from investigating the program at the private liberal arts college or at other colleges and universities in the Eastern Dis- -trict of Virginia unless the program in question receives direct federal financial assistance The Jurisdiction issue arose after the Education' Department notified the university in February 1981 that it planned a weeklong campus investigation of the university's athletic program because of a sex discrimination complaint received by the department's Office of Civil Rights The department also submitted a long request for information on all aspects of its intercollegiate athletic program including budgets policies practice schedules lists of teams training facilities and locker rooms according to Warrior's order The university questioned the Education Department's jurisdiction to conduct such an investigation saying that the program received no federal money and calling the request for information unduly burdensome and in excess of the department's authority It filed suit seeking to block the investigation The Office of Civil Rights responded that any receipt of federal funds by the university whether direct or indirect means the university must comply with the anti-discrimination provisions in Title IX Title IX says that there can be no discrimination because of sex in any educational program or activity receiving federal fends The Education Department suggested that if the university received even $1 from the federal gov ernment for any program or activity the university would be subject in all its programs to department authority Warriner said But
