Waller Charles Edward Tripp Henry Peck 'Gramps' Holland mail fraud for hiring Tim Ray in 1989 to kill a horse named Emili's Choice, which was insured for $45,000 and owned by the mother of one of Hunter's riding pupils. Hunter hoped the woman would use the insurance payout from the death of Emili's Choice to buy another horse from her or use her as a broker in making a purchase from another stable, said Assistant U.S. Attorney Steve Miller. Ray, who has acknowledged killing about 20 horses for profit over a decade, electrocuted Emili's Choice for a fee of $5,000, according to government filings.

According to prosecutors, Donna Hunter is cooperating with the government and will be a witness at the trial of Richard J. Bailey. Bailey has pleaded innocent to conning wealthy women, including missing candy heiress Helen Vorhees Brach, into buying horses at inflated prices. Bailey is also charged with arranging Brach's murder in 1977. the cases together because shells and shell casings from the same weapon were recovered in each crime.

Humphrey, Williams and Williams' brother, 16-year-old Marcuis, also are charged with attempted murder and armed robbery in connection with a shooting July 29 at a Decatur store. Stable owner guilty in killing of horse CHICAGO (AP) The owner of a north suburban stable pleaded guilty to arranging the killing of a horse in hopes that its unsuspecting owner would buy another horse from her with the insurance money. Donna Hunter, 43, is the 13th defendant to plead guilty during the federal probe of fraud in the equestrian business. Hunter owns Hunter Hill Farms near Mundelein with her husband. Judy Polonowski, 37, is charged with three counts of first-degree murder and one count each of second-degree murder, aggravated battery with a firearm and aggravated discharge of a firearm.

She is accused of killing Robert L. Sprague on May 23, 1992, after an argument in the home they shared in Pittsburg. Polonowski has since married. Judge Ron Eckiss on Friday set the start of jury selection for Nov. 29 in Circuit Court in Williamson County.

Prospective jurors will be questioned individually. Eckiss denied a motion by Polo-nowski's attorney, John Speroni of Marion, to dismiss the aggravated battery and aggravated discharge of a firearm charges. Speroni argued that to include those charges in the trial might lead to inconsistent verdicts. He retired in 1972 as a professor of chemistry at Sauk Valley Community College in Dixon, III. He was a member of the First Christian Church in Herrin.

He re ceived a BED degree at Southern Illi nois University at Carbondale, master's degree from the University of Illinois and a master's degree from the University of Mississippi, and was a scientist on the Manhattan Project, which produced the atomic bomb that was dropped on Hiroshi ma, Japan, during World War II. He had received the Atomic Bomb Med al and and a citation from Secretary of War Stimson. He was born Oct. 31, 1914, in Jonesboro, 111., to Edward and Mar tha (Meisenheimer) Tripp. He married Eva Kaleta on Aug.

12, 1939, in Zeigler, 111. She died Sept. 5, 1989. Surviving are one son, Dr. John Tripp of Cape Girardeau, two daughters, Sharon Fear of Long wood, and Martha Story of Bel leville, five grandchildren; one great-grandchild; and one sister, Ruby Lackey of Anaheim, Calif.

He was preceded in death by his wife, parents and a sister. Services will be held at 10 a.m. Monday, Sept. 12, 1994, at Johnson- Hughes Funeral Home in Hernn, 111. The Rev.

Mr. Herrell was retired from Free man Coal Co. Waltonville Mine. He was a member and chairman of the board of the First Christian Church, a member of the United Mine Workers a nd was an Army veteran of World War II, serving in the South Pacific. He was born June 9, 1920, in West Frankfort to William C.

and Lena (Kercheval) Henell. He married Jean Browning. She died Feb. 16, 1994. Survivors include one son and daughter-in-law, Terry and Debi Herrell of Centralia; one grandson, Alex Herrell of Centralia; one grand daughter, Amy Johnson of St.

Charles, two sisters, Betty Squano of West Frankfort and Mar tha Avery of Sunnyvale, two brothers, William K. "Bud" Herrell of Marion and Charles Halfacre of Du Quoin; and several nieces and nephews. Waller, 82 of Marion, passed away Wednesday Sept. 7, 1994, at 7:15 p.m. at Marion Memonal Hospital. Mrs. Waller was born Feb.

11 1912, in Anna, to Amry and Effie (Cox) Brown, She was married to Noel D. Waller on July 1 1, 1933, in Jefferson City, Mo. He preceded her in death. Mrs. Waller retired in 1993 after working as a clerk for Syd's Ladies Apparel in Marion for 25 years.

She was a member of the First Christian Church-Disciples of Christ, Marion. Zella was survived by one son and daughter-in-law, David and Vicki Waller of Marion; two sisters, Gracie King of Thebes and Iona Elliott Omaha, Neb. and several nieces and nephews; and one granddaughter, Shawna Waller of Marion. Zella was preceded in death by her parents, her husband (died Oct. 19, 1987), two brothers and two sisters.

Funeral services will be at 11 a.m today at Wilson Funeral Home of Marion. The Rev. Steve Bndwell will officiate and the Rev. Renee Brid- well will assist. Burial will follow in Anna City Cemetery.

Rose Madline Osborne HERRIN Rose Madline Os borne, 83, of 1101 S. 11th St. died Thursday, Sept. 8, 1994, in Herrin Hospital. Services will be at 1 p.m.

Monday in Van Natta Funeral Home, with burial in East Lawn Memorial Park in Energy. Visitation will be after 6 p.m. Sunday at the funeral home. Mrs. Osborne was a homemaker.

She was a Baptist. She was born March 30, 1911, in Gallatin County to Sam and Eliza beth (Hawkins) Hogan. She married Harvey Lavern Os borne. He died in 1972. Survivors include one sister, Grace Frost of Benton; one niece, Seconda Snyder of West Frankfort; and one nephew, Donald Wesley Snyder of West Frankfort.

Her parents, one brother, Clarence Hogan, and one sister, Mane Frost, also preceded her in death. John Benge JOHNSTON CITY John Benge, 57, of 1601 Benton St. died at 11:58 a.m. Thursday, Sept. 8, 1994, in Manon Memorial Hospital.

Services will be at 1:30 p.m. Sun day in Murman and Wilson Funeral Home, with the Rev. Fred Leist offi ciating. Burial will be in Lakeview Cemetery. Visitation will be after 5 p.m.

8, 1937, in Johnston City to Andrew and Ellen (Hill) Benge. He married Sherrill Campbell on Oct. 24, 1959, in Johnston City. She survives. Other survivors include his moth er, of Johnston City; three daughters, Angela Dodson of Herrin, Andrea Mueller of Johnston City and Amber Caraballo of Alexandria, six grandchildren; and one uncle, Joe Cargal of Johnston City.

His father and one sister, Nancy ee Benge, preceded him in death. Eber C. Saylors MURPHYSBORO Eber C. Saylors, 91, of 1412 E. Elm West Frankfort, formerly of Murphysboro, died at 5:30 a.m.

Friday, Sept. 9, 1994, in Union Hospital in West Frankfort. Services will be at 2 p.m. Sunday in Pettett Funeral Home, with the Rev. Bill Lewis officiating.

Burial will be in Pleasant Grove Memorial Park. Visitation will be from 6 to 8 p.m. today and until 2 p.m. Sunday at the funeral home. Mr.

Saylors was a retired iron worker. He was a member of Ironworkers Local 782 in Paducah. He was born July 4, 1903, in Pope County to Lucious and Lucretia (Darnell) Saylors. He married Madie Parkhill on uly 29, 1949, in Piggott, Ark. She died Jan.

11, 1986. Survivors include two daughters, Ruth Young of West Frankfort and Dorothy Knowles of Peoria; seven grandchildren; 1 3 great-grandchil dren; five great-great-grandchildren; and one sister, Patricia Stein of Caro, Mich. 9, 1994, a his residence. Mr. Holland was retired from Koppers Tie Plant in Carbondale, 111. He was a member of the Roy-alton Apostolic Church in Roy-alton, and was known to many for his Popeye imitations. Holland He was born March 20, 1918, in Bavere, to John Sam and Mattie (Witacker) Holland.

He married Anna Quails. She died Feb. 12, 1990. Surviving are two sons and i daughter-in-law, David L. Holland Bush, 111., with whom he lived, and J.C.

and Peggy Holland of Bush, 111. four daughters and sons-in-law, Jack ie and Carl Tweedy of Bush, 111., Vi ola and Oliver Miller of Murphysboro, 111., Mary and Robert Baker of Hernn, 111., and Janet Hal of Hurst, 33 grandchildren, in cluding John Pendall, who currently lived with him; 23 great-grandchil dren; one brother, Richard Holland of Hurst, three sisters, Lily Cook of Bush, 111., and Mildred InchclifT and Irma Thompson, both of Hurst, several nieces, nephews, cousins; and many friends. He was preceded in death by his wife, parents, two grandchildren, two great-grandchildren, four brothers and two sisters. He was born Sept. 24, 1921, in Marble Hill, to Lee and Rozetta (Hahan) Fisher. He married Celeste Eaker on July 14, 1940, in Marble Hill. She survives. Other survivors include one son and daughter-in-law, Don and Ginger Fisher of Marion; one daughter, Judy Fisher of St.

Louis; three grandchildren, Stephanie Solbrig of Carbondale, Martt Fisher of Dallas and Kate Fisher of Marion; three sisters, Alma Merdick of Marble Hill and Hallie Vesterby and Dora Cooper, both of Zalma, Mo. The charges were filed by assistants in his office before he took over the case, Garnati said. He told Eckiss that he will "probably be making a decision that will hopefully clear this up in the future." Eckiss denied Speroni's motion, but told both attorneys that it was with the understanding that the issue might be addressed later. In February, the 5th District Appellate Court in Mount Vernon reversed Judge Snyder Howell's decision that had dismissed all charges against Polonowski, and ordered that the case be returned to circuit court. The Illinois Supreme Court declined to hear an appeal. Howell dismissed the charges in July 1993 after concluding there was a possibility that Polonowski could not receive a fair trial.

Speroni had alleged misconduct by Garnati's office for failing to disclose that Garnati was preparing to marry the niece of a prospective ex- when Speakman rode into the path of a car in the eastbound lane of the highway. The impact of the collision threw Speakman into the windshield of Donald E. White's car. Police said the 63-year-old Valier man suffered minor injuries, but they did not say whether he was taken to a hospital. Mountain.

The witness was expected to testify that he considered Polonowski to be a battered woman. But the appellate court determined that there was no conflict of interest between Garnati and Michael Althoff, the clinical psychologist who had been hired by Speroni. According to previous defense briefs, Althoff thought that Polonowski was suffering from battered women's syndrome, and he thought that she had acted in self-defense when the shooting occurred. On Friday, Eckiss said he would need more time to consider a request by Garnati to obtain more discovery material from Althoff. Speroni said he will not use Althoff as a witness.

Garnati said he might want to call Althoff as a prosecution witness. But Speroni argued that two criminal cases, including one concerning attorney-client privilege, prohibit Garnati from doing so. Eckiss gave Garnati 14 days, and Speroni 21 days, to file more case law. Speroni said after the hearing that he is still considering whether to use another psychologist as an expert witness. Fire Perry County Sheriffs deputies are investigating a fire Thursday that destroyed two Timberjack log skidding tractors worth more than $100,000.

The fire, which deputies think was intentionally set, occurred about six miles west of U.S. 5 1 on Shamrock Road. The state fire marshal's office also is investigating, and a $500 reward has been offered for information leading to the arrest and conviction of the people involved.
