Killebrew, a Rosewood Heights real estate and insurance man. The suit, filed on behalf of Killebrew by East Alton Attorney Edgar R. Kelly, seeks a reversal of a decision by the county zoning board of appeals on June 13 denying a petition to re-zone a tract of land on Bel I wood avenue (Airport Road) to construct an apartment building. The petition filed in the circuit clerk's office alleges that the board of appeals action rejecting Killebrew's petition to rezonc the property from one family residence to multiple family residence violates the state and federal constitution. The complaint declares that the decision of the board of appeals was not supported by "any findings of fact or evidence." The plaintiff petitions the court that the "action of the defendants and portion of the Madison County zoning ordinance under which i purports to operate be declarec unconstitutional and void in violation of federal and state constilu tions." Killebrew constructed one 10- family apartment unit and expected tu erect a similar one across the street on the site he sought ; to re-zone until the petition was -denied by the board of ap- p'eals, lie'told the Telegraph today, He named the appeal board and county zoning administrator Charles Erspamer as co-defendants.
