against tbe Iron City Tool "Works. De fendant and plantlrT held a lot jointly on a lease, the plantitts being aasesset for taxes by the city for the whole lot, which ther paid unknowingly. Upon discovering the mistake. Long Co. asked the defend ants to repay them their share of the taxes, amounting to $14.

Judge Magee overruled the motion, holding that it did not show negligence on the part of the plaiutitl to pay the assessment without inquiry, as the assessment was supposed to be correct, and th it it was sometime a very difficult matter to get access to the tax books, and get such corrections ida. There was certainly a moral if not a legal obligation on the part of the desendants to repay the tuxes. Regarding the plain-tillis being volunteers, he would like a legal definition oi what constitute! a volunteer. The case therefore proceeded and is still on trial. Common EMettn No.

"Three of a Kind" ia a farcical comedy warranted to make the most pompous and sedate fwrson laugh. It i3 extremely funny.

I he cast the sanr.e as it has been for the past two years. Nellie Mc Henry is as pretty and pinarjt as ever. She is full mirth and jollity and keeps her audience in a constant state of good humor. llr Jhtitit I troH in a perfect piece of ictine, and her excellent interpretation of 'lie same scored her many out-hursts of applause. Josie I.angly, an Toutu, is as rh.T-riniiif as of old.

He received a justly deserved amount of applause. Uaball and Webster were good. Tbe Troubadours are sure to prove a winning card. Oi-KiiA Hoi sk The largest Monday night house of the season, filled Manager FUsler's theater last evening. The play produced was "A Prisoner for Idfe," a romantic drama in five acts by tbe famous French dramist, Anicet Hourgoia.

The action occurs in France, during the rijjn of Lout the 1 and is titled with rich dialogni-s, romantic episodes and wonderful mechanical ertects. The t-ast is strong. Among them are H. Studley and K. L.

BBADDOCK 9TBIKK PH ACTICALL ENDED. tiHca of ib Btl Worker and TMtfr4j-Tee for tcr Advise Tklr el lew Ea-ptoyes to Arrrpt the SHnaUoa A Rtlllrnnt Considered Certain. Tle striking steel workers held sereral meetings yesterday, and though a vote was carried in one of them to end the strike, the fnrnacemen refused finally to accept the offer of Carnegie Bros. Co.

The steel workers met in the afternoon and sent a committee to the furnace men, who were meeting in another hall, suggesting that they accept the terms of the company as proposed by Father Hickey on Sunday. The furnacemeu then went into a secret conference to consider the suggestion to the steel workers. While they were talking over the matter Father Bickay appeared and called for a show of hands, advising the men that it would be better for them to go to work, and that if the furnace men should deside to stay out, the steel workers would deeert them, as they believed thecompany had offered the furnace men very reasonable concessions. When Father Hickey rurluded his remarks a showing of hands followed, which resulted in a slight majority to resume work. The urnace men then objected to the result, saying it was carried by laborers present who do not work at the furnaces.

They adjourned without further action, but held another meeting in the evening. The upshot was that they adjourned to meet Superintendent Gayley, of the fur-Daces, to-day and tell him they would accept no other scale than that of 1SS1. As a large majority of the steel department employes will return to work whether the furnacemen strike or not, the difficulty at Braddock may be considered practically at an end. There is little donbt about the furnacemen resuming work too, although it is true a large percentage of them are dissatisfied. It wa reported on good authority at a late hour last night that the steel works and furnaces would both be in operation tomorrow with full crews.

As far as can be learned in Braddock the rumored resignation of Superintendent Jones is correct. THEY ARE DETERMINED. A meeting of the local nail plate feeders was held yesterday afternoon at No. Penn avenue for the purpose of forming an organization. Since the beginning of the strike some eight months ago the feeders have been without a district association.

Reports were received encouraging to the strikers. The feeders say they are just as determined to fight it out as the manufacturers. RAIWAY MAGNATES CONFER. The freight agents and other prominent railway officials of the Middle and Western States, met in one of the private offices of the Union Depot yesterday, and continued in session all day. The proceedings were held with closed doors and a sentry stationed in the hall way to prevent outsiders from getting within ear shot.

The officials present refused to give any information until the adjournment of the conference to-tiay. It was reported that among other business transacted a sub-poo! had been formed, which wonld be subject to the recently formed pool in Chicago. this rsiosr complete. The Federated Association of Glass Workers, including flint, green bottle and window glass, completed their amalgamation at a meeting held yesterday, and will hereafter bring a joint influence to bear in the settlement of strikes and wage disputes. It was the difficulty of carrying on a strike in one branch alone that originated the general union, as in the case of the green bottle blowers, who for the last seven months have been on a strike, while their fellow-workers at other lines in the same factories went to work at the regular time.

A BEfTAL FIUHT. One of the Participants Stsbbol Fonr Time. Frauenheim Vilsacks' brewery, on Thirty-third street, was the scene of a bru tal fight last evening which came near ending in a murder. Peter Berberig, the foreman of the establishment, and Peter Schnorr, one of the drivers, have not been on good terms for the past six months. On several occasions they have came to blows.

Last evening about 6 o'clock Schnorr came in with his team and was nahitching, when the foreman came out of the building and ordered the driver to remove some kegs that were lying near. The driver did not at once comply, which made Berberig angry. Hot words followed, and before anyone could interfere the men were engaged in a fierce rough and tumble fight. Schnorr was gertiog somewhat the best of the fight when his opponent drew a large knife and made tour lunges at him, all of which took effect, three in the left arm and one in the breast. By this time friends of the two men interfered and they were separated.

The wounded man was speedily removed to his home at Thirty-fourth and Liberty streets and a physician sent for. An examination showed that the cuts will not result fatally. ach time the knife struck a bone and glanced. The affair was kept very quiet and no arrests were made. lecse MM HONK A West Aewlon Drng-g-lat 4 barged With Forgery.

About 7:30 o'clock yesterday morning tbe boiler of tbe towboat Moloc exploded with a terrific report at tbe foot of Cherry street, Allegheny, just as she wax preparing to put out into tbe river. At tbe time of the explosion the crew of the Modoc consisted of Captain James R.

Krans. her owner; Pilot Joe Davy. Engineer Zach Evans, Fireman Matt Higgins and Kinsley McCormack, a deck-hand. The unfortunate boat bad an engagement to tow a barge to Saw Mill Run, and everything was in readiness for tbe start. Pilot Iavy was in tbe wheel-houso, Captain Evans and Fireman logins were forward tying the cables on the barge, Engineer Evans was at bis post, and tbe derk-hand was assisting at tbe ropes.

Captain Evans bad juBt given tbe word of command to swing tbe barge out into tbe channel; the pilot had given the wheel a turns: the b-t bad just commenced to move, when there was an explosion wbii fairly shook tbe houses along tbe river bank. The air was tilled with tbe riving debris of the wrerk, and the body of a man was seen whirling through tbe air. Tbe wreck was the com-pletest ever known on local waters. Tbe wheel-house was shattered to atoms, and pieces of tbe boiler were found three or four hundred yards frem tbe srerre of the disaster. Flying brick dropped in the yards of the houses along the bank, and one crashed through the door of a houte fully two hundred yards away.

So nh.rp and loud was tbe rejmrt of the explosion that many people in tbe vicinity thought I another disastrous natural ga-s accident bad occurred. A In1 est itiiinea.attdy after i tbe report tbe boat sank in the river, leaving nothing visible but the stern. Tbe startled pedestrians and people i working in tbe vicinity hastened to the! scene and found the fireman lying on the barge writhing in agony. His back had beeti broken. Captain Kvans was discovered witb bis bead seve-ely Kneineer Evans guttered some slight bruises, but the pilot as nowhere to be found.

He was killed beyond ijiiesttou. He was probably blown into the water near the bridges and drifted under them, or else out int5 the channel and ri down the stream. The most diMgent search has failed to find any trace of his body. The Modoc, which has been rather unfortunate, was owued by Captain Hvauv and was rained at f4.tKO. Two years ao, while the Seventh Street Bridge was in course of construction, the Mod or ran aain-tt an abutment on tne Pittsburgh side and sunk, but was raised without much trouble or loss. Pilot Joe Davy, who lout bis life, is a well known riverman, having been a ilt on tbe rivers for tbe past twenty yeax.

He was about forty -live yars ef age, and reside! at Monongabela City. Inspectors Neeld and Atkinson wre at the wreck shelly after the explosion occurred, but from the little that could be learned they were unable to give any cause for the explosion. The B'atal River it en, in common with seafaring people, have many superstitious notions or ideas in regard to the luck or ill-luck of their craft, prominent among which is the one that a boat having a name tvinmnc-ing with the letter is doomed to some dreadful disaster.
