Clark back in court as V.S. trial judge Associated Press WASHINGTON-At 70, former Supreme Court Justice Tom C. Clark is embarking on a new career— as a federal trial judge. "I'm looking forward to it ttfth great anticipation," Clark said. "I've never sat as a trial judge in my life." Smilingly, he added: "I rather think, with the assi- taftce of the lawyers, I'll be able to carry on all right." Beginning Monday, Clark will be at the U.S. District Court in San Francisco. He will confer with the lawyers in six to eight antitrust and breach of contract cases. It hasn't been decided over which cases he will preside, Chewing tobacco sales increase WASHINGTON (AP) - An Agriculture Department report says "the ring of the spittoon, familiar sound in the poolhall and saloon of yesteryear, may re - echo" because of a thriving chewing tobacco and snuff business. Production of chewing tobacco last year totaled 70 million pounds, a boost of 7 per cent from 1968, the report said. Sales increased by the same margin, officials said. Snuff output, after a 12-year decline, rose 2 per cent last year but sales continued to drop by about 2.5 per cent. His court assignment grew out of his longtime desire to sit as a trial judge and his friendship with George B. Harris, chief judge of the U.S. district court in San Francisco. Only once before in history has a retired or active Supreme Court Justice served as a trial judge. That was in the winter of 1940-41 when Justice Willis Van Devanter, while on the high court, presided at a trial in New York. Retired justices often help ease the load on the federal appeals courts. Clark left the Supreme Court after nearly 18 years in 1967 when his son, Ramsey, was named U.S. attorney general. Except for a hepatitis attack later that year, Clark has been extremely active. For two years he was the first director of the Federal Judicial Center, established by Congress to improve court administration and to foster legal research. He heads an American Bar Association Committee on procedures for disciplining errant lawyers. He also is the chairman of an advisory committee to the National Commission on Reform of Federal Criminal Laws. Clark is an experienced antitrust lawyer. As head of the Justice Department's antitrust division and then as President Harry S. Truman's attorney general he started 160 antitrust suits, four times the average begun by his predecessors.
