TUESDAY, JUNE 18, 1963 ALTON EVENING TELEGRAPH PAGE THIRTEEN Lord's Prayer Ruling Broadens Earlier Stand By JAMES MARLOW Associated Press News Analyst WASHINGTON (AP) - In this country where people have different religious beliefs and some have none, no state can impose any religious belief or exercise in the public schools. That's the short of the Supreme Court's historic ruling Monday outlawing the reading of the Bible and the Lord's Prayer In public schools as a religious exercise. Tills goes even if students, whose parents object to the religious exercise, are excused from taking part. But the court, whose majority opinion was written by Justice Tom Clark, did not say the Bible or religious history could not be studied in public schools as part of a general education program. Under the Constitution, Clark said, a state must maintain strict neutrality on religious matters, "neither aiding nor opposing religion." Another justice, William 0. Douglas, agreeing with Clark, put it this way: "Through the mechanism of the slate (unless it is banned) all of the people are being required to finance a religious exercise that only some of the people wan': and that violates the sensibilities of others." Almost Keaolird The court had been working up to this decision and almost reached it, but not quite, last year in the case o f New York schools where the Board of He- gents had recommended t.he recital of a 22-word prayer at the start of each school day. The prayer, which hud been drafted by the board itself, said: "Almighty God, we acknowledge our dependency upon Thee, and We beg Thy blessing upon us, our parents, our teachers and our country." But some people don't believe in God. Others, if they do, prefer to pray some other way. The court banned that prayer as unconstitutional. The opinion then was written by Justice Hugo Black. He said for the school board to require recital of its prayer violated the first section of the First Showers Widespread In South By THE ASSOCIATED PKESS Scattered showers and thundershowers dropped up to an inch of rain over parts of the South early Tuesday. Elsewhere, skies mostly were clear and temperatures mild. Rain fell in a broad belt from the Texas coast eastward across the heart of the South. The Corpus Christi Naval Air Station had a two-inch rainfall during a brief thunderstorm. Some light rain was reported in widely scattered sections in the Rocky Mountains, the northern Plains and the north Atlantic states. The majority of the Western states experienced early morning temperatures in the pleasant 60s. Farther east the mercury dipped into the 50s in some areas except in the Deep South where the temperature remained in the 70s through the night and early morning. Marquette and Sault Ste. Marie, Mich., each reported a chilly 46 degrees this morning. GOP Leaders Favor Move to Favorite Sons WASHINGTON (AP)—A move to make Gov. William W. Scran ton of Pennsylvania a favorite son candidate for the 1964 Republican presidential nomination won applause today from Sen. Barry Goldwater. Sen. Hugh Scott, R-Pa., told a news conference Monday there is growing sentiment among local Republican officials that Scranton should have Pennsylvania's 64 convention votes pledged to him. At Horrisburg, Scranton said he would be a favorite son candidate as a means of holding the state's delegation together at next year's convention. But, he added, "I want to make it perfectly cleat that I am not a presidential candidate." Goldwater, who is being bwrnccl by some Republicans for the 1964 nomination, said in an interview he thinks that would be "a vwy wise move for Pennsylvania to make when there are no announced candidates." "I think that any state that wants to should have its own favorite son candidate," the Arizona senator said. "Then the contest for the nomination will go down to the wire, This would make foi an interesting, open convention that could do the party some good." Amendment which declares, "Congress shall make no law respect- tig an establishment of religion or prohibiting the free exercise thereof." In that case Black put the emphasis on the first part of the amendment — "establishment of religion" — and not the second jart. But that amendment pro- libited Congress from passing a aw "respecting establishment of religion." How then could Black say the states can't pass such a law? Because the 14th Amendment nnkes it apply to states, too, by saying, "No state shall make or enforce any law which shall abridge the privileges or Immuni- :ies of citizens of the United Slates." The religious privileges are guaranteed by the First Amendment. No Power Black reasoned: the government has no power to "prescribe by taw any particular form of prayer which is to be used as an official wayer in carrying on any government-sponsored activity." Ho said: "Neither the fact that he prayer may be denominationally neutral, nor the fact that its observance on the part of tho students is voluntary, can serve to free it from the limitations of the jstablishmont clause." But he was talking about a jrayer written by a school board and imposed on the students. He didn't answer this question: What about schools that require Bible-reading or recital of the Lord's Prayer every day but excuse children whose parents don't want them to be a party to it- even though they only have to listen and don't have to say any tiling? Monday's decision was on two cases involving exactly that problem: one from Pennsylvania, one from Baltimore. In each case the court called the practice unconstitutional under that same "establishment clause" of the First Amendment. If a state is going to compel student participation in some religious project—like studying the Bible as history—the court said the primary effect must be one that neither helps nor hinders religion. Clark said the purpose of the First Amendment is to "secure religious liberty in the indidivual by prohibiting any invasion thereof by civil authority." He added: "It is no defense to urge that the religious practices here may be relatively minor encroachments on the First Amend- ment.The breach of neutrality that is today a trickling stream may all too soon become a raging torrent. "In the relationship between man and religion, the state is firmly committed to a position of neutrality."
