of Brookville and International Union of Electrical Workers Local 905 have 30 days to file briefs in their dispute over unemployment compensation for 78 replaced strikers. The Indiana Employment Security Division Board asked for briefs after hearing arguments in the long dispute Wednesday. It did not indicate how long it will consider the case after receiving the briefs. Sperry had asked that the appeal be heard by the full IESD board instead of the usual three- man review board, even though an IESD referee had recommended the replaced strikers not be paid benefits. Referee Paul Newman ruled that workers actually were replaced by June 26, 1961, two and one-half months after the start of the strike, and thus should have been eligible for benefits.

However, he said he also found that they continued picketing for 11 months longer and forfeited their right to benefits because they made no real effort to find other jobs. Newman also refused payments for 13 fired by Sperry for strike violence. Sperry contended the 65 others were never really fired. It sent them dismissal letters but said the letters were only strike strategy.
