assault and nattery Allison for the prosecution and Maloney Perkins for defendant Verdict guilty Sentence set for DectJiaUar 24 1S91 In the cat6 of the United States vs Wr A ThrAilkill motion of Rutby Kane for continuance of the case was denied and the bonds of the defendant with Lutv and A Dillingham forfeited In the case of the United States vs Phillip Roberts on motion of Allison jr order continuing the case till March The people vs William Johnson on a i second charge of assault and battery on trial POLICE counT Matney arrested for doing business without a license was fined 1 and costs of prosecution James Greek pulled on the charge of violating the fire ordinance by erecting oa wooden shanty within the fire limits was lined tMO and costs 4 James Foster and William Ward will have a hearing this morning on the charge of disturbing the peace UErOIlE JCDGE manor Only one case came up for disposal yesterday and that was the case of Alexander Ltobb whose arrest on the charge of grand larceny was noted in Tun HERALD several days ago He was arraigned pleaded guilty ana was bound over to await the action of the grand jury PROBATE COURT In the matter of the estate of Anna Noonan an order was made for the sale of real and personal property Tho Pressure too Great Just as the performance of Skipped by the Light of the Moon was over at the Grand opera house on Tuesday night a water pipe burst in front of the building and in a few minutes the streets were flooded with water and tho basements of some of the large buildings were deluged About half of the people succeeded in getting out of the building when the terrific force of the water caused the earth to gi away and the water began pouring into the entrance of the building as if guided by a hose The hallway was full of people and many of them received a good wetting and others who had not yet made their exit did so through tho stage entrance After a half hour or more the water was turned off but not until several hundred dollars worth of damage had been done This was followed yesterday by the bursting of a number of water pipes in dif ferent parts of the city In the First National Bank building the pressure bursted a pipe on the fourth lioor and before it could be repaired the water had gone through all the floors to the basement and completely Hooded the office of the Evening Mail The 5 water dripped into the cases from the cell lug above until the type in the cases was actually swimming and the printers were compelled to cease work The editorial room which is in an apartment adjoining the composing rooms was also submerged Colonel A Hays the editor says that an hour previous to the break ho had put a t20 bill into the lower drawer of his desk and that it was afterwards picked up in a mutilated condition by the janitor scrub bing the floor The First National bank room was but recently repapered and fitted up The plastering fell to the floor in large pieces and the clerks had a lively time in saving seine of the books from the water A break was reported at 2749 Grant avenue as well as at several other places The cause is said to be from the terrific pressure that was on i City Council The city council met in special session for the purpose of taking some action in reference to the proposed power works to be erected at the head of Ogden caflon to grant Orvjllo Banks and William hompson a franchise to ereot and operate in all the streets and alleys of Ogden city an eectric system to convey electricity for 1 jnutivc power lighting heating and all ether purposes to which it might be an piled The mayor stated that the meeting had been called for a purpose uhictt meant something of importance to Ogden city He was opposed to calling a special sessions for the purpose of railroading an ordinance through the council This was a matter which must be disposed of at once or Ogden might lose an industry which will perhaps mean the investment in den of hundreds of thousands of dollars in manufacturing in dnstries He did not believe in granting privileges to a fev but whatever action might be tatren that it will benefit any and ul alike He asked the council to consider I the question carefully I Mr Banks said that be was willing to have their franchise become null and void if the power plant is not in operation ny September 1 Ib92 and that It would be sat isfactory if a section be added requiring them to be ready to furnish 1800horso poer from utilization of water from Og I den river by that time Amendments were onereci which make the ordinance stipulate that the power works must be completed by September 1 hJ2Attornov Attorney Hey wood appeared in the in terest of Ogden Cit City Electric Light company and endeavored to impress the mem bers of the council that in the event a franchise is granted to Thompson and Banks it tvouid work a hardship to his company 4 Messrs Banks and Thompson replied it was not their intention to injure any indus try in Ogden city It is true they would be competitors to a certain extent of the company which Mr Heywood represents yet they believed they asked nothing but what was right of Ogden city that delay would imperil the question of the ower works for Ogden They have laborc oweri i lLo enterprise for months and have nade arrangements by whch they are 1 to induce an immense amount of mone to be expended in Ogden city Coun Hors Elliott and Dee favored ro ferring the matter to a committee to report at 2 oclock Thursday Mr Banks was asked if this would inter fere with them in carrying the project through He replied that their contracts for water right etc would expire on December 31 that it would necessitate taking a trip to San Francisco to doc up arrangements with parties whom thij have induced to come here with their money that the action of the council tonight would decide the success of the enterprise that the parties in San Francisco expect an answer tonight After considerable discussion an amendment was offered and carried that the committee make a report belore 1230 a December 24 1891 An adjournment was taken for one hour at 1010 oclock The council was called to order at 1115 with several members absent A special committee composed of Councilo Spencer Clawson and Lunday made a report which was unanimously adopted The ordinance was read as amended and passed Ji The rules were suspended and with some ff amendments read its title und passed at i 55 1145 This brought forth applause from those present and the power works were made an assured fact For two years past the utelization of the water of the Ogden river by the erection of mammouth power works has been the dream of all Ogden citizens At last their hopes have been realized and the Junction City is rejoicing The franchise is granted for a period of fifteen years General Gleanings Sleighing parties seem to be all the go A heavy snow storm fell here yesterday Several electric lights are being put in on Twentysecond street Charles Meghan is reported as slowly but surely improving THE CUKISTMAS HEIIAID will greet its Ogden readers this morning The building of tho power works will fill one of Ogdens greatest needs Sheriff Loveland of Box Elder county was In the city yesterday The street railroad company had two motors out yesterday clearing the tracks of snow The heavy snows in all directions have not delayed the passenger or freight trains to any extent The Wasatch Literary club has arranged to give an entertainment to the public at tho county court house Saturday night The entrance of the First National bank was draped with crape in memory of the I late Bishop Sharp who was vicepresident of that institution The Ogden letter carriers will give a ball in the opera house next Tuesday even ing They have extended an invitation to I their Salt Lake brethren County Clerk Joseph Ledwidgo issued I marriage licenses yesterday to Chase and Miss Etta Mitchel both of Og den Henry Hunt of Ogden and Miss Myrtle Kettle of Cedar Falls Iowa A rumor was afloat yesterday afternoon that the Methodist University had been seton fire by some incendiary and that it was discovered and extinguished before much damage was done A member of the board of uirectors was seen last evening and he isclaimed any knowledge of it Dr Edward Thompson delivered a lecture at the First Methodist Episcopal hurch last evening using as his subject The Best Day for All He was formerly a professor at Baldwin university and resident of York college Nebraska and ecently accepted the position of vice resident of the University of Southern California The Sunday school of the First Presby erian church will give a pleasing Christmas entertainment at the church this even i ng St Nicholas will be there with Father Time to aid in the distribution of presents the children as well as the older folks I One feature of the occasion will be the bringing of presents by the members of the Sunday school to be distributed among the poor people Candy nuts etc will be distributed I ributed promisicously among those present The members of the Ogden fire department have been busy for a week past preparing paring for their second annual ball which is to occur in the City Hall tonight The floor of the east room has been waxed ands in excellent condition A HEUALD reporter visited the place last evening and the boys were just about to complete the decorations which have been arranged with taste and care On the west side of the hall are the pampier decorations be i longing to the volunteer company along with elegant designs composed of wreaths of flowers and evergreens Another portion of the room is a representation of a fireman in the act of rescuing a child from a burning building The representation is so realistic that it is well worth seeing and no doubt the novel feature of decoration will be viewed by many appreciative eyes Not only has Christiansens orchestra been eniraeed but the Silver Moon Mandolin and Guitar club will be in attendance PROVO THURSDAY Dec 24 THE POLITICAL CALDRON Democratic Mass Meeting A Tramp Brought to a Fnlltop Tho political ball is beginning to roll There are many forecasts as to who will be brought forward as candidates for city offices by both parties The Republicans have put on a bold front and suggested the name of Reed Smoot as their candidate for mayor Tho Democrats have a score of good men in view but have laid stress on no names On Saturday night there will be a grand rally of Democrats at tho court house when the public will be addressed by Hon Kintr A Gash and Nelsen There will be a brass band and drum corps in attendance at the meeting and the occasion will be one replete with Democratic zeal Houtz will stump through Sanpete next week in the cause of Democracy POLICE POIKT3 Charles Miller a tramp who got a fif teendays layup in the city jail on Tues day made a break for liberty yesterday and was tired upon bv Road Supervisor Strong The vagrant secured fifteen days to escape the blasts of winter and at the same time obtain something for tho inner man The officers however decided to stop the racket of making the city jail a coveted retreat of tramps by giving them exercise in throwing the rocks off the street Charlie was thus put to work yes terday and at once displayed a repugnance to manual labor In a moment when the officers attention was diverted elsewhere he made a dash toward the depot Officer Strong drew his gun and fired four shots in quick succession none of which struck the tramp but served to frighten him out of a few pounds of flesh and bring him back to work City Marshal Brown has retired from the restaurant business and William Hill will succeed him Sheriff Fowler has captured Moriarty one of the men who is implicated in the murder of a man who died at Tmtic from the effect of wounds inflicted with a long handled shovel and other weapons a short time ago Commissioner Goodwin Judge Smith decided that it was a case of malic ee ious prosecution and exonerated Judge Colburn at the same time taxing Pierce with the cost of the trial A complaint was filed in the sheriffs of Ice yesterday by James Allen charging Christian Anderson with petty larceny Plaintiff claims that Anderson stole a calf from his place on the island PERSONAL AND GENERAL Judge Smith officiated in a delightful wedding today Mr George William Lar kin and Miss Emily A Trott of Ogden being the contracting parties To make their marriage doubly certain they will go through the Temple
