B-6 PITTSBURGH POST-GAZETTE THURSDAY, JANUARY 7, 1999 STATEREGION Brentwood faces sanctions in death at 2:20 a.m. on St. Patrick's Day, 1097. Allred said the fight was over when police arrived, so they tried to disperse the crowd outside the bar. Sewell was one of the people outside the bar.

I Ie told investigators he started running when he heard a voice behind him threaten to shoot him. When Sewell started to run, Bonacci took off after him. Allred said that Bonacci caught up to Sewell, and hit him in the head at least twice with a heavy aluminum flashlight. Sewell eluded Bonacci, but two Braddock police officers, who had responded to help Swissvale, found him under a bed in his girlfriend's house, four blocks from the bar. Sewell didn't fight as the officers pulled him from under the bed, Allred said, but when Bonacci came into the room, he kicked Sewell in the side.

Hugus, who is now a sergeant for the East Pittsburgh Police Department, testified yesterday that Sewell was bleeding from his head when he was brought to the Swissvale police station. Hugus said Sewell was on his knees, facing a row of filing cabinets, with his ankles crossed and his hands cuffed behind his back, while he waited for an ambulance to take him to a trauma unit. That was when Bonacci came in and the two shouted at each other. Allred said doctors had to close Sewell's two head wounds with stitches. Sewell was charged with aggravated assault, resisting arrest, disorderly conduct, criminal mischief, breaking and entering, and trespassing.

Those charges were dropped on Monday by the Allegheny County District Attorney's Office. Bona'cci's attorney, Thomas Ceraso, said the officer did not use unreasonable force. He said Sewell was struck by the officer after Sewell jumped off a porch onto the officer during the chase. He said Bonacci broke a finger during the ensuing fight and tried to subdue Sewell. Sergeant testifies about argument in civil rights trial ByAnnBelser Pobt-GaMlo Suit Writer Phillip Sewcll was on his knees, handcuffed and bleeding in the Swissvale police station, when Officer Raymond Bonacci screamed at him and started toward him, a police officer testified yesterday.

"Mr. Sewell and Officer Bonacci started exchanging words at the top of their lungs," Sgt. Eugene G. Hugus said. "IBonaceil took one step, and that when Lt.

An-thony) Costa took a step between them. Lt. Costa asked Bonacci to step out into the hall." Sewell, 34, had been arrested by the Swissvale police, but those charges have been dropped. Instead, Bonacci, 32, of Murrysville, a Swissvale officer who is currently on leave, was seated yesterday at the defense table, charged with violating Sewell's constitutional rights. Bonacci was indicted by a federal grand jury in June on charges that he used' unreasonable force and deprived Sewell of his liberty without due process of law.

"He is charged, essentially, with using unreasonable force and beating Mr. Sewell," David L. Allred, a prosecutor with the U.S. Department of Justice in Washington, told the jury in U.S. District Court during his opening statement yesterday.

Allred told the jury that Ronacci was called to a fight at the Lounge on McCague Street in Swissvale opening the depositions' of Hartshorn, Lutton and Nort. Depositions are sworn statements lawyers use to prepare their cases. Cindrich also ordered Jerry S. McDevitt and Mark A. Rush, attorneys for the Barrett family, to submit a schedule of fees and costs associated with reopening those depositions, including serving subpoenas, paying a stenographer and the attorneys' time.

The judge also ordered Brentwood to pay costs McDevitt and Rush incurred in filing their request for sanctions. McDevitt said cost of filing four motions for sanctions will be "well over $20,000." Klaber declined comment on the judge's decision. The judge also asked McDevitt to submit portions of the sworn statement given last year by Mariann Shaffer, a former Brentwood employee. McDevitt said the borough failed to tell her she was to appear and give a sworn statement. The judge said if he became convinced that Brentwood failed to notify Shaffer of the deposition, the borough would have to pay the costs associated with her failure to appear, which would include the cost of a subpoena, a court reporter and the lawyers' time.

PA 15216. Mr. Dissen worked for the Allegheny County Dept. of Aviation and was formerly employed by the F.A.A. as an Air Traffic Controller.

By Marylynne Pitz PostGa'ette Stall Writer A federal judge ruled yesterday that he will sanction Brentwood Borough because it misled attorneys for the family of Judith Barrett about the existence and subsequent disappearance of evidence associated with her death. U.S. District Judge Robert J. Cin-drich said during a hearing that attorneys for the Barrett family had to question more than 40 people to learn that two additional police reports were written, one by former Brentwood police Chief Robert Hartshorn and another by Officer Harry Lutton. Both are missing.

The attorneys' investigation, the judge said, led to the unearthing of a color photograph of a blood stained bus kiosk where Barrett's body was found as well as telephone and radio logs from the night of her death. The judge said attorneys for the Barrett family had to go through the "tedious process" of questioning every current and former employee of Brentwood to unearth the documents and photograph because the borough's attorney did not make a "good faith" effort to determine what documents existed and ask enough questions of borough em HECKMAN KAREN L. Jacobs, Sheryl A. Kline, Kathryn l. Rozumalski, Cindy Jo Parker, Dennis Scott A. Richard Bud Jacobs; also ten grandchildren. Re ployees, Barrett, 26, was found dead in a Brentwood bus kiosk in the early morning hours of June 27, 1993.

Hours before she died, Barrett argued with her fiancee, Brentwood police Sgt. John Vojtas. The bullet that killed Barrett came from Vojtas' service weapon. The Allegheny County coroner's office ruled Barrett's death a suicide. But in a 1997 federal civil rights lawsuit, Barrett's family says Vojtas provoked her death with physical and mental abuse.

Vojtas has denied abusing Barrett. Cindrich said Brentwood made misleading statements in court papers, initially saying that only Brentwood policeOfficer John Nort wrote a report about Barrett's death. Only after attorneys for the Barrett family questioned Hartshorn and Lutton did they learn that both wrote reports, which arc now missing. Brentwood's misleading statements, Cindrich ruled, forced attorneys for the Barrett family to ask additional questions of three officers who went to the scene Nort, who was the first to Hartshorn and Lutton. Brentwood, the judge said, must bear the costs associated with re tired from Westinghouse Research.
