Qafk today denied a motion fbt temporary Injunction, tiled by nine phy- siclang-sufgeong on th* Wood River Township ttotpital medical ttaff to restrain use of hospital records involving their patients at farther hearings be* fore the hospital's board of directors on dropping of Dr. Bernard Apanel from associated medical staff membership. The order was signed at 11:30 a.m. today. The hearings had been scheduled for June 22 and 23. Under the order signed by Judge Clark, since Dr. Apanel had not been served with a summons in the cause, the hearing was continued until 1:30, June 23. Named as defendants in the suit for temporary injunction were the five members of the hospital's board of directors, the hospital itself and Dr. Apanel. The suit, heard in Judge Gark's court Monday afternoon, was taken under advisement until this morning. Attorneys for the plaintiffs. Hamilton C. Jones and Robert F. Quinn, contended that items taken from the records included the patient's age. sex, physical condition, date of entry into the hospital, diagnosis treatment and other medical history and that the plaintiffs are "concerned" with the revalation of such information to unauthorized persons. They maintained that to reveal such information was a violation not only of a confidence between doctor and patient, but a violation of the doctor-patient statute added to Illinois statutes last year. Jones said that the doctor* want to cooperate in every way possible but they are concerned about use of the records. Francis Manning of Wood River, who with Charles O'Brien of Chicago, represented the hospital board, maintained that the staff doctors used Dr. Apanel's records when they recommended that he not be re-appointed. He used as a comparison the grand jury where he said court reporters and secretarys come Into the hearing room but the secrecy of the grand jury is not violated. Manning said that the hospital licensing board and accreditation committee also examine such records and that the hospital board was only trying to give Dr. Apanel a fair hearing and a chance to present his side of the case. The board, he said, has no authority to force a doctor to testify and that the statute cited has "nothing more to do with the hospitaJ than the chattel act or drainage act." Prosecution Witnesses Testify in Foster Trial EDWARDSVILLE—Three witnesses testified for the prosecution this morning in Circuit Court in the trial of Gordon Foster, 39-year-old relative of rackets czar Frank (Buster) Wortman, on a misdemeanor charge of carrying a concealed weapon. A jury of seven men and five women for trial of the case was completed late Monday in the court of Circuit Judge Joseph J. Barr. The three witnesses called to the stand this morning foe the prosecution by Assistant State's Attorney Joseph J. Bartylak were Fred Grafe, operator of a drive-in restaurant on St. Louis road near Collinsville, and two Collinsville police patrolmen, Robert Self and Walter Fronchak. Foster, who appeared in the courtroom with hig right foot in a east when the case was called for trial Monday morning, wag arrested by the two police officers near the drive-in restaurant early on the morning of last Feb. 8 in Collinsville. He was represented in the trial by Bernard Melman, who identified himself as an associate of St. Louis Attorney Morris Shenker. A motion to suppress evidence seized by the arresting officers, including the .32 caliber pistol allegedly found in the car in which the officers said they apprehended Foster near the drive-in, was denied by Circuit Judge Harold R. Clark before trial of the case began before Judge Barr here Monday. Grafe testified he was asleep in living quarters at the drive-in when aroused about 3:30 a.m. last Feb. 8 and called the Collinsville Police Department. One of the two police officers who responded to .the call said he found Foster in an automobile parked near the drive-in, and both patrolmen testified they found a .38 and a .32 caliber pistol and a brown canvas satchel on the front seat of the car. Maximum penalty for conviction on the charge of carrying a concealed weapon carries a penalty of a fine up to $300 and a possible jail sentence up to one year.
