Urbana School Board Sued On Maternity Lea ve CITIZEN SMITH By Dave Gerard Springfield 0) DAILY NEWS Saturday December S 1973-5 As Urbana teacher haa filed 550000 federal court suit against the Utbana City Board of Education seeking back pay and damage! for a period when she left work for maternity reasons The suit was filed in file UJ5 District Churt in Dayton where another suit brought by an Urbana High School student is still pending The most recent notion was filed on behalf of Marilyn E Khmison a fifth grade teacher at East Elementary school who maintains that she was unlaw-fully denied sick leave payments during a period for which she was granted an authorized leave of absence for maternity reasons last spring Named as party defendants to the suit which seeks actual damages in the amount of 510000 and punitive damages ' in the amount of 540000 are members of the Urbana Board of Education collectively and singly Roe Hildreth Urbana school superintendent Burr A Simpson who was the assistant school superintendent at the time Leonard Walker East Elementary School principal and Gary Bauer cleric of the Board of Education - Mrs Khmison represented by Nancy Drake Hammond a Xenia attorney alleges that shs had over 100 days of accumulated sick leave at tin time she left her job for maternity reasons last February She further states that she was assured tay Mr Hildreth Mr Simpson and Mr Walker that she could use her sick leave for maternity purposes Mrs Khmiaon’i suit claim that on March 22 1973 without her knowledge or application she was notified that the Board of Education had' granted her a leave of absence without pay retroactive to Feb 26 1973 pursuant to board policies rules and regulations She claims that her contractual salary was reduced by the sum of 52288 even though she had sufficient sick leave to cover each teaching day she missed all of which were missed at the recommendation of a licensed physician The suit maintains that file rules practices and policies of the board are "patently arbitrary and discriminatory and are t FOR CHRISTMAS GIFTS FOR DAD SHOP PARK SHOPPING CENTER! Rights Act of 1971 j The suit alleges further that Mrs Klnnison has suffered financial hardship and “embarassment and slreta strain vexation and mental anxiety as a result of the defendants’ unlawful and discriminatory acts" The defendants have been directed by the federal court to file an answer to the complaint within 20 days Failure to file an answer according to the court will result in Judgment by default in favor of Mrs Khmison School officials Friday Indicated that they are consulting with attorneys and offered ' no comment on the court action A 1952 Ohio attorney general’s opinion maintained that payment of side leave for maternity purposes would not be legal under Ohio law The state auditor’s office also adhered to this interpretation Last summer the Ohio General assembly passed legislation mandating payment of sick leave for maternity purpose!
