136 southwest-of Lancaster Railroads sue over truck weight limits JEFFERSON CITY, Mo i A A spokesman for Gov Joseph Teasdale today said the governor had no immediate comment on a suit by a dozen Missouri railroads challenging his decision to temporarily raise the weight limits for trucks traveling on major state highways. Notification the suit would be tiled in the Missouri Supreme Court was received by the court Thursday, according to a couit spokesman. The suit, which formally will be filed July 10 by the railroads and several labor groups, calls Teasdale's action unconstitutional and asks the judges to force state officials to restore the former 'state maximum truck weight of 73,280 pounds Teasdale's press secretary, Dale Amick, said the governor would not comment on the action until he had a chance to study the suit in detail. At the urging of President Carter. Teasdale recently raised the maximum weight limit for trucks to 80,000 pounds pendent truckers.

His order was issued for 30 days, but can be renewed. Carter made the same request to several other governors whose states do not allow the 80,000 pound trucks on their roads Teasdale acted under a new law giving him emergency fuel allocation powers, claiming the bigger trucks can haul more and thus save gasoline and diesel fuel. Missouri was one of several Midwestern states that did not allow trucks. President Carter recently urged those states to relax their limits in an effort to answer one of the complaints of striking truckers. The suit claims the emergency powers law doesn't give the governor authority to relax Missouri's weight limit.

The railroad industry said Teasdale's action gave the trucking industry an unfair competitive advantage. The railroads were joined in their suit by representatives of the United Transportation Union, the Brotherhood of Maintenance Way Employees and the Brotherhood of Locomotive En- an effort to answer one of the complaints of striking inde- gineers.
