Bork submitted to a third straight day of questioning today as a key Undecided member of the Senate Judiciary Committee said he is not yet satisfied that the 60-year-old deserves to be confirmed. 'Tin still not clear" on the rationale that Bork would rely on in deciding sex discrimination cases, as opposed to race discrimination, said Sen. Dennis DeConcini, D- Ariz. shortly before the nationally televised hearings resumed. DeConcini said that mail to his Senate office is still running heavily in favor of Bork's confirmation, but less so than before the hearings began Tuesday. He said the mail is how tbout 2-1 in support of Bork, compared to 3-1 or 4-1 earlier. Bork, whose nomination has set Off a ferocious lobbying struggle between liberals opposed to his Confirmation and conservatives Who favor it, chatted amiably with Sen. Joseph Biden,. D-Del., the committee chairman, before the gavel sounded. " Once the session began, however, Biden questioned Bork closely 'about his views on privacy and free- "~ dom of expression. When Biden asked whether the Constitution provides a right to marital privacy, Bork replied, "I aon't know, It may well." But Bork ikkfed that he agrees with "the con- feept and I think it's important that it l»e maintained." Bork also said, as he did on Wed- ftesday, that his view of freedom of Speech has expanded in the last IS years. He said that while his view might not be as broad as current 'Supreme Court decisions, "I have 'bo desire to disturb that body of !aw." •'• The responses were in keeping frith his assertion a day earlier that •ihere is "nothing wild" about him as \ lawyer nor extreme about him as a .judge, and that his positions were not moderated with cveiy nomina- •tion for a federal job. „ Bork used the second day of his confirmation hearing Wednesday to .'forcefully deny that he was a racist, •opposed equality for women or •.changed stripes when it was •convenient.
