Members of the Tulsa Metropolitan Area Planning Commission Wednesday refused to certify plans for the district because a portion of it fails to conform to the Comprehensive Metropolitan -the study that sets out areas of probable future development.

The huge water district, encompassing a large, portion of Rogers County north and of Claremore, also extends west. miles into eastern Tulsa County, near Owasso. Owasso's representative at the TMAPC meeting--Ray Clark said the city fathers there violently oppose the water district coming into Tulsa County, because has plans "probably within a year" to annex eastward to the Tulsa County line. Owasso, therefore, would be supplying water to the area within the proposed water district. But Art Lane, an engineer working on plans for the district, says the district will be operable before Owasso has the money to install water lines in the area.

The lack of certification may mean that Water District No. 3 will be unable needed govPrnment funds to install water lines to the rural areas hence families there will still be without water, other than from wells, as they have been in the past. Funds would come from the Farmers Home Administration and would be used to lay water lines to each home in the district.

The water district, said Lane, already has collected between $30,000 and $40,000 from residents in the planned district toward water line installation. What it boils down to, noted TMAPC members, is two different groups attempting to do the same thing.

What this means is that anyone receiving approval by the TMAPC and City Commission on a zoning application must finalize that application with the time allotments, or the zoning will become void and a new application will have to be filed.

X15 Plane Achieves 3,785 MPH Speed LOS ANGELES -Air Force Lt. Col. Robert A. Rushworth flew the X15 rocket plane 3,785 miles an hour Wednesday on a stability control test. He was at the controls of a model that shortly will be equipped with external fuel tanks.

The test was aimed at determining whether, with the tanks, the craft will be more stable with or without the lower vertical tail fin. The removable fin was attached for the test. World's Own Service MUSKOGEE-American Flyers Airline Corp. of Ardmore was hit with its second major suit Wednesday when the mother of a soldier killed in the April 22 crash near Ardmore of a Lockheed Electra filed for $1.5 million damages in federal District Court. The suit was filed by Tulsa attorney Joseph LeDonne on behalf of Mrs.

Jean M. Stallbaum of Philadelphia, Pa. She is the mother of 17-year-old Joseph R. Stallbaum, one of 77 Army recruits killed when the airline's prop-jet aircraft plunged into the earth near the Ardmore airport. Tuesday, American Flyers was involved in a $1 million damage suit field in Chicago by the wife of an Army private killed in the crash.

Mrs. Tina Lara instigated the action because her husband, Richard Lara, was among the recruits aboard the chartered aircraft when it crashed during its second approach to the airport. Mrs. Lara's suit said the airline negligently failed to keep the aircraft under safe control during landing procedures. She also alleged the plane's pilot, Reed Pigpresident of the firm, suffered from a heart ailment for many years and the Federal Aviation Agency had not been notified of this.

Pigman's heart condition was disclosed May 14 when members of the House Commerce Committee were told by a federal official that a post-mortem on Pigman revealed he had arteriosclerosis. The investigation also disclosed Pigman had been under the care of a private physician for a number of years because of the heart condition. Townsend did not say what his recommendation would be to Gov. William H. Avery. Bailey, a 79-year-old whitehaired ex-convict, is now working in Joplin, for a woodworking company. Townsend told Bailey his reason for a pardon was not sufficient grounds for a pardon." Bailey has been on parole since March 31, 1965.

He originally was sentenced to 10 to 50 years for the $31.000 robbery of Citizens Na! tional Bank of Fort Scott, in 1932. Later the same year, Bailey was convicted of conspiracy in the kidnaping of Charles F. Urschel of Oklahoma City. Bailey accused of possessing some was, $200,000 ransom paid for Urschel's release. Bailey was paroled from the federal charge in 1962 and was returned to Lansing to complete the bank robbery sentence.
