Synopsis of an Act to be Voted Upon at the Next Election The classification of the business of Insuring and guaranteeing titles to real estate is proposed In an act to be voted upon In California in November. The California Land Title Association, which includes representative abstract, title and title insurance companies In nearly all of the 58 counties of California will meet at San Diego September 29 and 30 to discuss the proposed amendment and lay plans for its adoption, Tho following synopsis of the new, with comparisons with the title Insurance law aa it now stands, has been issued: "STATE SUPERVISION. All title companies under provlslopa of this enabling act will be placed under the control and regulation I of the State Insurance Commls- sioner, the same as other Insurance companies. "FINANCIAL RESPONSIBILITY. A minimum deposit of $100,000 must -now-be made with the State Treasurer before companies may engage in the business of title insurance.

This insures financial responsibility to the guaranties and policies Issued by title Insurance companies, but because of the minimum deposit of large centers of population enjoy the benefits of title Insurance Smaller communities are deprived of this modern and essential method of guaranteeing titles. "THE NEW LAW By classifying counties according to population, as contemplated by this amendment, the Legislature may prescribe smaller deposit, than $100,000, In 'less populous communities. The Legislature will provide a sum sufficiently large, however, to Insure adequate flrfanclal responsibility. By this means, title companies in practically every county will qualify to write title insurance, eliminating the present control of the title business by large cities. All companies so qualifying under the proposed law would be subject to state supervision.
