An order was made yesterday In common pleas court No. 2, placing the case of the Bennett Water Company against the borough of Miiivale at the foot of tho present trial list. This means that the case will come op trial In about two weeks. The plaintiff company has sued to recover IiLVX0 damage? and the question involved la out that ha never been passed upon by tho supreme court of Pennsylvania. The Water Company had a contract with the borough to supply tho residents with water.

The borough then erected its own plant. The right of tho borough to do this was tested and the euprerne court decided In favor of the boroug ii. For several years the business of th-j water company has been on a gradual and the concern flnaliv went Into th hands of a receiver. It Is charged that the action of the borough in putting up its own plant was responsible for the destruction of the water company's business and this suit to recover damages was entered. The Cfse promises to be hotly contested and will be watched with interest, as upon Its result will depend the future courso of many Independent water companies.

In No. 3 a verdict for the piaintiit was rendered in the case of the Iron City Planing Mill and Lumbar Company against the consolidated 1 raction Company for a car colliding with a wagon belonging to the plaintiiTs. In the case of the Allegheny Valley Railroad Company against Thomas II. MeGowan, a verdict for $388 Cj was rendered for the plaintiff. The plaintiff, company sued to recover the price of a which the defendant refused to accept.
