from Page C9 who are owed $20000 Michalek retorted that the sale is the only way to recoup some money for the investors If the banks take over the property in stead the investors see a dime he predicted just think what he told you is the best excuse he could think erdman said How projects reached their financially strapped state is the central issue The attorney general suspects Michalek diverted excessive pay offs to himself and his other com panies Michalek raised $8 million to $9 million for the Chestnut Ridge medical offices and the apartments from banks investors and his own cash Rosen estimat ed Yet he was prepared to sell them to Schectman for a net profit of only $375000 after the mort gage liens and taxes were paid Rosen said did all the money Rosen asked Simple said Michalek The money went toward construction payroll utilities maintenance and other costs associated with the project Any money he collected in legal fees and other services to the project he pumped back into the project he said The apartments unfortunately were perhaps too expensive for the market at this time Michalek said And at a vul nerable point in the spring of 1988 contractors demanded im mediate payoffs and investors started a drumbeat for return of their investments Threats of bank foreclosures followed But if he were allowed to hold onto the apartments for three more years and convert them into condominiums that would sell for $125000 or more apiece inves tors would recoup most or all of their money Michalek predicted It may take a judge and an army of attorneys to decide whose version of the demise of Michal vision is correct The only thing Kalinowski is sure of is that he and his family are out $142000 That includes $71000 worth of appliances Kalinowski supplied to the apartments as one of Michal contractors $46000 invested in the Chestnut Ridge medical of fices and apartments and $25000 invested in the ox Chapel estates project which is not yet complete Michalek said that fewer than 50 people invested in the ox Chapel estates venture a limited partnership known as Tremont and all stood a good chance of getting paid back In comparison hundreds invested in the Chestnut Ridge project Kalinowski remembers the lav ish cocktail parties Michalek would throw at local country clubs to impress investors and coax new investors into the partnerships Michalek drew on networks of friends and friends of friends to raise cash Kalinowski said he feels guilty about some people who invested just because his name was already on the investors list have one personal friend who golfs with me ani I even want to talk about it with Kalinowski said Kalinowski said he now is working longer hours putting off remodeling his Orchard Park ap pliance store and credit cards aid consumers Associated Press WASHINGTON Credit card disclosure rules taking effect today offer the 1 07 million card holders a new opportunity to shop around for lower interest rates consumer activists say Industry analysts however say they expect the new rules to have little impact at least over the short haul The regulations adopted by the ederal Reserve Board in April require credit card issuers to dis close the interest rate monthly fee grace period and other terms in a chart on applications used to sign up customers Previously the card's costs did not have to be disclosed until it arrived in the mail The new rules also require companies to notify existing cus tomers in advance when their ac counts are about to be renewed and another annual fee charged should use the re newal notice as a reminder to switch cards and said Elgie Holstein director of the Bankcard Holders of America a consumer group He advised cardholders to pay off their high rate cards with a cash advance from a low rate card New York already has its own disclosure rules but they will be replaced by the new federal regula tions The new rules apply to bank cards such as Visa MasterCard
