If a couple is killed in an accident and it is impossible- to determine who died first, who will inherit their estate if they leave no will and if they have no children? A. There are state laws to provide for inheritance in cases of simultaneous death. Any property the couple owned jointly will be divided in half — one half to go to the wife's closest relatives and the other half to go to the husband's closest relatives. Any property owned individually will go to the relatives of the spouse who owned it. According to the Illinois Probate Act, when a childless couple dies simultaneously and there is no will, the-line of descent starts with each spouse's parents, brothers and sisters and ends with the most distant known relative. In the event one spouse has no known relatives, that spouse's portion of the real estate will go to the county in which it is located and his personal estate will go to thu county where he resided. - Illinois State Bar Association.
