Hob-tea's saw pteeajkymriten compared with tha Henrico Jury Decides in Favor of Powhatan Furnace Owners MAY GO TO SUPREME COURT Vaughan Title Set Aside Defend ant Not Being Able to Prove Claim Tedious and wearisome the suit for possession of the Powhatan Furnace property brought by the Reading Iron Company of Pennsylvania against Wellington Vaughan which occupied the session of the Heartoo Circuit Court Wednesday afternoon and which was taken up again yesterday morning at 10 o'clock was concluded at 7:45 last night wben the Jury brought in a verdict for the plaintiff The erfae was long drawn out involving many technical complications and a gopd many contentions based on facta which were excavated from the depths of recollections of times many many years gone by The evidence was threshed over many 'times and after each threshing the Jury was as much entangled as ever There were two deeds to the disputed property Introduced In the trial one made to the Reading Iron Company by the Pennsylvania Railway and Iron Company in which the consideration named was- fi the other deed was the one which was made last May to Capltola Shaw by her sister the wife of Wellington Vaughan and In this deed the consideration was $5 The latter however was recognised as a mere subterfuge and figured in the trial only as an object of amusement The defense all the way along had uphill work It was not attempting to prove a title to the property but directed all of its energies and legal light to show that by virtue of the facts that these people had been in possession of the property for such long period and although they had been paying rents for a number of years prior to the beginning of the present dispute in the lease which was signed in the fall of ISOS' there was no limitation placed upon the duration of the contract the action of legai detainer was not valid They also contended that while there was certainly no title to the land there was a clear right of possession resulting from the fact that for all those years the property had been in the hands of these people and at no time lad they recognised any landlord Complicated with this suit there 1 another the latter being instituted against Mra Welllngon Vaughan separately In the present case the contested right is that of Wellington Vaughan himself coming through his wife from her father who it was proved began living on the land in 1851 and continued to reside there until his death in 1890 The suit against Mra Vaughan involves the right which descended upon her from her father at his -death This suit however will not be heard until the next term of court After learning that the decision of the jury was agsinst them the attorneys for the defendant moved that the court set the verdict aside on the ground that it was contrary to the law and evidence anb by misdirection of the court The motion wss overruled the defendants excepted and leave was given to prepsre and tender bills of exception It was intimated that the case will be taken to the Supreme Court for final decision heinous of crimes and the statute prescribes a penalty even for an attempt at poisoning of from three to eighteen years In the penitentiary the maximum penalty helng equal to that for homicide It is a penal offense even maliciously to poison animals Final Sleep for Mnggtns Little Muggins was laid to rest In the pauper section of Oakwood Cemetery at 8:80 o'clock yesterday afternoon There was no ceremony no one to mourn his sudden loss Dr John Moncure conducted the services and then the plain little coffli was carried out to the cemetery and placed in an unmarked grave Vaughan had endured more than the common lot and his last sleep will he more restful than any he ever had on earth The City Home again went about Its business The Inmates whia pered It over among themselves but only as ar Incident somewhat out of the ordinary routine of their lives A few those who had known the child were a little Promoters Ready Now to Proceed With Purchase of West-hampton Site Plans for the establishment of a large country club to be built near Richmond culminated yeaterday In what seems to be an assurance of the ultimate success of the promoters when the Corporation Commission granted a charter to the Country Club of Vlr glnla Incorporated with the following Incorporators: John A Coke Jr president CL Kirk vlca-presldent John Or gain secretary and treasurer John Walker William Habllston and Charles Borden all of Richmond The maximum stock Is $80000 and minimum $10000 For a long time It has been the desire of these and other prominent Richmond men to Consolidate the three clubs new existing near the city Into ono large Institution which from the numerical strength of its membership oould be run on a much more extensive plan Repeated efforts were made toward thla end but there was always some hitch many members of th pres ent clubs not desiring the conaollda tlon and the merger was never made ambassador upon hearing the complaint laid the matter before the SUte Department and Acting Secretary Bacon forwarded the correspond-end e1 to Governor Swanson yesUrday with the request that he InvestigaU the subject and furnish the department all possible information raUtlvo thereto The Governor at once secured copies of the Byrd liquor law and the recent city ordinances adopted hero monwealth Says Treaty Is VloUted The ambassador contends that recent acts of the Legislature and the Richmond City Council are in violation of a treaty entered into between the United StaUs and IUly In 1S71W which provides that Italians resident In this country shall be on the same footing with American-born dtlsens concerning the right to conduct any line of business He gives the impression through his letters to the State Department that he considers the aforesaid laws and ordinances as his peo ple and appeals to the Federal government through the Department of 8tate at Washington for relief Copies of the Byrd law and the city ordinances bearing on the subject of the sale of liquor having been forwarded to the ambassador through the State Department further action on the subject Is awaited with some interest This much may be said however In explanation: The liquor laws of the State and city are applicable to all persons alike whether American-born oitlsens or of whatever nationality They are like the suffrage provisions of the new Constitution They apply to all who undertake to avail themselves of their provisions without reference to race or color The American-born citisen must comply with certain provisions and restrictions In order to secure a license to sell liquor or to be allowed to dispense It as a bartender and these are the only requirements that are made of others In the same line Though every courtesy hss been shown by the Governor and city offl-clals In the matter of furnishing information to the State DeMrtment on the subject it Is believed meeting yesterday and discussed the situation If they arrived at any definite conclusion it was not made public It Is hardly probable however that they know any more than has already been printed in then probably will 1 come the arrest Mrs Gaylord was reported to be very feverish yesterday but her condition is not regarded as serious She appears to be a woman of high temper hut able to preserve most FEDER1L COURT TO HIKE I Clerk Authorized to Purchase New Books for Appeal Court Judges For the trial of important cases heretofore heard in and appealed from the lower courts of the circuit an order was entered In the United State Circuit Court of Appeals at Asheville yesterday' designating the following district judges to hold the November term of the United States Circuit Court of Appeals in this city beginning on November 3d: Judges Tho Morris of Baltimore William Brawley of Charleston and Thos Purnell of Raleigh The oourt also entered an order making requisition for 81000 worth nf late books under a recent act of Congress appropriating that sum for the Library of the Circuit Court of Appeals at Richmond Mr Claude Dean the librarian will now send out a list of the book to he purchased under thla appropriation to the various law book publishing eo eompaniee for bids Although it Is not known how many esses are on the docket for the November term It la expected that It wilt he an extended one and that man Important decisions will be hande down Judge Jeter C- Pritchard of Asheville will preside FELL DEAD IN OFFICE George Hudaoo Victim of Heat aui Heart Disease Mr George Hudson of Fulton Hill dropped dead yesterday in the offices of Kelson A Ladd where he was employed Hit death was due to the best and to heart disease with which he had been suffering for some time He leaves one son and three daughters He was on of the oldest and moist respected citlsens of his community having been one of the first to settle there Arrangements for the funeral bad not been made last night a sltlon and that the others are volun-teers from among the inmates hardly fit for such duties as may be imposed on them This state of affairs will also be investigated A Nothing new of
