Hearst (Continued From Page 1) defense to present whatever testimony they want at the hearing, including witnesses.

So it was possible that Miss Hearst would testify, about the making of the tape. U.S. Atty. James L. Browning said the jury should get to hear the tape, which he branded "an admission of guilt." Chief defense counsel F.

Lee Bailey has contended the script for the tape was written by SLA member Angela Atwood and Miss Hearst was forced to record it. The judge also must rule on whether any of Miss Hearst's activity with the SLA after the robbery is admissible as evidence, including a May 16, 1974, incident in which she allegedly sprayed a Los Angeles area sporting goods store with machine gun fire. The defense wants mention of any such activity suppressed as irrelevant to the bank robbery case. A teen-ager, Thomas, Dean Matthews, was held hostage for 12 hours after the Los. Angeles incident, and Miss Hearst allegedly bragged to him about her part in the bank heist.

But Gilloon says that wouldn't change what is essentially an unfair system of distributing the need portion of the road use tax fund to counties.

Forty per cent of the county share is distributed on the of area and 60 per cent on the basis of need. The DOT, however, is using a 1959 needs study as the basis for distributing the need portion. Gilloon wants it to use instead a.1974 study, then revise the needs data every two years. Under Gilloon's plan, 1959 study would remain the distribution basis for 1977. He proposes that in 1978, 66 per cent of the need money be passed out on the basis of 1959 needs and 34 per cent on the cent 1974 on study; 1959 and needs in 1979, and 66 34 per per cent on the biennial update.

In 1980 and thereafter, the latest biennial study would be the basis of the fund distribution. That wouldn't keep some. counties from getting a smaller portion of the needs money than they now get, Gilloon concedes. But he said it would avoid a sudden sharp drop in their road use tax fund allocation and his plan would more accurately reflect the comparative road needs of the counties. The DOT estimates these amounts will be available to the counties, suming there is no Increase in present road funding: roads 1977, 1978,.
