Wait I AKotlier Week I Work on the Boulevard Progressing JHcoly RedncJnsr the Force in tho En jriHoerlng Department Warrants Coming in Slowly Keports County Selectmen Bamberger Baboon and Morris sat yesterday as aboard of water comissioners for the I purpose ot hearing the petition of James Hansen for an original water right to a small stream of water which flows into Parleys creek several miles 1 above the mouth of the Parleys creek conduit In his petition Hansen sets out that in 18S6 he located two i i mining claims in Parleys canyon designated as the Warm Springs mining district called the Golden Faith and Golden Faith No2 and that in the working of the claims he developed a stream of water which water is necessary for the economic working of the mines Attorney Allen appeared for the petitioner Salt Lake city represented by City Attorney Coad filed a contest and claimed the water by virtue of former appropriation The contest papers setout that for twenty years before Hansen had located in the canyon the stream in question had flowed from a cave or tunnel and on down the moun tain side into the creek When Hansen and his associates commenced op erations they diverted the water and claimed to have developed the stream in their workings The hearing occupied the attention I of the board during the day a large number of witnesses being examined I I and had not been concluded when an adjournment was taken last evening PAY DAY PASSED City Employees Will Have to Waltz Another I other Week None of the city departments or offi ters were paid off yesterday for the very good reason that there was no money in the treasury with which to pay them County Collector Leonard not having made a settlement with the city treasurer No money was received from the collector yesterday although Friday was the date upon which a transfer of money should have taken place Of course Treasurer Duke still has money enough to redeem all outstanding warrants but this does not Include department expenses Pi inents mav be made by the middle nt i the week THE BOULEVARD A Force of fifteen Men Employed Upon It Fifteen men are now employed on the new boulevard now being constructed in City Creek canyon by the charity committee through the application thereon of the work of unem ployed men who are in need and de sirous of obtaining work During the nast week the force has made a remarkable record and the drive already begins to assume some proportions The work is under the direct supervision of the head of the street depart ment which has put a foreman in charge The men were first started in the canyon about 2000 feet above the upper tank and the road will be completed around the face of the hill to 1he head of i street The men are given work alternately but fifteen be ing employed repularly during the week Reducing the Force Eight men were discharged from the field force of the city engineer last night and during the winter months but little work will be done outside of the office In this department During the past week the department has been at work preparing final estimates of the work done on street paving and sidewalk contracts and making maps of the gravity sewer system These maps will be very complete and represent I all the features along the line City Warrants i Holders of city warrants are not presenting I them for redemption very rapidly and City Treasurer Duke has issued another notice calling upon them to get a rustle on themselves He is very desirous of canceling all warrants ana tvuiuu uc fjicuocu LU see their holders at Ills office The run made I I yesterday was an improvement over thatof Friday Jrorlslon Inspector Notwithstanding the action of the sayor Provision Inspector Kendall is at hia old post and will remain there until his successor Is appointed and has qualified During the past week the inspector has made 419 inspections I and condemned as unfit for food 125 pounds of fruit 470 pounds of game 721 pounds of poultry 70 pounds offish and 375 pounds of sweet potatoes making a tqtal of 4061 i Health Department I Eleven complaints were made last i I week to the health department One II case of diphtheria was reported one case of scarlet fever and from the I latter disease one death occurred Eighteen burial permits were issued and two shipping permits The num ber of reported births reached the respectable total of 2L Street Department The street department was engaged last week In putting in stone crosswalks at the intersection of State and 4 yifth South streets Eighth East and First South streets South Temple Theodore Salmon whose playing so charmed his audience on Tuesday evening will give another recital on the 17th inst at the parlors of the Salt Lake Music company The room will accommodate four hundred and It should be well filled Mr Salmon will be assisted by several of our leading musicians He left for San Francisco on Friday intending to give two recitals in that city Tho Orpheus Club The Orpheus club is having frequent rehearsals in preparation for the concert on the 12th inst when the club will assist the Mendelssohn quartette of Denver The concert should be well attended not alone because it will be a rare musical treat but because Denver showed true fraternal appreciation of the Tabernacle choir when it visited that city Notes San Franciscans are jubilant over the fact that Sousas band has been I engaged for the entire season of the I midwinter fair The past week witnessed two notable musical events the recital at Calders music palace by Mr Theodore Salmon and the contest at the tabernacle The Herald quartette composed of William Clements 1st tenor Rowe 2nd tenor Joseph Adams 1st basso and John A Adams 2nd basso is a new organization that is doing some excellent work It is hoped Henri Martear the violin virtuoso will visit this city in his tour of the United States He has recently added some fine numbers to his re pertoire which now numbers 134 selec tions IN POLICE 1000 eacn The men are charged by Johns I Hauswirth with having stolen crpen ter tools from his residence while he was detained at the city jail for an assault upon his wife and when I Rices residence on Fifth West was i i searched a great variety of carpenter tools and many other articles were I I found Some of tae property was iden tified by Henry Tarrant of North Salt Lake whose residence was burglar I ized a few weeks ago They are also charged with the recent robbery of the North Salt Lake broom factory Detectives Sheets and Rhodes who made the arrest also recovered five cots a desk a table and other arti cles of furniture from a second hand dealer to whom they had been sold by Rice and Medlar Several alleged criminals are being held at the city jail awaiting prelim mary examinations Among them are Johnson alias Ransom an ex convict and George Harris who are being held on suspicion of having burglarized the safe of the Denver Rio Grande Western at Spanish Fork Miss Stevenson who claims to be a clairvoyant and test medium and is the landlady of a lodging house at 44 East Second South was charged with using abusive language the complainant being Louis Rocca The hear ing developed many amusing features but the court discharged the defendant Rocca alleged that Miss Stevenson I had used some improper language I in conversation with his little sister and the youth went to see about it The visit does not seem to have been very satisfactory but the arrest of the I young woman followed Three lodgers at the house testified that the boy was the only person who used abusive and improper language they having heard the conversation from the land I ing above Charles Olensilt charged with fight ing failed to appear and forfeited 5 while the other party in the the Receipts and Disbursements Decision i in tho Dyer Case The end nf the second day of the hearing In the case of Ernest I You get al minors on accounting of the guardian Mrs Sibella Clayton failed to witness a conclusion and the case went over until Friday next The en tire day was consumed with a continuation of the examination of Mrs Clayton as to the receipts and disbursements of the estate and she vas still on the stand when court adjourned In the course of her examination Mrs Clayton was questioned as to the petitiOn filed in this court in 1884 for the sale of the property on the ground that the income was insufficient to support her and her children the sale and as to the disposal of the surplus after the purchase of a cheaper place It was not within her knowledge that her present husband was the actual purchaser of the property Neither I had she any reason for knowing that Mr Clayton furnished the money for the purchase in the first instance He however afterwards bought it from the actual purchaser a Mr Lyman Her husband paid the money to her in the first instance as Mr Lyman agent She received from the Brigham Young estate certain stock coming to her husband 172 shares Ernest I had his shares and witness had the balance She had property of her own now between 30000 and 40000 which Mr Clayton a ve her THE DYER CASE Judge Blair rendered his decision in the Dyer estate case and ordered the executors to pay a family allowance of 75 per month from the date of their Qualification until October 19 the date of the widows marriage to Searles The amount allowed is but half that asked for by the petition Judge Hen derson is the guardian of the children and must hereafter provide for their welfare In rendering his decision Judge Blair went into and reviewed the case since its first appearance in the probate court and caused no little amusement by his reference to the marriage re lations of the parties interested Even Ogden Hiles attorney for Mrs Searles received an occasional dig The court went brefly into the provisions of the late Mr Dyers will The deceased he said bequeathed to his widow 10000 III east tie also jjave nei the homestead in which she now resided and all the appurtenances thereto belonging i in addition to a piece of property on Commercial avenue The former was valued at 15000 according to the evidence and the latter at 35000 or 40000 Mr Dyer obligated the executors to remove the mortgages off both pieces of property so that the widow could have them entirely clear and Mrs Dyer herself admitted upon the witness stand that she had had an advance from the executors of about 2000 and that she received as rentals after paying for necessary repairs and insurance on this property the sum of 300 per month So far as the widow was concerned that would seem to bean ample amount for her support without any allowance from the general assets of the estate But the most important point had yet to be named By the terms of the will Judge Henderson was the guardian not only of the persons but of the estate of the three infant children The mother had no cQntrol over them without the guardians permission Mrs Dyer had already it
