An Import ant. ruling retarding thf application o' the "contract lubor law" of wai made by Judge James Leathers of th superior court, to the effect that the board of managers of the Indiana re formatory at Jeffersonville have vlo luted the provisions of the act by let ting a contract to the Indiana chair works for the employment of a lare number of convicts. Samuel 1.1. Wells a chain manufacturer nt Greenfield Instituted the proceedings. He alleged that the act provided that the con vlcts should not be employed on out side contracts, but that there was to have beeen established nt the reform atory a training school that was tc furnish the various departments of th state manufactured articles at cost He Insisted that a contract had beer let to the Indiana chain works thai was not only a violation of the law but which would cost the tax payers $50,000 annually.

The attorney gen eral replied that the state was tin real defendant and that It stood by lti right not to be sued. Judge Leathers however, ruled that the law was be Ing violated and that the agents of th state In the matter were subject tc the court's opinions. Judge Leathers set a date for the hearing In June when he will determine whether oi not an order restraining the reform atory from continuing the contract shall be lssund. Superintendent Whit taker fears that an injunction would tie up all the departments of the re formatory In which the convicts would have to remain in idleness until the court decided the questions at Is sue. The railroad commission has decider to file a suit in the local county courts next week to test the constitutionality of tho "full train crew" law unacted by the recent legislature, providing that on all trains of over fifty cars six men shall be employed and on all other trains, five men.

The rail roads have served notice that they will not observe this law on trains that are engaged in interstate traffic. This would practically kill the law, as near ly all of the fifty-car trains are those that are used In hauling freight front one state to the other. The comnils slon will try to have the case rushed through as soon as possible to the su preme court, where the constitutional Ity of the law can be determined. II Is understood that nearly all of th roads have agreed to observe the new law prohibiting them from keeping men on duty more than sixteen con secutlve hours In twenty-four. Theodore P.

After Pronouncing Infant, Dead Hs Had a Happy Thought and Made a Hasty Investigation, i Found That the Child Had Swallowed lt Tongue and Prompt Action Saved Its Life.

Brazil, April One of the most miraculous oases of the supposed dead being brought back to life occurred here last evening when the slx-weeks-old eon of Mayor It. L. Shat-tuck was restored to life, after the pulse had ceased to beat for several minutes. The child was being held by Its mother when It suddenly fell back Into her arms, and after a few gasps for breath apparently expired. The household was thrown Into confusion by the supposed death of tho baby, and when Dr.

T. A. Glango arrived a few minutes later the family was weeping over the child. Dr. Glns-go felt the pulse of the baby.

and announced that It was undoubtedly dead. He then pried open the baby's Jaws, which wero tightly closed, and discovered that In nursing the Infant had drawn its tongue down its throat, which had swollen badly and had strangled the child. Removing tlw tongue from the throat. Dr. Glasgo applied the usual means of restoring respiration, and after moving its arms up and doWo a few times and pressing on its chest he was rewarded by spo-lng the infant breathe.

In. a short time the child had fully recovered from Its experience and was restored to Its mother's arms, laughing and cooing. Dr. Glasgo, brought the Infant back to life, Is a physician of the old school, having practiced medicine In this city for more than forty years. Few physicians would have thought, of looking In the Infant's mouth, but Dr.

Glasgo had known of babies "swallowing their tongues" before and by prompt action brought the child hack to life after It had apparently died. ONLY ONE INDIANA SPEECH However, the President May Howd'y to Muncle People. Say Indianapolis, April 25. A Washington dispatch says that announcement was authorized at the White House today that the president would not be able to make any stops In Indiana during his trip from Indianapolis to Lansing, on the evening and night of May 30. Letters have been received from several towns along the route of travel, asking If It would be worth while to extend formally an Invitation for the president to stop for a three- or five-minute speech.

Secretary Loeb says that as the president's train would not get away from Indianapolis until late In the afternoon the trip would have to be made at night, and he foels that It would be out of the question for him to encourage any entertainment along the way. The train, according to the present arrangement, will go out of Indianapolis over the Big Pour through Anderson, Muncle, Fort Wayne, Waterloo, Angola and Hillsdale, Mich. Anderson and Muncle will be reached early in the evening, and it Is probable that if there should be crowds there the president might apeak briefly. Under the schedule that has been prepared Fort Wayne will be reached about 11 p. ni.

Under the Beardsley Law. Poseyvllle, April 25. The Law and Order League, of the previous existence of which llttlo was known, filed a complaint against John Heck-man, a farmer, alleging that he made a false statement in order to procure a quart of whisky from Joseph 7. Shafer, a druggist. The bottle fell into the hands of members of the league when It was In possession of William E.

Elliott, and It had on It a label showing It bought by Heck-man for medicinal purposes. The testimony showed that It was bought for Elliott by Heckman, who made a false statement to tret It. The Jury found Heckman guilty and he was fined $25 and costs. It ia the first case tried under the Beardsley law In this part of the state, and It attracted considerable attention. Widow Gets Large Estate.

Jeffersonville, April 25. Judge II. C. Montgomery has declared the will of Prof. W.

W. Borden to be Invalid. This conclusion was reached on the basis that Prof. Borden did not make his meaning clear. Thus, tie widow becomes the sole beneficiary of an estate valued at about $1,000,000.

Prof. Borden bequeathed to the people of Indiana his museum, containing specimens gathered from all ports of the world. Another beneficiary was the Indiana university. When Mrs. Borden sued for a construction of the will none of the trustees responded.

They gave as a reason that they did not dire to undertake the execution of Prof. Hord'-n's wishes, Inasmuch as the provision for maintenance had not been made clear.
