Crcer, Mills Co. Cam Do Business at the Stock Yards Fendlnir the Hearing of Their Case. The sensational article printed In a. morning paper yesterday concerning the action of the Live Stock exchange in obey ing thei order of the United States court. by reinstating Greer.

Mills t. temporarily, contained the statement that United States Marshal Jo Shelby had visited the exchange and notified the directors that unless the board at once complied with the order of the court he would arrest every one of them. That statement Is false, according to the statement of Marshal Shelby and the directors. Marshal Shelby said yesterday, when asked about the story: "I visited the exchange to serve the sub-poenaes of the court and was shown every courtesy by President Stoller and each member of the directory, and when the processes were served they at once called a. meeting and obeyed the order of the court, temporarily reinstating Greer, Mills Co.

Their actions were perfectly proper and manly, and I did not threaten to arrest anyone for the very good reason that there was no cause for arrest, and was "utterly 'powerless to make the arrest' unless there had been warrants issued for con-empt of court. Thtre was no spirit manifested on the part of the men served to do anything other than obey the summons, end it was done promptly. There was no basis whatever for the story printed, and 1 am at a loss to understand how such misstatements could have gotten out. The directors of the exchange are business men, who are ready to obey the orders of any court of competent Jurisdiction." Greer. MiUs Co.

are only reinstated until the federal court takes final action their application for-, a permanent -In-, "junction. ARE' SORRY THEY MARRIED. Smith M. Ford and Others Ask the Circuit Court for Divorces. Smith M.

Ford, the Populist politician, brought suit in the circuit court for a divorce from Mary H. Ford a or two rince. The suit -was filed by Henry S. Julian and the greatest pains were taken to keep the names of the parties secret. A false name was placed on the appear ance docket in the circuit clerk's office, prcsumbably at the request ot Ford himself.

Desertion is the allegation. Mrs. Ford, who Is a woman of talent and literary ability, has for some years past keen accustomed to giving lectures and 'readings on art and other subjects. It is said that she and the three children born to Ford and herself are now in Chicago. Mrs.

Almlra Gllkey brought suit for a drvorco from Elbert D. Gilkey yesterday. She claims that she Is the owner of a grocery store at Twenty-first and Vine streets. The proceeds from the sale of the groceries, she says, her husbands keeps for himself. She charges him with other indignities.

They have three adopted children whose care she wishes. Suit for divorce from Delia Maxwell -was brought by Arthur Bird Maxwell through his next friend. Arthur F. Maxwell. The firm of Mescrvey.

Pierce German, attorneys, filed a divorce suit In the circuit clerk's office yesterday. They had the first names of the parties placed on the appearance docket, but kept off of it the last name, which begins with a G. It Is said that the parties to the suit are relatives of Attorney German. RAISED A TECHNICAL rOINT. Brewers Claim Tliey Are Not Guilty of Ylolatlnic Interstate Law.

Commissioner Parry spent three hours yesterday afternoon listening to the preliminary Investigation of the brew.ers charged with violating the anti-combine but did not conclude the hearing. Owing to the absence of certain witnesses which the government very much desires to examine to-day. The conclusion will begin this morning at 10 o'clock. Yesterday the main feature of the hearing was the attempt of the brewers to get out of ihe affair on a technicality, and this morning there will be another effort made to seek covir under the same claim. The brewers claim that they are not guilty of violating tho interstate commere law.

because the United States supreme court decided in reversing Judge Brewer's original package decision that liquors when in a prohibition state were contraband and without value In the eyes of the law, and. therefore, there could be no combination to do an act which the highest court has expressly declared could not be done. The commissioner did not see the matter that -way, and the attorneys will hunt for the decision and slow it this morning. Ths testimony yesterday was largely a repetition of that shown the opening day. and It Is claimed that such witnesses as were called for this morning will make stronger statements than those who have testified.

So far the government has shown some strong instances of interference in business and the collection of extortionate prices "H.1 le effort this morning will be to show that kind of work In Kansas, and thus make the alleged violations Interstate, Circuit Conrt at Independence. David Condon's suit for personal Injuries sustained at the hands of Joel Stelbe' while employed by the Kansas City Sprinkling Company, resulted yesterday in the plaintiff bting awarded 1 cent damages. He sued for $1.00. The plaintiff nnd defendant were employed by the vprJnkllng company. The defendant was ashler and a wordy war.

followed by a kt.oikdown reulted over a dispute relative to a check. The Evuns-Snyder-Buel Company obtained Judgment against Howard M. for yesterday on a note held by the plaintiff. J. C.

Sampson and T. W. Taylor, of Lee's Summit, were parties to a suit over $220. In Justice McDowell's court at Lee's Summit. Taylor received Judgment for S2M, but the decision was reversed yesterday.

Taylor sold C. Rlttenhouse timothy seed and the same was placed in an elevator for shipment to a Kansas City firm. The firm refused to take th? seed. J. B.

Sampson had a claim against Rlttenhouse and Jn liculdatinn took all of the seed in the elevator. Taylor subsequently found out the facts In the case and brought suit against Sampson to recover. Judge Henry held that-Rittenbouser not was the responsible party and reversed the Justice. Attachment Suits. Attachment 6uits were brought against L.

O. Hauge. a Kansas grocer, by T. M. James and by the Campbell-Eaton Crockery Company in the circuit court yesterday.
