By Jan Ackerman Post-Gazette Staff Writer Four years have passed since state police used court-authorized wiretaps to gather information that was later used to charge a Westmoreland father and his son with running a prostitution ring out of their adult bookstores. The bookstores have remained open while the criminal charges have bogged down in a morass of legal arguments and sometimes contradictory rulings regarding the legality of the wiretaps. Now the case against William Robert Birdseye, William Richard Birdseye and two associates is headed for trial as soon as defense attorney Thomas Crawford and Deputy District Attorney Michael M. Ahwesh finish arguing a host of pretrial motions that are piled high on the bench of Common Pleas Judge Raymond A. Novak.

The Birdseyes, both of Hempfield, are charged with promoting prostitution, possessing obscene materials criminal conspiracy. Roger Gray of Shadyside and David S. Kawelkewics of Charleroi are charged as conspirators. The arguments were heated yesterday as Crawford demanded that two confidential informants come forward to testify. Former state Trooper Louis Gentile said the informants were afraid that they would be harmed because the adult bookstore business has a "history of violence," especially in Western Pennsylvania.

Crawford objected to that and similar statements made by Gentile, who now works as director of the Bureau of Narcotics in the office of state Attorney General Ernie Preate Jr. "Has Bill Birdseye ever been arrested or convicted of a crime of violence?" Crawford asked Gentile. "Not to my knowledge," Gentile said. In December, Novak ruled that state police were legally allowed to use the wiretaps against a corrupt organization that engages in prostitution because prostitution is "dangerous to life" because of the dangers of AIDS. Crawford still plans to argue that information gathered from the wiretaps should be excluded because police did not have probable cause to obtain them.

i The pretrial hearings will resume today. he told a friend that he was going to take his own life, Washington County Coroner Farrell Jackson said. Love died of a self-infliced gunshot wound of the head, Jackson said. A rifle was found at the scene, police said. New Brighton contracts New Brighton council awarded a $2,500 contract last week to Santan-gelo and Associates, New Brighton, for design of a district justice office The borough is considering remodeling its property adjacent to the borough building and renting it to Beaver County for a district justice's office.

VVerley Pittsburgh, was awarded a $6,150 contract for design and consulting services to help the borough submit a grant application to the state De- Eartment of Community Affairs for usiness renovation on Fifth Avenue. Tuscarora Plastic Inc. is building its corporate headquarters on Fifth. Council appointed Richard Haddox to a five-year term on the sanitary authority. Haddox is a former mayor of the borough.

Water alert in Economy Economy residents are under a water conservation alert issued Friday by Mayor Kenneth Campbell. Residents nave been requested to restrict use of water to essential needs only until further notice. Washing cars and watering lawns or gardens is prohibited and violators are subject to fine. Campbell said Monday that the water level in the Rehoboth tank, normally 14 feet, dropped to four feet. He said the level rose one foot yesterday.

The tank supplies Eart of the borough. Campbell lamed the water shortage on increased demand from new homes, a recent warm spell and the possiblity of a waterline leak. Economy expects to begin on June 1 using a new larger waterline along Legionville Road and a new pump house, which should alleviate the chronic water supply problems in sections of the borough. Chief of labor relations Richard Joyce, the assistant chief of the Public Safety Department's Office of Professional Responsibility, has resigned his post to become the city's labor relations officer. Effective Monday, Joyce, 34, of the South Side, will become the city's chief labor negotiator.

He replaces Diane Holmquist who left the city's Law Department post earlier this year, said Albert J. Neri, the mayor's spokesman. Since July 1986, Joyce has headed the OPR, which investigates allegations of impropriety by the department's uniformed personnel. In his new job, Joyce will earn $43,200, or $5,320 less than he was paid as head of the OPR, but he will nave more free time to devote to his private law practice, Neri said. A successor for the OPR position has not been named.

Retenauer to get hearing Common Pleas Judge Patrick Mc-Falls set a hearing for June 12 to consider a request by a fired employee of City Controller Tom Flaherty to get his job back. Philip Retenauer, a former account clerk and contract auditor, was fired Friday for "extreme insubordination" after Flaherty aides said he made "an obscene gesture at the controller." Retenauer contends he was fired in retaliation for his activities in helping to organize the office's rank-and-file employees and for his appearances before various boards, including the state Ethics Commission, the Pennsylvania Public Employee Labor Relations Board and the Pittsburgh Police Department Man's skeleton found The skeletal remains of a Washington County man who was reported missing in July were found yesterday in a wooded area in Beallsville, state police said. The remains were identified as those of Donald Love, 55, of Canonsburg, who had been missing since July 18 when Pittsburgh sklee Sunset Wed 8 16 m.
