Thursday, May 22, 1986 Child abuse law clarified Court ruling protects sexual privacy of minors under 14 SAN FRANCISCO (AP) Californias child abuse reporting law does not require reporting of voluntary, non-abusive sexual conduct between minors under the age of 14, a state appellate court ruled. The opinion by the 1st District Court of Appeal said the broad reporting requirement violated the intent of the law to protect minors, and violated their constitutional rights to sexual privacy. Instead of a blanket reporting requirement of all (sexual) activity of those under a certain age, the professional can make a Judgment whether a minor Is having volun tary relations or is being sexually abused, the court said. The 1981 child abuse reporting law requires health practitioners, child care workers and employees of child protective agencies to immediately report to the state any physical or sexual abuse, willful cruelty, corporal punishment and neglect they observe. But Attorney General John Van de Kamps interpretation of the law In June 1984 changed It to Include all sexual activities of minors under the age of 14.

Failure to report such findings is a misdemeanor with possible pen alties of a $1,000 fine and up to six months In jail. Planned Parenthood and two medical doctors went to court last year, A Los Angeles district attorney also questioned the opinion, asking whether it was necessary to report when a child receives medical care for a sexually transmitted disease, birth control, pregnancy or abortion. Although opinions by the attorney general have no force of law, they usually are followed by state and local agencies until a court rules on the Issue.
