ENRIGHT MARION JEANNETTE Marion Jeannette Enright, 65, daughter of Elizabeth I. and the late Oliver "Red" Pellizzaro, died early Monday morning at her home in Monroeville. Marion was born in Pittsfield, Mass, graduated from Pittsfield H.S., married Walter O. Enright on Nov.

4, 1950 and had seven children. She is preceded in death by daughter Christine, brother John Pellizzaro and husband Walter. Marion was a resident of Monroeville since 1966. An active Democratic Committee Woman in the 170's, she ran for the office of tax collector. Marion was also an active member of St.

Bernadette Parish, where she taught CCD. While raising a family of six, she began a seventeen year career at Equitable Gas Company in the property records dept. where she was beloved by many. She retired in 1995. While her family was her highest priority, she shared her unparalleled zest for life with all who crossed her path.

In her free time, she enioyed golf, travel and supporting the state lotteries. A federal judge ruled yesterday that he will sanction Brentwood Borough because it misled attorneys for the family of Judith Barrett about the existence and subsequent disappearance of evidence associated with her death. U.S.

District Judge Robert J. Cindrich said during a hearing that attorneys for the Barrett family had to question more than 40 people to learn that two additional police reports were written, one by former Brentwood police Chief Robert Hartshorn and another by Officer Harry Lutton. Both are missing. The attorneys' investigation, the judge said, led to the unearthing of a color photograph of a blood-stained bus kiosk where Barrett's body was found as well as telephone and radio logs from the night of her death. Re- ployees, Barrett, 26, was found dead in a Brentwood bus kiosk in the early morning hours of June 27, 1993. Hours before she died, Barrett argued with her fiancee, Brentwood police Sgt. John Vojtas. The bullet that killed Barrett came from Vojtas' service weapon. The Allegheny County coroner's office ruled Barrett's death a suicide.

But in a 1997 federal civil rights lawsuit, Barrett's family says Vojtas provoked her death with physical and mental abuse. Vojtas I has denied abusing Barrett. Cindrich said Brentwood made misleading statements in court papers, initially saying that only Brentwood police Officer John Nort wrote a report about Barrett's death. Only after attorneys for the Barrett family questioned Hartshorn and Lutton did they learn that both wrote reports, which are now missing. Brentwood's misleading statements, Cindrich ruled, forced attorneys for the Barrett family to ask additional questions of three officers who went to the scene -Nort, who was the first to arrive, Hartshorn and Lutton.

The judge also ordered Brentwood to pay costs McDevitt and Rush incurred in filing their request for sanctions. McDevitt said the cost of filing four motions for sanetions will be "well over $20,000." Klaber declined comment on the judge's decision. The judge also asked McDevitt to submit portions of the sworn statement given last year by Mariann Shaffer, a former Brentwood employee. McDevitt said the borough failed to tell her she was to appear and give a sworn statement. The judge said if he became convinced that Brentwood failed to notify Shaffer of the deposition, the borough would have to pay the costs associated with her failure to appear, which would include the cost of a subpoena, a court reporter and the lawyers' time.
