at 2 oclock A CUNNINGHAM J9 President ttf aC JUT AH LEGISLATURE TwentySixth Session I coracn EIGHTH DAY Monday Jan 21 1584 The Council assembled at 2 pm All answered to their names but Mr Richards Prayer by the Chaplain Minutes of the last session were readMr Hammond suggested that the year 1878 in the minutes was an error Also asked for information as to whether or not the matter in the minutes should be kept standing so that corrections could be made Mr Grant said the printing of the journals was in the hands of the Secretary of the Territory The Chair said the error pointed out by Mr Hammond should be corrected and a correct copy of the minutes furnished A correction was ordered and the minutes were approved Mr WoolJey presented a bill to extend the powers of corporations organized for commercial manufacturing or stook raising purposes in the Territory of Utah Mr Barton moved that the bill pass its first reading and be referred to the committee on private corporations Carried Mr Woolley presented a bill making county treasurers sub treasurers of the Territory and repealing certain acts conflicting herewith Mr Grant said that the Territorial treasurer had had great difficulty in obtaining funds under the old plan and he was opposed to the bill When the treasurer called on the assessor and collector for funds he generally was met with the reply that they had been handed over to the county treasurer and herein difficulties were created Mr Wooley briefly explained the nature of the bill taking a position in opposition to that of Mr Grant claiming that the old law was the best and that the treasurers should be required to settle at certain times not be permitted to delay and be thus enabled to embezzle The bill was finally read the first time and referred to the committe on ways and means The Chair announced that he was in receipt of a telegram announcing that he had a dangerously sick child at home and desired to be excused in time to reach the train at 3 pm I On motion the request was adopted and the President excused Mr Richards presented a bill to amend Section 576 of the Compiled Laws It provides that after the word bylaws and before the word established an authorization for issuing degrees and diplomas bo inserted Mr Hey borne moved Its reference to the judiciary committee Mr Hammond suggested that it could not be told what committee was proper from the subject matter of the bill Mr Barton moved to amend by referring to the committee on education Accepted and adopted Mr Page presented a bill with a pet lion from Naile asking for a change of name he moved its reference to the judiciary committee Mr Taylor desired to introduce an amendment making all such matters one bill further in the session and acting on them together He moved to that effect and that the judiciary committee be instructed to withhold such bills for that purpose Carried Mr Woolley was called to the chair and the President took his leave Mr Taylor moved that the Coun cl adopt the rule suggested by him in relatIon to change of name and that the committee be instructed to prepare a bill accordingly Mr Grover thought this a rather wholesale way of doing business such cases should be acted on separately This might be the only case of the kind Mr Hammond was opposed to the motion in its present form The committee should examine each petition and report on it one way or another Mr Taylor further explained his objects and the nature of the bill The motion was put and defeated by a rising voter to 4 Mr Grover moved to proceed with the regular orderthe report of the committee on rules adopted and the Clerk proceeded to read the rules Mr Grant moved that where no objection was made to rules while being read they be considered approved Adopted Mr Hammond moved that House rule with amendment be substituted for rule 12 Adopted Mr Barton moved the amendment of rule 13 Adopted Moved that the rules as read and amended be adopted Carried Adjourned Alexander Anderson Referred to committee on judiciary The judiciary committee reported adversely the petition of Robert Hendrick on for change of name of Diary Henderson Mr Peery moved to recommit the petition for further action Motion lostThe The report of the committee was on motion adopted The same committee reported in favor of granting the petition of John Nerenhurst to John Hurat and presented a bill se ordering The committee on claims and public accounts reported in favor of granting the petitions of Ashton Nebeker and Johnson of Kane County and paying them moneys paid for delinquent taw After considerable discussion Mr Dusenberry moved to recommit and the motion prevailed No 10 a bill changing the name of John Nerenhuret to John Burst was presented by the Committee on Judiciary and passed to its second reading No 11 By Mr Francis A bill to compel railroad corporations to fence along their respective lines of railway and to maintain on all crossings etc cattle guards On motion of Mr Peery the bill was referred to the Committee on Private Corporations Mr Creer presented a resolution instructing the Chief Clerk to prepare a list of bills presented and have printed for the use of members On motion referred to the Committee on Rules On motion at 315 pmadjourned until January 22nd ODDS AND ENDS I New York has an anticharity society At roll call the city
