STITT HOWE WIN BIG CASE Supreme Court Affirms Decision Of Judge McClenahan in Big Logging Case BIG VERDICT FOR PLAINTIFFS Rat Portage Lumber Co. it is Claimed Refused to Carry Out Its Contract The supreme court of this ha- affirmed the decision in favor of Stitt A Howe against the Hat Portage Lumber company, in a big timber eon tract case that ha- in litigation in the district courts of Brainerd and Du luth for the past four years, By terras of the decision affirmed, Stitt A Howe get alarge quantity of Itasca pine, worth aliout by payment of a mortgage covering the timber. This decision was rendered in the district court after a trial in this city, Judge MeOlenahan presiding, It was claimed that Mr. Stitt bought feet of Itasca county timber, the title being vested in the Rat Portage Lumber company. Stitt A Howe were to log it at market price for such work, -After they had logged feet ii was claimed that the Hat Portage Lumber company refused to carry out its contract, and that the company claimed the timber.

Stitt A Howe brought action the corportion to have the deed deelar- rd a mortgage, offering to redeem by paying the Rat Portage Lumber company back all mon it had ad vane cd for timber. The court found that was still unpaid $03,000 on timber estimated at 12,000,000 and found it to worth $5 per thou-ami feet at the present market price. Stitt A Howe represented in the action by ll. B. Fryberger.
