hut enough to have supported a verdict of murder in the first degree It was true that Powell actually did the killing but Pridgen was equally guilty Justice Walker states "Let us premise the discussion by stating what is decided in all the eases and especially in State sc: Whitson 11 695 that as the jury found that one of the defindants Louis Powell slew the deceased under circumstances which would make him guilty of murder and other defendant who was then and there present aiding encouraging and abetting the killing would be guilty of the same degree of crime as the man who did the killing This is not only settled by authority but is a truism" There was no error State vs Ross is a conviction under Laws 1913 Ch 81 see 2 for unlawful possession of cocaine 225 little packages of but it WAS in mitigation and not a defense that it was in reply to an attack made upon him Two wrongs do not make a right Nor could he show good faith and the absence of malice as a defenae for the article which is ilbetotim per se These are matters which could be urged in mitigation of damages only Knott vs Burwell 96 272 and the defendant was allowed so to use them They were therefore not matters requiring an issue The Issues were in accordance with the ruling in Hamilton vs Nanace 159 59 etc" There were a number of exceptions which cannot be reviewed here No error was found in the trial JUDGE CARTER DENIES REPORT IN PAPER AS TO ALLEGED REMARKS Elizabeth City Nov statement published in a local newspaper crediting Superior Court Judge Frank Carter with the words "I would rather
