PAGE FORTY ALTON EVENING TELEGRAPH THURSDAY, JUNE 20,1963 News of Stock* Only Small Fluctuations NEW YORK (AP)-TTie slock market continued to grope in moderate trading early this afternoon. Changes of most key stocks were small. Stock market analysts looked upon the "consolidation" of the past few weeks as a process which may be necessary to form a base for a further advance. The trend among steels, motors and tobaccos was lower. Sugars and rails advanced. Oils were narrowly mixed. The Associated Press average of 60 stocks a noon was unchanged at 273.1 with industrials off .3, rails up .5, and utilities up .1. Chrysler continued with its sinking spell, dropping a couple of points. General Motors and Ford lost fractions. American Motors was steady and Studebaker eased. The top steelmakers took minor losses. Among the more actively traded Issues, Olin Mathieson, responding to favorable advisories in the street, gained a fraction. Avco, with record sales and earnings, also gained a fraction along with Chock Full O' Nuts, Korvette and Jonathan Logan. Ampex was up about a point. Pacific Pet- roleums was about a point lower. Western Union and Belco Petroleum were fracational losers. IBM was off about 5 points and Xerox about 6. Twentieth Century-Fox dropped more than a point. Merck was off about a point. Schering was about a point ahead. The Dow Jones industrial average at noon was off 1.55 at 718.29 while the Dow Jones composite of 65 industrials, rails and utilities was up at 257.23. Prices were mixed in slow trading on the American Stock Exchange. Corporate bonds were mixed with rails lower. (AP)-Th University of Alabama Board o Trustees has taken what could be the first step toward removin three Negro students from th university system. The board filed notice in U.S District Court Wednesday that i would ask the 5th U.S. Circui Court of Appeals to overturn lower court refusal to delay in jtegration of the formerly all white institution. Only notice of appeal, not th< text of the appeal, was filed. In effect, the appeal would asl the court's permission to remove the Negroes until racial tension have eased in the state. The trustees said they were ap pealing the May 21 judgment b> U.S. Dist. Judge H. H. Grooms which overruled a board motion to modify and suspend an earlier injunction requiring integration o the school. In that decision, Grooms refused to delay the admission o Vivian J. Malone and James A Hood to the Tuscaloosa main campus and Dave Mack McGlath ery to the university's Huntsville Extension Center. On May 17, the judge held that a 1955 injunction abolishing ra cial discrimination at the university still was in force. That court order opened the schools doors to its first Negro student seven years ago. The student, Autherine Lucy, was greeted by rioting mobs. She later was expelled for unproven charges that university officials conspired with the mobs. The notice of appeal was signed by 11 of the 12 board members, Gov. George Wallace, an ex-offico member, did not sign the petition, but no immediate reason was given. University attorney Andrew Thomas would not say whether the notice was a step to have the Negro students removed. Thomas also would not comment on what the appeal would involve or when it actually would be filed with the Circuit Court in New Orleans. Latham, Yoek Win Delay in Executions DENVER (AP)—The 10th U.S. Circuit Court of Appeals postponed for 30 days Wednesday execution of two youths who were to have been executed early today in Kansas State Penitentiary. The condemned pair, George York, 19, and James Latham, 20, were convicted of slaying Otto Ziegler, a 63-year-old railroad worker, at Oakley, Kan., during a 17-day crime spree two years ago. Seven persons were killed during the period, including one in Illinois. The federal court agreed to hear arguments July 8 on a'cer- tificate of probable cause for an appeal from the Kansas courl verdict. York and Latham were captured near Grantsville, Utah, a few hours after Rachel Moyer, 18, a waitress, was killed near Craig Colo. Attorney Ray Cook of Kansas City, Kan., based his plea before the Circuit Court of Appeals on the contention that the two youths were denied court-appointed counsel at the time of their preliminary heariiig in Sharon Springe- Kan., after being returned from Utah. Cook said that York and Latham, at that time, had waived rights to obtain access to information which was to be used against them, and also to deter mine validity of their purported confessions made in Utah. Conse quently, later in the case, Cook said, they lost a choice of pleadings before their trial. TRY DIADAX TABLETS — (form erly Dex-A-Diet). New name, same formula, only 98c.
