Suit filed in test of property law A Superior Court suitchal- lenging the Arizona law governing the establishment of improvement districts filed Tuesday. The suit was filed as a class action for 80 families in the Estrella Dells ment District, which was formed in 1971 to improve water services to property owners in an area near Buckeye. Steven Friedman, Phoenix attorney who filed the suit, explained the challenge this way: Under state law- owners of 51 per cent of property in a given area can start an improvement district to provide such services as new streets, overhead streetlights, or water services. Consequently, if one person owns 51 per cent of the property, and 49 others own 1 per cent each, the one with 51 per cent has control over assessments placed on properties of others to pay for the improvement district. In the tfstrella Dells District, said Friedman, petitions presented to the county Board of Supervisors asking the district be formed contained signatures of persons owning 79.3 per cent of property in the area, but only 9.G per cent of the total number of owners.

Friedman argued due process of law was denied the majority of property owners. Property owners were assessed a total of $632.000 to cover the installation of water lines and construction of a well, the lawyer said. Several land owners in the district recently received their assessments, some for thousands of dollars, Friedman said. Among defendants named in the suit are the county board of supervisors and the board of directors of the water improvement district. Fred Harrington, attending a FOP state conference at the Holiday Inn, also claimed "compulsory and binding arbitration is the best and most satisfactory way of settling wage disputes involving law enforcement officers. Harrington said his home state of Pennsylvania as well as Michigan and Rhode Island have binding arbitration laws used for settling law enforcement officer salary requests. "These are exactly the same type laws used in settling railroad worker wage disputes so transportation is not interfered with," he said. Harrington based his criticism of the Phoenix City Council on a statement by City Manager John Wentz last week that the city has the money to give police officers a 15 per cent hike.

The council approved an 11.7 per cent wage increase for 386 veteran officers and granted some 600 officers an estimated 4.6 per cent cost-of- living increase. The police officers had been asking for the 15 per cent hike. Harrington refused to endorse strikes or work slowdowns by police officers and said this manner of demanding salary increases is not endorsed by the FOP. "The struggle for increased wages must be accomplished in a proper manner," he said. Harrington estimated he has served on 200 arbitration boards in recent years.
