Present: Aldermen Porter, fiexe, Lalley, Thune, Skancke, Absent: Alderman Graham. Mayor Martin Osterhaus presiding. The minutes of meeting of July 6, 1959 were approved as read.

The City Auditor advised that this was the time and place set for opening of sealed bids for gravel bituminous asphalt pavement for Street improvement Project 59; Notice to didders has been pub' ilshed as required by statute, and Affidavit of Publication is on file in the office of the City Auditor. Moved by Sexe, seconded by Skancke, that the bids be opened. Voting Aye: Roby, Porter, Sexe, Lalley. Thune, Skancke, Larson. Motion carried, and the following sealed bids were then opened: W.

E. Bartholow Son Construction Huron, South Dakota, Total Bid $76,476.56. G. H. Lindekugel Sons, Mitchell, South Dakota, Total Bid $71,060.07.

The bids were referred to the acting city engineer, city attorney and public works committee for study. Charles Krall, representing the Junior Chamber of Commerce, appeared and presented a proposal to make. available to the city for off street parking a SO ft. lot between 1st and 2nd on Main Street. A discussion period followed, and it was suggested that a more extensive study be made before any decision is reached.

Acting City Engineer Kinport reported on the sealed bids on asphalt paving, stating that the total cost is 10 to 15 per cent above previous assessment estimates. Ensuing discussion terminated with Sexe moving to reject all bids, which motion was seconded by Roby. Voting Yes: Roby and Sexe. Voting No: Porter, Lalley, Thjine, Skancke, Larson. Motion lost.

Moved by Thune, seconded by Larson, that the bid of G. H. Lindekugel Sons, be accepted as the low bid received. Voting Aye: Roby, Porter, Sexe, Lalley, Thune, Skancke, Larson. Motion carried.

Alderman Roby offered the following resolution and moved its adoption: RESOLUTION WHEREAS, Tabbert, Sioux Falls, South Dakota has deposited with the City Treasurer of the City of Mitchell, South Dakota the sum of Three Thousand Two Hundred Dollars ($3,200.00) to pay the cost of surfacing certain streets In Bridle Acres Addition to the City same being on North Kitttidge Street between East First and East Sixth Avenues; And WHEREAS, alnw the adoption of said resolution certain water main has been installed in a portion of said street, and the excavations necessarily dug in said have not yet properly settled and stab- lized as a result of which it is not feasible at this time to proceed with the surfacing of those streets; now therefore BE IT HEREBY RESOLVED by the City Council of the City of Mitchell, Davison County, South Dakota that the resolution of necessity for the improvement of certain streets heretofore adopted on the 6th day of April. 1959, be and the same is hereby amended insofar as improvement number 1 is concerned, by deleting therefrom the improvement on North Klttridge street between East First and East Third Avenues, but that in all other particulars said resolution remains as heretofore adopted. Passed and approved this 20th day of July, 1989. Moved by Larson, seconded by Thune, that the application of Harvey Paul Diede for abatement oi school poll tax in the amount of ll.OO, as approved and recommended by the Director of Equalization of Davison County, be approved und allowed. Voting Aye: Roby Porter, Sexe, Lalley, Thune, Skan eke, Larson. Motion carried.

Moved by Porter, seconded by Sexe, that the following reports be approved and filed: Treasurer's Trial Balance and Excavating Per mils Report. Voting Aye: Roby Porter, Sexe, Lalley, Thune, Skan eke, Larson. Motion carried. by Porter, seconded by the City Auditor's Statement of the Finances of the City of Mitchell, South Dakota from December to June 30 1959, be approved. Voting Aye: Roby, Porter, Sexe, Lalley, Thune Skancke, Larson.

Motion carried. Alderman Porter offered the fol nf lowing resolution and moved it: adoption: RESOLUTION WHEREAS, the City of Mitchell Davison County, South Dakota now has on deposit in its checking ac count in the Mitchell National Bank of Mitchell, South Dakota the sum of Mitchell, Davlson County, South' of Four. Hundred Fifty-eight Thous and Four Hundred Fifty-three Dol lars and Five Cents ($458,453.05) such amount being, in major part the'proceeds realized from the sal of bonds issued by the said City Mitchell to finance Improvement 'a the sewage disposal -system the City of Mitchell, and It appear ing that only a portion of sai money will be needed in the im mediate' future to meet the expen ses of such improvements; no therefore BE IT TTEREBY RESOLVED the City Council of the City of Mit chell, Davison County, South Dako ta that the City shall forthwith withdraw from said checking ac count the sum of Two Hundred Fif ty Thousand Dollars ($250,000.00 and denosit one Hundred Thous and Dollars ($100,000.00) of sue amount in a savings account wit interest, and invest the remalnin One Hundred Fifty Thousand Do lars ($150.000.00) in United State Treasury Notes bearing interest a Three and One Half (3V4) percen coming due in May of 1960. BE IT FURTHER RESOLVED that the proper officers and employees of the City of. Mitchell be and they are hereby authorized to execute such documents as may Dakota; and WHEREAS, a contract has been entered into between the City of Mitchell and the Lindekugel Construction Company for the surfacing of certain streets in the City of Mitchell; now 'therefore BE IT HEREBY RESOLVED that the contract with Lindekugel Construction Company shall have added thereto the the following Bridle Acres Addition: 1.

North Marshall Street from the north property line of East Fourth Avenue to the north property line of Lot Thirty four (34) in Block Four (4) of said addition. 2. Bridle Drive from the west propertly line of Lot Fourteen (14) In Block Two (2) to the east property line of Lot Twelve (12) in Block Two (2) of Bridle Acres Addition. BE IT FURTHE3 RESOLVED that the surfacing of said streets be in accordance with the specifics tions heretofore established for the other streets to be surfaced by the said Lindekugel Construction Company, and that the cost of surfacing the above described streets shall be paid from and out of the money on deposit with the City Treasurer. Passed and approved this 20th day of July 1939.

Mayor Osterhaus reported on a recent meeting with the Traffic Safety Committee of the Chamber of Commerce and the Public Health and Safety Committee, and read a letter from the Chamber of Commerce In which it recommended certain changes in speed zones entering Mitchell on State Highway 37 and U. 8.

Highway 16, installation of larger signs for right hand turns in downtown Mitchell, setting new speed limits on city streets, removal of school zone speed limit signs during the summer months, and asking further study and consideration be given to establishment of one way streets clear across town from east to west, Alderman Porter offered the following resolution and moved Its adoption: RESOLUTION WHEREAS, due consideration has been given to the speed zones established by the South Dakota Department of Highways on United States Highway 16 immediately east and immediately west of Mitchell and on Highway 37 im egal holidays.
