Kerr Jr. asked Federal Judge Louis Rosenberg to consider a motion for a preliminary Injunction against Local Board 11, which ordered the reclassification and induction after declaring Colfax delinquent last January for failure to carry his draft card. In his petition, Kerr stated that when Colfax notified the board he Intended to appeal the 1-A classification, the board responded that an appeals board already had affirmed the reclassification. Kerr described the board's action as being "punitive in nature" and beyond it's statutory and constitutional power. "It has the effect of penalizing the assertion of First Amendment rights under the U.S.

Constitution," Kerr's petition declared. The 3-A classification in which Colfax was originally listed generally includes fathers of dependent children or supporters of other dependents. Kerr's petition asked the court to nullify the board's determination of delinquency and reclassification order and to enjoin the induction procedures. Judge Rosenberg slated a full hearing for 10 a. m.
