Tfc AMAIL The Arizona Republic m Wed., Jane 17,1970 Therapy death ruing: no basis for charges Insurers suspending coverage to oil firms against spills Northern Arizona Bureau FLAGSTAFF - Coconino County Atty. J. Michael Flournoy announced yesterday that a two-week investigation had revealed no basis for filing criminal charges in the death of Mrs. Gene (Margretta) Butler of Flagstaff. Mrs. Butler died of cardiovascular collapse due to stress and fatigue at Flagstaff Community Hospital on May 30. Her death came after a fatiguing, physical-contact psychiatric treatment known as "rage Deduction therapy." Flournoy said, "There have been no requests to this office for a criminal complaint either by any individual or any law enforcement agency . and both the sheriff's department investigator and the attorney for Mrs. Butler feel, as 1 do, that a criminal complaint should not be filed." However, the State Board of Medical Examiners has begun an investigation of Dr. Norman Duley and Dr. Guy Smyth, both Flagstaff psychiatrists, at the request of the Coconino County Medical Society. Flournoy pointed out that Mr. and Mrs. Butler had consented to her treatment by the type of therapy after it was explained to them and that the doctors had cau- tioned individuals connected with the therapy session against physical harm. "But there was some verbal abuse which the therapy calls for," Flournoy noted. "There is absolutely no evidence of anyone connected with the therapy striking or slapping Mrs. Butler, but physical contact was used," he said. "AH evidence indicates that no one intentionally tried to harm or hurt Mrs. Butler and that the doctors, in fact, were only trying to help Mrs. Butler," Flournoy said. He also pointed out that Mrs. Butler's husband had participated in the therapy . . . "That the doctors were doing what they thought was best for his wife, but Mr. Butler felt the doctors used poor judgment in using this type of therapy." Both Duley and Smyth, along with their Flagstaff Psychiatric Center Ltd., and 10 other defendants have been named in a $1.2 million damage suit filed on behalf of Flagstaff truck driver Jacob Lucero. Lucero claimed to have been injured from a severe beating while undergoing "rage- reduction therapy" for treatment of a back injury. Los Angeles times Service The insurance company that paid Union Oil Co. $5 million to cover the cost of cleaning the beaches in Santa Barbara, Calif., no longer will provide such coverage to oil firms. Aetna Life and Casualty Co. of Hartford, Conn., recently sent a memo to all field offices explaining that it no longer will insure oil companies against spills. The move is part of a general change in insurance industry policies. The new attitude extends to London, where many oil firms had turned to get catastrophe insurance — coverage that starts only after expenses covered by standard policies is, exhausted. Even the London insurers are saying "no" to the oil companies. The wreck of the tanker Torrey Canyon off Great Britain wrote an end to insurance coverage of that sort of disaster. Payments for damages totaled more than $7 million. With insurers refusing to cover tanker operators, the oper- ators were forced to set up their own insurance mechanism -• a pool, into which all companies contribute. Some oilmen think their industry will be forced to follow that pattern. Otherwise, the impact of any new spillage on individual companies could be tremendous. Union Oil said that as a result of the insurance change, it was making provisions to increase its self - insurance. This means it will set aside more of its revenues to cover potential liability losses. A widespread insurance in- dustry retreat from oil pollution coverage became effective earlier this month. The Insurance Rating Board, a national organization whose members include some of the country's most powerful firms, filed a proposed policy exclusion with insurance authorities in all states. Liability insurance policies, the statement said, will not cover damages caused by "the discharge, dispersal, release or escape of oil or other petroleum substance or derivative" into any body of water ranging from an ocean to a pond. The ban is complete, "even though the discharge is sudden and accidental," the board said. Member firms almost invariably follow the 1KB recommendations.
