Otn, Soutteau: Dear Sir: You will receive with this let- ter, a petition, of Fakes, the contents and purposes cf which it is neediest to state.

I have known. Mrs. Fakes for macy years acd do sot hesitate to state that she is a lady of good social position, of ungues tionable truth, and in every way worthy of your kindest consideration. 1 think you may rely on the statement of. facts with faJ confidence of their truth.

I Cled, as counsel, a bill for Airs. Fakes, to have all ber internet in her father's estate settled upon her and her children, and my knowledge of her husband's pecuniary con ditioa I am satisfied that all tae property wnich Mrs. Fakes has in poites.ion, was derived directly, of indirectly from her father's estate. I would most earnestly urge upon you. General, the justice and propriety of granting all that Mrs.

Fakes asks in her petition, feel confident that she does not state too strongly her destitute condition, and it certainly can not ba the policy ot tba Government to permit the burthen of the war to fall so heavily upon those of surh moderate means. I Yours truly, 2, i Joaoaa Etokcs. ToMeJ, G'cn. JJojmcji Comswntfiry the District cf TenntMt Your petitioner, Mary Fakes, would ra- speetfuTly state that on the 15th and' 16th dsys of October last, a small squad of men under command or Col. Joseph Bluckburn' cams to her house in Wilson county, Tennessee, aud seized and carried off one horse nine years old and two raluable marcs, on of which waa with fnal, two boys saddles, the certificate of her having taken the oath, a small amount rf assay, aud some other articles of small value.

AU these articles of property belonged to her sole and separate use, having bvn bought with means derived uom her father's estate. Her hus band, Daniel Fakes, had no interest. CoL Bla-kburn left with her a broken down horse branded U. B. for which he has aicc given bar a protection paper, and so far she has been permitted to keep this horse undisturbed.

The two msres were unfit for the service and be promised to let her bare them again, but she has made several efforts to rejsin possession of them without success, Pome eight or ten days ago aba went Col. tleekburn's Head ousrlers to mala a last rfiort to regain her property. CoL Blackburn informed her that the horse and one of the mares had been worn out in th service tbs one with foal had not been turned over to tba Gov eminent, that she bad a coll end it was possible that he could get her aad the colt era: a. Lieut, vannetta oi ioa. ciacmum a command, informed your petitioner tint the mare and eolt waa in the neighborhood of Liberty, ia DeEalb county, Tennesson.

r.o v'scau i Dear Eir I hava thia day received from your Headquarters, (ofScially) a letter ad dressed yon from Jordan Stokes; also, a petition- from Mary-Fakes, -prsyice yon to horses captured by me whiV OijiU'ii of Compeev 5th acted upon those naper. rf-rre to me, snd forwa'd to yon. In ji'ce to nvif and men, yon will brer with pie vntil I explain to yon the eir. am stances tinder which those horses were taken, as I tsure yon that Jordan Slcl" 'a lab'wing under a rrwat mintaka, in enden-irjg Urs. Farket' petition, as ha docs, or he wisbe to pro.eeute and persecute meper-bttps for money, at he' is a gentleman of the.t profession.) I acknowledge, th fit Uie horses spoken of ia the petition were tskn by men of jny company, but not tsnder the circumstances ss stated in the petition, I waa not Colonel of a regiment, bnt undor orders from Colonel B.

Ptnkes, to whose yoriment I belonired, and 1 think that Jor.isn Stokes has but little confidence in his brother's management of a regim', when he as business man ought to Vcw, and perhaps does know, tbst when fclrses were seized by me or my eommtnd always took pains in givios; to the loyal the proper papers to ensure tha pay for their damages. After doing so contend that if any one of a recimect fg in fftcU it is the commander and quartermaster if th psv for damans are not received by the sppH-esct. Bet to rcy exp'anatinn. While passing through th neighborhood in which Fakes resided, I learned that at his hoe were throe horses, that he had captured on a bush whacking expedition, and tbst Fakes h'mself wss a rsirnlsr beshwhaeker. As soon as I ssw the horses that mv command hfld taken from your petitioner I found that two of them were government property, which were sceordingly turned over.

The mar In foal, spoken of, was kept by me and I turned another hers ever in her pise to the government. Yet upon tha application of a lady deemed it proper to receipt her for th horso thus turned over by me to the government So the two horses that I aay were government property are beyond dispute, and will not be accounted for by me willingly. The mare in foal ran delivered to" Mrs. Fakes by me, if you think it necessary, and it ahall le my loss. At the time those horses were taken, from what I had heard of Fakej, as before stated, Capt.

Vanalta saw him in a field and ar rested him, ss citizens had told ns that he had stolen two mules and had them hidden in a swum p. He, after being arrested, de- ied having any horses or arms, but the citizens with us contended tbst bad the three on double barrel shot gaa and some nsvies. Cspt. Vsnstta placed a guard around him and approached the nnse, stating to Mrs. Fakes tbst her ban- band had been arrested by him and desired her to give np his weapons, which she did, producing the shot gun that was concealed the house snd the pistol that wss hid en In a hen-house under a nest One of the horse was in the stable end two in a dense thicket.

Tha saddles tsken that the petitioner reports to be boys' fuddles were men's saddles, as "I can prove, and when Capt. Vanatta asked your petitiorer why Ftkes stole the mules, and why he Vent arms concealed, her reply was that he wss rank when heatole themuiet, and noed'd is weapons when be was drnak. Iuroedi- tely after this conversation lee reed that Col. Withers wa in the neighborhood, snd myself and Cspt. Vanatta started in pursuit of him, and while absent from tbs com mand Fskes mad his escape, leaving h's horse and saddle, and that was a portion ol the property that your petitioner, wished yon to return as her individual property am charged in th petition and endo-sed by Jordan Bloke sa hiving committed something prodigious, after all oaths rsd been administered that constitutes loyalty.

nd I yow ask yon the question, why is it that, if Mr. Fskes and Mrs. Fakos hsd be come so devited to our cause after tokteg tha oath, did he steal mules'' and have apons concealed and after beirg arrested, I have before stated, by Capt. Vanstte, make his escape, leaving his horse, saddle, tc Did it not show guilt I think it certainly did, if there was no other proof. I ean produc any sort of pro to yon showing that I was justifiable in doicg ss I did, when it ii necessary, snd therefor I think that citizens who wish prosecute, ought to have grounds, indisputable, be for making br endorsing charges.

I have for three years, been engsged, constantly, defending my country, while others htve been following a more lucrative busincr, and know but little about the duties devoir ing upon a soldier. I have said nothinc; my own behalf in thia cane, compared to proof that I tan bring before you if nec essary, a'sd therefore wish jordog btokes tr any ether man to be aatitfied of my guilt before bringing amt. I have expected to hear charges brought agp mat men oi standing, ss the war was near close, but little expected that I would bo one bf that class, as I am no a-pi rant, end now desire, as my time will toon expire in th service of my country, to ra turn to my home enjoy the comforts of my family with a good moral character. Yonre very Eespectfully. i J.

ut the -question of negro sufifsg ifi the Southern States, as now presented, is not aettled by those principles. Other principles are involved which demand attention, one foremost among tiiem is that which involves the right of the resident or of to decide; ichzt the quaiikeniions cf vo t-rs ja tnvrof Slain. -Hitherto the National Gjrerameut hat never claimed s.ny audi power, Kew York decides by her own coctiiution what men may vote, acd what men may not vote, at her elections. Some of the Western permit aliens to vote before they are nr.turaliied. Some Northern Stales excljde negro voters al tog ether some require a proper qualificattOd, and oth-e-a admit them on the tame terms with whito.

If the National' Government 1 a --rts control ot ta wnow question, we must be prepared to see tiiat control exercised everywhere, If the Presirlent may aay who ahall vote in one Mate, he may aay whoshall voce in every o.ner. The same rule must be applied to Virginia acd to Georgia in this matter. as to Massachusetts and New York.

If they are States of the Union they must control this question of voting themselves; and if they are not States of the they have no business to vote at all President Johnson acta upon the principle that they are in the Lnion that they have never been out of it that their acts ot pretended secession were null and void and never changed in the slightest particular the lecsi re altor of those citatea to the lnion; and this principle, with ail its legiti mate coneequences, wiii be accepted by he country as tne baais ot reconstruc tion. But even if it were competent for Congress to decide thia question of ne gro suUVage, there are some considerations connected with it which Senator Sumner can scarcely ignora Conceding the full natural equvlity of the two races, their opportunities for culture have certainly been very unequal. A very large proportion of the reent slaves at the South were field-hands illiterate, ignorant of even the exit-ling government, snd just pa incompetent to form opinions on ponucat sunjecis as the cattle by their side. In South Carolina this class would very nearly form a majority of the whole voting population. Is it sensible or decent to lace the political control oi mat taie in their hands? Does Mr.

Sumner be- ieve that it would be for anybody a in terest to do so?
