7 7W 2J SHE SALT LAKE HERALD SATUBDAY MAKCH 25 1893 THE 1N1TlluI1 ENDED Further Testimony Concerning Martin and Moyer NONPAYMENT OF COSTS Mr Moyer Denies That There Was Any Arrangement Made One of air Hurds Questions Arouses His Ire A Great Number of Cases Inquired Into but No Very Damaging Evidence Commissioner Moyers investigation 1 was resumed yesterday morning i I He was asked if he I i had paid the fines in his possession oer to the county since I the investigation was begun and replied that he had I Tho matter of fees was then taken up i and Mr Varian asked the commissioner I II hich fee bill he used the Territorial or United States His reply was that he had I always been governed by the latter Mr Varian Well wny have you been governed by the United States fee bill when you have acted as a justice of the I peace I Mr Moyer am a United States officer i and hold that I have a right to charge as 1rovided in the United States statutes The matter of fees was then gone into at some length but it all looked favorable to Mr Moyer II THE HOBBS FUND AGAIN IAn interruption was caused at this I point by Joe Bush being recalled to answer a few question relating to the Martin matter and the discharge of the I man Hobbs whom it was alleged had paid 50 to have the case dismissed Mr Bush stated very emphatically that Hwbbs only pave him 25 and that he gave it tp the woman She then gave the commissioner 5 Bush 5 and kept 15 i Other questions were then asked but I nothing material to either side resulted I Jmm them Mr Bush was then excused and A Sibley was called I WHO PAID THE COSTS He testified that the only arrangement made between him and the commissioner was that the costs in cases were to lie paid as money came in on other cases Well if the money didnt come in Mho paid the costs asked Mr Baldwin The money always came in though replied tbe witness Ididnt sue unless I knew the parties were good When you served summonses in Mr Hartins court how much did you get for service 4I always got MOTEB TAKTKD IT ALL Didnt you have some trouble with Mover about serving a summons Yes How did the trouble arise Did Moyer wish to keep half of the amount I Xo he wanted to keep it all Additional questions however brought out the statement that Mr Moyer paid tic 2 and that the trouble arose over the I fact that he didnt have the change when Sibley wanted the money paid Mr Hcycrs hearing was then resumed ROUSED HIS IRE Were the entries in this criminal pocket made before this investigation was bun asked Mr Hurd Certainly I not answered Mr Moyer angrily If there is any question but that I can produce witnesses to star that they are the original entries Judge JuddWhy do you wish to ask such a question as that Mr HurdBecause I want to know Mr Varian Did other commissioners lrldie as attorneys in your court Mr Moyer Yesthat was the custom Booth Lee Gray brought a large num Vx 01 cases in my court and I brought suits in other commissioners courts THE HITCHIE CASES ilr Hurd Referringnow to these cases aganst Ritchie the clothing club man I notice that Mr Wheeler appears for the plaintiff which was the people of the ternary Mr Moyer He represented the com 1 Dining witnesses There were several case against Ritchie for obtaining money under false pretenses I found him guilty nd fined him 5 in one case and 2 in the other A subsequent case was never prosecuted In the case of the People vs Terrell how was the bond given or A ertified check for 100 was sent me end I cashed it When Tirrell was discharged I gave my personal check for the amount Mr Varian Did you keep money belonging to ot er persons in with your personal accou Mr Mover lid THE DR DOGGE CASE The civil case of Weinstein Co a frtign corporation against Dr Dogge is then taken up and Mr Moyer was aid upon what evidence he rendered I gmt nt against the defendant There an affidavit in the papers from the plaintiffs to the effect that the defendant owed them the amount sued for and the affidavit was allowed to go in as testimony It was also apparent from the papers that the defendant demanded security for costs but there was no entry to show tbat the security was given although Mr Moyer staled that Booth Lee Gray put up their personal chtck for the amount In the case of Archer vs Hancock it appeared that the plaintiff was a former eiaployee of Booth Lee Gray In this cise judgment was rendered on the plead iacs after the defendant had answered grnerally denying the allegations contained in the complaint The answer was not verified while the complaint setout a contract in writing Mr HurdDid you ever give Booth Lee Gray summones signed in blank Mr Moyer I gave them a few once with the understanding that the com piaints were to be filed and the summons I returned to niv office before being served Mr Hnrd Mr Moyer did you ever uicit collections from merchants or corporations in this city Mr Moyer Certainly I have solicited business as an attorney Mr Varian lld you solicit the business to bring suit in your own court Mr Moyer did not Did you have any agreement with other commissioners that no costs should be paid nnder certain circumstances None whatever 1 MRS HAUDIKS CASES Several cases brought by Mrs Hardin against various parties were next given the attention of the examining committee Mr Moyer stated that the woman asked permission to bring the suits hers and he granted it without asking her to advance the costs He explained the matter to her and told her he would be as lenient with her as possible as she alleged that she had lost a large amount of money by deadbeats In this connection Mr Moyer was asked if he ever got any consideration for summonses issued out of his court and replied that he never got a cent in any instance One suit was found in which Parsons appeared as attorney in a case which grew out of a collection left in Mr Moyers office This was the only case of tho kind on his docket Parsons had office room with the commissioner and served summonses which he was paid for He was asked if did not agree with Connolly to allow several suits to be brought with the understanding that no costs would be taxed unless the suit was successful and again stated that no such arrangement existed This concluded Mr Moyers examination and other witnesses were called some of whose testimony was not very material to the case WHAT MOTEK SAID George A Burgon an attorney stated I II that31r Moyer told him that be had BO I I i J1 1 licited accounts from merchants for collection with the understanding that they should not pay costs unless the bills were collected Snell jr Mr Bur gons partner was present wLen the I conversation occurred and testified as to 1 the same statement of facts Parsons stated that he had brought two case in Mr Moyers court but had not paid the fees in the case yet There was no agreement that he should not charge faes unless the collections were made He did not get pay for serving summons unless the money was paid in GOT A PERCENTAGE Mr Sibley testified that Mover gave him a certain percentage on the business he took to him He further stated that Mr Moyer agreed to pay him half of the sums which he might realize out of cases in which he appeared as attorney Thomas Connolly brought a suit in I Mr Moyers court and paid no costs until I the money was collected I I Marks stated that Mr Moyer called at his store about a year ago and I said he would like to get some accounts i for collection He also offered to buy any accounts that Mr Marks might desire to I sell if the price suited him Emanuel Kahn testified that Booth Lee Gray who have 423 cases on Mr Moyers docket bad some of his claims for collection The understanding had with the attorneys was that he should not pay costs until the claims Were collected MR MARSHALLS COMPLAINT Elijah Marshall the last important witness was called He stated that he brought a replevin suit for another party in the I commissioners court to recover the possession of a horse Mr Wheeler drew up the papers for him and as soon as the horse was recovered Wheeler sued him for attorneys fees in the sum of 20 II and Mr Sloyer rendered a judgment in favor of the plaintiff Mr Mar shall also stated that he had endeavored to appeal the case but his sureties were not acceptable to the com missioner ie objected to the first two sureties because they resided in Davis county and to one of his Salt Lake sureties in the second instance on the ground that he was not possessed of sufficient means Mr Marshall likewise infcrmed the investigating committee that after the suit had been taken up Judge Judd who assisted Mr Wheeler in his suit advised the commissioner to dismiss it as the wrong man was being sued Marshall brought the suit for his fatherinlaw and held that he was not liable himself Judge Ju dlJo you mean to say that 1 advised the dismissal of that case Marshall do Judge Judd That is all The fatlierinlaw was called and stated that he understood Judge Judd to say that the case should be dismissed Marshal was acting as his agent Mrs Harden was called but her memory was too defective for her evidence to bo very material Mr Moyer had brought some suits for her and collected some money but she didnt remember how much he retained JUDGE JUDDS STATEMENT The prosecution then announced that they would rest and Judge Judd asked to be sworn The oath was administered and the judge made a statement relative to the re plevin suit which had been testified to by Marshall showing that there was nothing crooked about the transaction Moyer employed Wheeler to begin the suit and when another attorney got the case away from them Wheeler brought suit for his fees and got a judgment Mr Moyer was then called by Judge Judd and testified with reference to the failure of the defendant in perfecting an appeal He found that the sureties wero not worth the needed amount and he refused I to accept the bond Mr Moyer was also examined as to the affidavit cf Bur gon Snell to the effect that he had solicited business from merchants and allowed suits to be filed without demanding the costs in advance He testified that he did not tell them that he allowed costs to be waived unless they could be recovered I from defendants but did tell them that if he felt like the matter of a few dollars costs in case could prejudice him he would never try another case Mr Varian Did you ever in any instance agree with persons that you would not charge for your services unless the amount could be collected from the defendant Mr Moyer never did Mr Moyer then made a very plausible statement in his own behalf denying every charge that had been made against him himH Booth was called and swore positively that he had never made any arrangement with Mr Moyer about the nonpayment of costs and that his firm was responsible for the costs in every case brought before the commissioner Lee testified to the same facts and after some further immaterial questioning of several wItnesses who had previously I been examined the great inquisition closed At 615 oclock adjournment was taken until Monday morning at 10 oclock when argument will be heard cheered plucky Billy Pittman yesterday A Gurney cab team without a driver came rushing up Main street yesterday afternoon Billy was starding just above the Walker House and jumping into the street by a dexterous lunge he grasped the bridle rein of tho nearest horse and was dragged to the White House corner before the team slackened its speed The great I crowd that thronged the street at that time sent up a cheer that could havo been heard for two blocks I CAUSE FOR INDIGNATION Filth From the City Dumped on Forest Dale To the Editor of THE HERALD The residents in the neighborhood of Forest Dale are outraged and put to no I end of inconvenience by malicious persons from Salt Lake who under the I shadow of night bring their filth and dump it on Fifth and Seventh East and between Twelfth and Thirteenth South This business has been going on for sometime and it must stop It is about all we can stand now from uncleanliness at this season of the year of our own corralls and pig pens without Salt Lake dumping her unhealthy filth in our very door yards The county court and sheriff have been notified of this nuisance but still it comes If they dp not act let someone engaged in this business Tailing I His Medicine The inquest over the remains of Frank Nuxall the young tailor who was found dead in his bed at the Valley house cot tage on Thursday morning was held by Coroner Taylor yesterday Thomas Barlose Daniel Camomile and Chas Stimson being sworn as jurors It was shown that the deceased had been on a protracted debauch and was in a critical condition in consequence when Dr Mac Lean was called to attend him on Wednesday night The jurors found that the deceased came to his death from alcohol hastened by the too frequent use of a medicine prescribed by his physician composed of digitalis and cinchonia with directions to be taken in three hour doses ho havinc taken as much in ten hours as he should in fortyeight and this we think was the cause of his death The funeral will be
