Judge Hooey pointed out that the code contains many much needed changes. One change he calls "very beneficial is that jurors no longer have to be locked up overnight during the I pendency of criminal cases. This is a matter now within the discretion of the court and Judge Hooey said he does not intend to lock up jurors in criminal cases. Another change th e judge discussed was the elimination of the absolute right of severance. Judge Hooey recited one example in which two defendants were charged with the same crime and they were tried separately. One defendant received two years in prison while the other only received four months. Under the new code, these defendants would probably be tried together and would receive the same sentences, he said. Another "important change" cited by Judge Hooey was the enactment of the misdemeanor probation law.
