MACON DURING 1911 OWING TO LARGE NUMBER OF CANDIDATES FOR SOLICITOR BELIEVED TO BE THE ONLY FAIR METHOD Postcards containing the list of the proposed improvements for Macon which were outlined at the beginning of the year have been mailed to the members of the organization with the request that they check those improvements which they believe to be more urgent and mail it hack to the chamber Among the work which is listed will be seen the following: Conventions public library public golf links new park development packing plant new industries trade extension agricultural development live stock development publicity for advantages tree planting along highway festivities for opening of new union station get A out of debt manual training school for each for white and colored boys arch sign at new passenger station on Cherry street good roads freight rates passenger service attracting tourists to Macon make Macon capital city development of city and county boulevard river navigation one centrally located building for chamber of commerce Georgia state fair united charities and club quarters permanent exhibit of Macon made goods potteries factory development better acquaintance with and development of colleges and establishment of A The work which seems to be the choice of the majority of the members will be carried on first Tampa Fla Feb 22 Federal authorities here are certain that Dr Grant Lyman wanted by ihe postoffice authorities for misuse of mails and alleged to have defrauded clients out of much money through a stock jobbing scheme at New York spent from Tuesday of last week to Sunday afternoon here Publication in a local paper yesterday of Dr picture led to identification of a man who gave his name as Cisco and who secured a room with a private family here saying that he wanted quiet and did not care to go to a hotel The people at the house say Lyman and Cisco undoubtedly were the same man and a business man at whose home sought for a room says it was Lyman The landlady at whose house secured lodging says his baggage horn absolutely no mark of identification She said on Sunday afternoon he announced that he was going to move and sent his trunks by a transfer wagon to the Southern Express office Investigation develops that he expressed his trunks to Jacksonville to the express company office Under the name of Jackson Lyman is said to have used the alias of Jackson The federal authorities here have been unable to trace the trunks beyond Jacksonville TWO COCHRAN BANKS It looks now that Bibb county will i have three primaries this year If the county executive committee at its meeting Saturday decides to appiv the majority rule to all the county of- ficers and if no candidate in the race for solicitor of the city court should get a majority over all other candi- dates then a second primary will be necessary to decide between the two men getting the highest number of votes Then in September there will be the primary for governor congress-men state house officers and members of the legislature Owing to the large number of can-didates for the solicitorship of the--city court it is believed that the eminently fair plan is to provide for a majority vote so that the choice of the people ran be fully expressed It is believed that this rule will meet with the approval of all the candidates Officers to be chosen in the coming primary are: Clerk of superior court tax collector receiver of tax returns sheriff treasurer coroner surveyor rMicitor of the city court and five county commissioners Wednesday April 5 is the day favored for the primary by the va- rious candidates This date if adopted-would cause the registration books for- that primary to rioFe on March 5 the law requiring that the books close- thirty days preceding the day of elec-- tion Secretary Hines sent out no---tices Tuesday morning to the mem- bers of the rommittee calling them to meet nt the county court house at noon Saturday -t PLEA OF CRIMINAL SAVES ACCOMPLICE v'm FROM TRIP TO PEN A very important communication as to the number of experienced players and the maximum salary in the South Atlantic circuit was received by President Jacobs of the local club today The rule recently passed by the directors limits the number of experienced players to three and the salary to $150 per month Mr Jacobs stated that he considered it a very good ruling as it would tend to develop many young players and would increase the number that might be sold to the big leagues Following is the communication in part: having been recently made to me to know when the agreement regarding the use of experienced players becomes effective I have thought it best to notify club members that after conferring with the committee appointed by resolution at meeting of February 4 it has been decided to have the same go into effect on the opening day of our 1916 season Your club will be required to file with this office in advance of said date a list of its three experienced players including manager me to remind you that this rule has been further revised so as to include class players In other words players previously engaged in leagues of classification and above to the extent of ten games for pitchers and 20 games for all other players in any one Beason shall be regarded as experienced Players receiving more than $150 per month will be Mr Phillip Wachtel has also received a communication from President Corish stating that he would endeavor to have the opening of the season here the -Monday following Easter Local boosters have inaugu-ated a movement to have the whole city close up for the occasion and an attendance of 7000 is being sought Atlanta Ga Feb 22 That the state tax imposed upon tobacco dealers who redeem coupons or tags is unreasonable and arbitrary and therefore unconstitutional and void was decided by the supreme court of Georgia Tuesday in the case of the United Cigar Stores against Tax Collector A Stewart of Fulton county Judge Marcus Beck wrote the decision which was concurred in by every member of the supreme bench The decision reverses Judge John Pendleton The case began in Fulton superior court when the United Cigar Stores sought an injunction restraining A Stewart from collecting $200 special tax under a fi fa of 1912 Judge Pendleton refused the injunction holding the tax was valid and the United Cigar Stores appealed to the supreme court The section of the Georgia tax laws which is m-ade invalid by this decision is No 33 of the 1909 tax act which wyn poses a tax upon every manufacturer of tobacco and every wholesale or retail dealer in tobacco who redeems or offers to redem any tags or labels sold or distributed or given with a tobacco sale The tax is fixed at $200 for every place of business in the state where tags and labels are redeemed The United Cigar Stores Co has one such place of husines in Fulton county The supreme court held that the law is void because it violates section 7 of the constitution and section 6553 of the civil code (based upon the constitutional provision) providing that taxes of this character shall be uniform upon the same class of subjects In other words the court held that the tax was invalid because it singled out tobacco concerns thus discriminating in favor of all other businesses which might redeem coupons given with sales of ice cream retail merchandising stores drug stores hardware stores and any kind of business In the decision Judge Beck remarked that the question of discrimination might even have been raised if all merchants of every kind who redeemed coupons were taxed thus singling them out from merchants who never rdemed coupons but he goes on to say that this point was not pertinent to the issue and therefore aid not have to be Washington Feb 22 Fifteen southern and western attorneys general joined in filing with the supreme court of the United States an argument in support of the West Virginia liquor law prohibiting the receipt and possession of intoxicating liquors for personal use and of the federal Webb-Kenyon liquor law prohibiting the shipping of intoxicating liquor into states for use in violation of state laws The attorneys general were Wiley Jones of Arizona: Clifford Walker of Georgia II Peterson of Idaho George Cosson of Iowa Brewster of Kansas Ross A Collins of Mississippi Bickett of North Carolina Henry Linde of North Dakota Freeling of Oklahoma George Brown of Oregon Thomas II Peebles of South Carolina Frank Thompson of Tennessee John Garland Pollard of Virginia YV Tanner of Washington William Martin of Alabama The decision in the West Virginia liquor cases now before the court for oral argument is expected to be the most important of its kind in a decade The cases were to have been argued this week but the presence of only seven justices at the sittings resulted in a postponement Arguments Used seems strange at this late the attorneys general stated in their brief hear a claim made that the state and national governments guarantee to a citizen the right to possess and receive liquor for personal uso and to drink tnc same ir unlimited quantities such had been the case it Is difficult to see how any soil of prohibitory law could ever have been sustained since all of them have a direct tendency to reduce or prevent the use of intoxicating beverages and it is the purpose of all of them to promote temperance by the prevention of the consumption of intoxicants This purpose has found repeated expression in adjudged Decisions were cited to show that the supreme court lias held a state may prohibit the manufacture of liquor by a citizen for his own use a citizen of a state has a right to obtain intoxicating liquors for his own use in any quantity or in unlimited it waB argued would seem to follow he should at least have the right to manufacture such liquor for his own use from the products of his own labor and yet it is settled he has no such Turning to the Webb-Kcnyon law the attorneys general urged that to accomplish the valid purpose of prohibiting the traffic in liquors it is necessary for a state to have the right to control interstate shipments even for personal use is a step which has a fair relation to the end to be accomplished" they contended is the difference in principle between the denial of the right to Wilson and Secretary Lansing It is understood that he will accept thn place although he said when leaving tho White House that he still had it under consideration PIKE COUNTY MAN FILES BANKRUPTCY PETITION Kappa Sigma Conclave of District Six convened at the Dempsey Hotel this morning Delegates were present from the chapters at Auburn Alabama Georgia Tech Georgia and Mercer The morning session was consumed by reports from the chapter delegates and discussion of those reports All delegates reported that the Pan-Hcllenic Council were working well with the exception of the Georgia Council It was very gratifying to know that the chapters of Kappa Sigma leads in scholarship at Mercer Auburn Alabama and Georgia Tech Reports from the Atlanta Alumni Chapter let it be known that they are going after the National Conclave for Atlanta in 1917 and that it is backed by the Atlanta Chamber of Commerce All southern chapters of Kappa Sigma are working for this It will be quite a large thing for the university life of the south as Kappa Sigma is the largest college fraternity in America consisting of 82 chapters in the universities of this country and dating its history back to the year 1400 A The honor system in university was discussed at the morning session It is working excellently at Auburn and Georgia Tech the only colleges in this district where it is being tried One excellent new idea that was brought forth by the Georgia delegate was that instituted by the chapter there of having prayer meeting every Wednesday evening conducted by some member of the faculty of the university The Conclave will reconvene this afternoon at 2:30 The banquet will occur this evening at the Dempsey Hotel It was with much regret that the members of the Mercer chapter could not honor their visiting brothers with a dance or reception but due to the fact that only one day could be taken up with the conclave and as it is entirely a business affair it was deemed fit to omit this feature Deaths and Funerals GEO SUMMERS BARXESVILLE Barnesville Ga Feb 22 In the death of Geo Summers which occurred Sunday night Barnesville lost one cf its most distinguished and wealthy citizens who was known far and wide as a pioneer manufacturer of buggies lie came to this city from Alexandria Va more than fifty years ago and since that time has been engaged in manufacturing the vehicles which are sold all over the south For the past several years he had been in declining health and for months had been quite feeble He was 79 years dd Mr Summers had been mayor of this city and otherwise actively identified with the prosperity of the sec tion Field Gordon's beau tiful athletic grounds was named in his honor on account of his liberality and public spirit The funeral service was conducted from the Presbyterian church of which he was a member Monday afternoon Dr McMullen the pastor officiating He is survived by three sons Charles George and William all residents of this city and one one daughter Mrs Cook Taylor of Birmingham Ala PAULLIN BEGINS CRUSADE ON ALL SIGNS WHICH ARE OVERHANGING SIDEWALKS A vigorous crusade has been started by Building Inspector Paul lin against this merchants who have failed to secure permits for signs over sidewalks A surprisingly large number of persons it was disclosed have failed to comply with this ordinance The law requires the owner to suspend Bigns made entirely of metal and that it shall be constructed under tiie supervision of the city electrician and building inspector In addition the owner of the sign must enter a written agreement with the youth only 22 years old coming to the city from a little farm owned by his father in South how he had fallen in wtih a profes-sional crook in Atlanta and how as a' last resort he had been influenced to commit the crime for which he was now on trial was vividly portrayed by the Hon Frazer Lyon former attorney general of South Carolina who had been employed by tial people in Columbia to young Koon at the hearing Charles Arrington also repre-senting Koon made another talk appealing in nature Judgo Mathews as well as the tire court room was affected not only by the appeals of the lawyers but by the appeal of Naylor feel that under the circumstances I would do not wrong in suspending a sentence on this young man said the judge the law gives me the discretion to reduce a crime of this nature to a misdemeanor but to give" a sentence somewhat in keeping with' the enormity of the crime Koon Fined $400 "I will make the sentence of Koon one year on the state farm with the alternative of paying a fine of Judge Mathews thus reduced the offense to a misdemeanor Spectators of the court room were' deeply impressed as young Koon stood before Judge Mathews his body shak-: ing under hia inability to control hysteria which overcame him as counsel referred to his good people in South Carolina It appeared that Koon only this morning waked up to a realization of the seriousness of his crime Koon is a nice looking young hap On his countenance you could aee no trace of a criminal heart Naylor Changes Plea The caw of Naylor was brought to -i trial yesterday afternoon He entered' a plea of not guilty Koon took the- stand this morning and told the story of the crime from beginning to end is testimony was straightforward-Evidence pointed strongly against Naylor On the advice of attorney About one thousand farmers are expected to visit Macon on April 2 at the first annual meeting of the Georgia branch of the Southern Settlement and Development Organization which was organized in Macon last fall The meeting will he held in the city auditorium The scope of this organization is more extensive than any other of its kind in the country The purposes of the organization are to advertise in a conservative manner the resources of the state and to attract as many settlers here as possible thus boosting real estate values The Southern Settlement and Development Organization was organized in Baltimore Attended by governors from all over the south it was praised as one of the greatest means of advancing the interests of the South At that meeting it was decided to make effort to organize branches in each state in the south The Georgia branch is the third to be organized Virginia was the second branch Mottc of Savannah Is chairman of the Georgia branch Shedden is vice chairman and the board of directors is made up of the most prominent citizens of the state each of the twelve districts having one man on the board The Sixth district which includes Macon is represented by Taylor JOHN BENNETT IS URGED FOR CHAIRMAN Waycross Ga Feb 1 The friends of Hon John Bennett of this city are going to present his name for the chairmanship of the state democratic residential convention to moot
