decision can be rectoed in the tert case now pending determine the contiUtutionalitJr of act creaiinr State Real Estate Commissioner and llcenginn brokers, according to R. Riley of Colton, San Bernardino county, who holds appointment of Real Estate Commissioner bt who declines to exercise the duties of the office until the court renders its decision. Riley has instituted proceedings to test the act and there has been Intervention by Oaklandsrs, from whence came the fight that resulted In overturning the act that was passed two years ago. The original suit was brought by Riley In the shape of mandamus proceedings to compel the state comptroller and other state officers to recognize the act. They.

In turn, have opposeo. the act upon the ground that it Is unconstitutional and the case was set in the Appellate Court at Sacramento. Riley and the state officials had hopes that a decision would have been reached by this time, but in this they were disappointed. A hearing was Bet for September 2. but the arrival of the fleet caueed Dr.

J. Calvin Settles, who Is a student of psychology and a salesmau of real estate, says that the facts and the planets and his own judgment all agree that Oakland has a great future and that now Is the psychological time to Invest. Also he says that too big a deposit down ofttimea kills a good tale. These various statements, starting at corner lots In Oakland and reaching to the limits of our planetary system, ere made at the bi-weekly luncheon of the Oakland Real Estate Board at the Hotel Oakland yon Wednesday. This was by far the largest luncheon1 that has been held and shows a growing Interest In these events which have become the great round-table gathering of the real estate men of the Kastbay district.

It was presided over by Emll Frltsch, and after a number of business matters had been called up by Secretary Porter Giles, Dr. Settles began his talk. He told how he had begun life as a trader In mules. Left fatherless early in life he tried a little of the David Harum stuff and found that he was a good enough horse and mule trader to arcumulate quite a little money. This was added to in the express business and then he.

branched out for himself and tfiod Los Angeles. "I had quite a little bank account and I investigated a place that advertised 'business chances. 1 soon found out that I could trade mules but I couldn't beat the Log Angeles business chance. 1 had all the chances and they had all the business. They slmpley cleaned me.

I went to a prominent real estate man and told him my situation, and he gave me a job selling lots in a little tract office, one of those two by four places with a desk and onf chair. I made good there and I learned several things, "One was that the square deal i tery company's plant, 150x131 feet has been purchased by the (I. O. Harrison company, who will Improve the property and install a portion of their business therein. "These- two wiles are significant of a livelier market for business purpose," Itsed.

"Ilank-'clear-ings indicate that the volume of business being done In Oakland today is fully Ml per rent greater that of a ear ago. Practically every store room is occupied. New businesses are coming in dally and finding no apace available for them to cupy. This shortage has' naturally resulted In an Increase in rents, until today rentals on business properties are higher than they have been In the last five years. Huili a condition necessarily warrants the erection of new store rooms.

Increased cost of materials has dissuaded many from building. But we find that tenants are now willing to pay rentals that yield igood interest on proper lund values 'and present costs, Three clients who desire locations have offered to pay as high as 10 per cent net for brick buildings within the bust- has grown up around anil far beyond the property -with prices remaining for the present practically at a standstill, making it sn investment with the guesswork eliminated. is seldom if ever." said Walter Leiinert yesterday, "that a nroperty. of this particular nature finds its way to the market. But-whatever the attitude of the planets, this was merely confirmatory, for his Judgment' was that Oakland was ail right and so was its real estate- a postponement or ten days. The court gave them ten days in which to file a brief and another ten days in which the other attorneys could reply to such points as they might bring out. This will consume all of September and bring the hearing In open court early in October. It will probably tak thirty days to reach a decision so that It will be November, at the earliest, before a decision can bo had from the Appellate Court. If that decision is very positive. Commissioner Riley may decide to rest upon it and put the act into effect by orgauizina his office, but there is also a chance that hn mav wait for a decision from the Supreme court.

Riley derlinfs to try and put the act into effect and collect a lot of license money until the courts finally pass upon the constitutionality of the law. 'You wish to know why I. purchased in the Moraga Road District?" said Howard Schafcr, Secretary of the Oakland Rotary Club, when asked why he purchased a two-acre home-site in the Moraga Road District. "Well, young man. I bought there because I found the property combined three features I was looking for: First: Accessibility to Oakland's business district; to be exact it is only twelve minutes by automobile by my watch. "Second I found that the property had a 1 mild, balmy climate.

The other evening I was there until eight o'clock with Alfred Peterson, the Contractor, who will build my home, and it was wariA and pleasant. The clima'tic- change, as we returned, was very noticeablef Third: The property has a natural beauty. Nature has already decorated it with Oaks, Pines, Redwoods and Eucalyptus that would take a life-time to grow. To put it briefthe stage is already set for the home."
