Mr Kern said that in view of the precedent established by the; Sherrick decision there is no ground; on which the state can sue Henderson for the insurance fees he took under; the impression that he was entitled to them. Mr Kern said there is no authority that can be cited to disprove the conclusion he advanced, as the Sherrick decision is the only prece dent established. He insisted that the Sherrick decision knocks out every contention of the state that it can recover the money from Henderson Mr Miller said that the Sherrick de-1 cbion was no bar to the recovery of the money from Henderson, and that It is for the courts to d. whether he took the money as a part of salary as representative of the state or of the companies that paid the in surance taxes.
