Bender Sues Macoupin Sheriff Charges He Was Held Unlawfully CARLINVILLE - A $10,000 damage suit was filed against Macoupin County Sheriff Russell Sexton Tuesday by William Bender, who alleges that he was unlawfully held and imprisoned in violation of his constitutional rights. In the complaint filed in Macoupin Co. Circuit Court today, Bender alleges that Sheriff Sexton failed to release him from jail on May 16, 1963, after "good" bond had been posted. The complaint further alleges that Bender was held until 4 p.m. on May 17, when he was released. On May 16 Bender and his consul, Attorney Dennis McGrady, of Gillespie, appeared in circuit court and posted bond through a professional bondsman. Bender demanded release at the time, but was held in jail until the following day, the complaint states. Bender is now free on $7,500 bond. There are three habeus corpus suits pending. One is in the Federal District Court in Springfield, "which Judge Poos has under advisement," said McGrady. "The second is in the Circuit Court of Macoupin County and the third is in the Illinois Supreme Court. The latter two courts have not informed us of any action on the writs," he added. This is the latest in a nearly nine-year series of legal actions concerning Bender.
