 2003, at age 77 formerly of Shaler Dad went home. A wonderful, kind and generous man, he was loved by all. He was most proud of his service to his country in World War II, receiving a Purple Heart and four Bronze Stars for his valor. His children were his pride and ioy. He retired from Alcoa after thirty years of service, and was a graduate of Central Catholic High School.

Surviving are eight devoted children, Mrs. Kathleen Maseth-Ready of Massachusetts, Joseph R. Kretz of Chicago, I Mrs. Roberta Marie Depenhart of Delaware, Stewart F. Kretz of Pittsburgh, Jeffrey David Kretz of Sandy Hook, Mrs.

Cecilia Petro of Pittsburgh, Mrs. Margaret Smith of Lancaster, and Mrs. Dianne McMaster of Ellwood City, PA. Dad rejoiced that all of his children graduated from college. He was the former husband of Katherine Ditmore Adams for 23 years.

He served in WWI I as a pilot in the Army Air Corps- first as an instructor in B-25s, and then went on to pilot A-20s inthe Pacific A sportsman, he played basketball and tennis in school, later he ran 10k races and became a bicyclist. He was an avid birder as a result of his hikes, painted birds on driftwood, loved digging old dumps to find antique bottles. He would sell his found treasures at the flea market which advertised "Birds, Bottles It1 he edited the Relative a monthly family newsletter with 50 subscribers Attending the University of Pittsburgh's "College for over he took 20 literature courses and wrote for Trinity Evangelical Lutheran Church, Connellsville, the operating Engineers Local 66, and the Connellsville B.P.O.EIks 503. She was a beautician, singer songwriter, and musician who appeared in over 100 television commercials and newspaper ads in the Pittsburgh area.

An Actress at heart, Gerry apppeared in two award winning movies, "Flash-dance" and "Kid both filmed in the 1980's. In addition Gerry, affectionately known as the singing grandmother, formed the Berry Music Record Label and produced and recorded her own songs that were played on local and national radio stations as well as abroad. Gerry is survived by her son, William Klug, daughters, Betty Corson Janet Saxton; grandchildren, Sheryl Saxton, Colleen Simpson Sally Saxton; great-grandchildren, Sean Katie Simpson, and brother, William Bechtle.
