After some discussion the following resolution was proposed by Councilman Preston who moved its adoption: Resolution Calling Special Election WHEREAS, heretofore and on or about the llth day of October 1923 this town did enter into a contract with David A. Baum of Omaha, Nebraska providing for the rental by the said Town of a tract of 162.95 acres lor a period of fifty (50) years at a stipulated rental of $1,600.00 per year; and WHEREAS such contract was entered into by the Town foi the purpose of acquiring a wate: eservoir or water supply for the ise ofjhe Town Municipal Wat r Works Plant and such pro- jerty has at all tunes since the [ate of the said lease agreement >een used by the Town for that >urpose; and WHEREAS negotiations have been commenced with the said David A. Baum looking to the acquisition of title to the said ;ract, the same to be paid out of the future net earnings of ;he Town's Municipal Water Works Plant at a price of Forty 'housand Dollars ($40,000.00) o be evidenced by Water Works Revenue Bonds; and WHEREAS such transaction as ontemplated will result in a ubstantial saving to the Town nd this Council deems it advis- ble to submit to the electors f the Town the question of uch acquisition for the benefit nd use of the Town's Municipal Water Works. NOW THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF LENOX, IOWA, AS FOLLOWS: 1. That the Mayor and Clerk are hereby authorized and directed to prepare and publish in the Lenox Tune Table, a newspaper published hi Lenox, Taylor County, Iowa and having a general circulation therein, a good things necessary and proper to carry out the true intent and purpose of this resolution. The above and foregoing resolution was seconded by Councilman Nelson and passed with record, all councilmen voting aye. Councilman Tyler proposed the following Resolution and moved its adoption: WHEREAS, this Town now owns and operates its own Municipal Electric Light and Power PI;ait System as well as its own Municipal Water Works; and WHEREAS the conduct of the business of the said Municipal Utilities may, in the opinion of this Council, be more efficiently and advantageously performed by a board or boards of trustees as outlined in sections 6144 to and sufficient notice of said election, once each week for four consecutive weeks, the last publication to be not less than five (5) days nor more than twenty (20) days before the date thereof, and such election to be in all respects conducted as required by law for the Town of Lenox, Iowa. 5. The Town Clerk is hereby authorized and directed to cause to be prepared all such ballots and poll books, and other supplies as may be necessary for the proper and legal conduct of said election and to do all other 6149 inclusive of the Code of Iowa for 1931; and WHEREAS this Council considers it advisable and for the best interest of the Town and its Inhabitants that the questions of placing the management and control of its Municipal Electric Light and Power Plant System and its Water Works Plant in the hands of a board or boards of trustees be submitted to the electors of the Town at a special election; and WHEREAS, by resolution of this Council just passed and adopted, a special election has been called for the 4th day of October, 1935 on which date it is proposed to submit to the electorate another public question as in such resolution set out; and WHEREAS the questions of placing the management and control of the Municipal Electric Light Plant and Water Works Plant in the hands of a board or boards of trustees can be submitted to the electorate most economically at the same time; NOW THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF LENOX, TAYLOR COUNTY, IOWA, AS FOLLOWS: ..Section 1. That at the special election heretofore called by this Council to be held on the 4th day of October, 1935, there shall be submitted hi addition to the question previously provided for, and upon the same ballot, the following public measures, towit: "Shall the Town of Lenox, Iowa place the management and control of its electric light and power plant system in the hands of a board of trustees?" and "Shall the Town of Lenox, Iowa place the management and control of its water works plant and system In the hands of a board of trustees?" Section 2. That the questions to in the previous resolution calling such special election. Section 3. That the ballots to be used at the said special election at which the said measures are to be submitted shall be the same size, similarly printed upon yellow colored paper and to read substantially as follows: (FORM OF BALLOT) At the top of the ballot, print the following: (Notice to Voters: For an affirmative vote upon any question submitted upon this ballot, make a cross (X) mark in the square after the word "Yes".
