MORNING Eleven to One For An Unconditional Conviction Was Shown By the Ballot In the Jury Room One Man Said to Be Opposed to Capital Punishment Prisoner Content The Jury in the case of John Douglass charged with murder found the defendant guilty of murder the first degree and recommended that he be imprisoned for life in the state prison The verdict was arrived at a little after 3 oclock the afternoon and time for passing judgment was set for Monday morning At 9 oclock yesterday morning the jury came into court and asked for further instructions They presented I i 4k I I JOHN DOUGLASS written request asking the court if the obligations they took as jurors should influence them in the matter of recommending that the death penalty be not Inflicted All the jurors had answered that thaI favored capital punishment oat one at least evidently wished to mitigate the punishment from the extreme penalty The court instructed them that the recommendation was a separate matter and the jurors wee entirely free from restrictions Again they retired and at 1130 came lr ocroln tilth onrttVipr griffon rmpKtinn This was an inquiry If there were degrees of insanity which might be properly considered in fixing the degree of punishment The court instructed them that a defendant was either sane or insane and if sane he was responsible if Insane he was not accountable for his acts The court then adjourned till 2 oclock At 2 oclock the jury had noMenort to make and adjournment was taken till 330 That hour came and still no sign came from within the jury room The crowds of spectators still waited without talking in whispers and waiting Suddenly came a sharp decisive knock from within which made a sudden hush come over the throng It was I like the knocking at the gate in Mac beth Every eye was fastened on the door when Bailiff Harrop opened it and received the message that the jury had agreed A message was sent to Judge Rolapp The sheriff brought in the prisoner who looked a shade paler than usual and whose face twitched somewhat under the great strain At just 350 the jury tiled Into court and after the usual questions presented the following verdict which I i was filed and read State of Utah vs John Douglass We the jury in the above entitled action find the defendant John Douglass guity of murder in the first degree as in manner and form charged in the information and recommend him to the mercy of the court WILLIAM SMITH Foreman The court then said There are but two forms of verdict hen you find the defendant guilty of murder In the first degree elthar guilty of munl in the first degree in the manner and form as charged in the information or guilty of murder in the first degree with the recommendation that he be imprisoned at hard labor for life No other verdict can be received by the court so fares that degree of murder is concerned You will have to retire with the officer and prepare a proper verdict Aft the jury was discharged It was learr i that
