Ferguson on a charge of possession of heroin. Duncan waived trial by jury and \vns heard by Judge Ferguson. Court observers Iwlicved this is the first criminal district court case to be heard before n judge nlone in a number of years Judgr Ferguson assessed Duncan's punish „„,.,) .,» r.,,,,, ,...,, ri; )„ Texas Department of Corrections and formal sentencing has been set for Dec. 3 at I p.m. Duncan gave notice of appeal. Only two state witnesses testified in the trial, the arresting officer of the Department of Public Safety laboratory technician who tested the alleged heroin. No witnesses were called by the defense.
