Similar Measure Come From the House and Is Referrei Other Business of the Upper I House of the Legislature Yester dav Mr Chambers Sworn In The senate indulged In two debates yesterday the first being upon the hasty passage of bills which was led I by Mr Whitaker and partially coin cided in by Allred and Harbour the second being on the printing of bills I in hich Harbour and Allred joined with Whitaker in a successful struggle The first talk was had when senate bill No 4 the measure introduced by If Mr Caine permitting those who have i acquired title to railroads in the state 1 by purchase to incorporate and operate the same Mr Whitaker said he I because should vote against the measure cause ho had not had time and opportunity to examine the same that a copy had not been furnished him for approval and amendment He did not ish i tj concur in the same not that 1 IJ uns idered it a had measure by any iman hut i because he did not understand ail it contained stant Mr Nebeker who acted UUibing 1r lpheker I as chairman of the railroad committee In the absence if Mr Chambers said the iHI was a good measure and the passage i ol the same was for the benefit of tin people of tb state I actions were brought against the company tHS which was to be formed under its provisions they would not be troubled to go to the federal courts for i relief but could obtain the same right i here at home in the district courts of I the state This was one of the many beiints to be derived I THE BILL PASSES I Mr Harbour said the hasty passage 11 of the bill was to be deplored but as he II had advised the committee that he would vote for it he should keep his I word He thought the hasty passage alluded to was the fault of the committee on rules but would interpose no objection at this time being content to rest on the advice of the commit I I tee which had examined the bill i The lull then las ed all voting aye i qh with the exception of Whitaker who I voted no and ms who was absent I at hine where it is understood he has sickness in the family I UTAHARIZONA BOUNDARY Snows resolution giving the governor authority and directing him to appoint I two commissioners to visit the legislature of the territory of Arizona with the iev of getting its consent to I Change the boundary line between Utah i and Arizona and making an appropriation of UO for the purpose was brought up on the favorable report of I the committee hnh has been considering I the sam the committee being that of appropriations and claims and alter a slight amendment was read third time and passed all voting I aye upun the measure which was then sent I the house Later in the Jay a similar measure was received from the house where it had passed which was I referred to the Committee which reported re1erre on Snows resolution where it I vrill no doubt be buried the Sn act i covering all the essential points I Prior to the passage of the resolution Mr Harbour asked Snow what he i meant by the breaks in the liver and being informed they were the high i walls whiCh lined the Colorado for a considerable distrnr and which were deoijid all right for an establshing pOnt sat down with a sigh of relief I Mr Hamer introduced a resolution din i ting tk secretary of state to mail all at ts which take effect upon passageS passed at this session to the several 4 county delkF of the respective counties 3 5 of the state for posting for the benefit of the public which went over one day under the rules and which will doubtless pass as did a similar measure at the last session 11 Came resolution providing forth I distribution of documents which I was introduced at Fridays session caim ui again and was adopted i i HAKDOUR RESOLUTION Then it was that Mr Harbour pretip itatJ a cil hat He introduced the I foMon ing resolution I Resoved That senate rule No 48 I le hanged to rat ZOO copies of every 4 bil joint resolution and memorial i shall I ordered printed when referred to a Committee I Mr Caine caned attention to the I 1 fact that economy was wealth so to I speak and that this senate was elected Ito practice econ my in its work He did nut believe uills should be printed until it was certain the senate was I going to take ai ton thereon The printing of bills was something which ca Fid expense and he did not want th taxpayers Burdened more than I vas absolutely necessary Mr loot joL ed in this view and I declared that at the last session there decar ses I were tons and tm of bills and other I mattr printed win was a total loss He spoke advisedly on this because he had been the printed matter at the clot of the session Bills were printed I and encumbered the files for the entire session and at the end of that time i were fit for nothing save waste paper for fire kindling or something of that i I sort lit did not believe in printing I bills which were neer coming up I i i and asserted that any bill of sufficient Importance oulel be printed when requested I by the member introducing it I Mr Mired vanted copies of bills before Jim so he could understand what I was being done He had seen none i of the hills passed already had no know ledge of their contents save that I imparted by the reading by the secretary He did not want to be compelled to explain to his constituents that he voted against this bill or for that one because he did not know I its contents Senator Whitaker presented an aiminlnvnt to the pending motion in I the shape of an addition to rule 48 reading and all bills must be printed before second reading Incidentally I 1 he suggested no senator would present 4 a bill which he did not want printed aud nich he would not work for I therefore all his should be printed I after first reading This elicited a re I i mInk from Senator Smoot to the effect that bills were often introduced by request I by senators who had no interest in them at all However he was I glad that the senate was going to be industrious as evinced by debate He I supposed from remarks made that all bills were going to be read in full I three times something which had been Hone never in the history of any legislative body that he had ever heard of Mr Whitakers amendment was lost and Mr Harbours withdrawn Then i was that Mr Hamer offered an amendment to the effect that bills should be printed upon the request of a member To amend the rules requiring the printing of all bills would mean 200 copies of the report of the code commission But his amendment was lost and a motion recon Ji1 I i sidering the vote on the amendment I to the rule by Whitaker prevailed and the same was passed Mrs Cannonmoved a reconsideration of the vote by Which the report of the code commission senate bill 1 was referred to the committee on judiciary and when Hamer seconded the same said she had arrived at the conclusion the work was too much for the com wa mittee and that time would be lost unless the subject matters contained I in the measure were not referred to the appropriate committees having them in charge AN EASY SOLUTION I Replying Mi Hamer stated the senate committee on judiciary was arranging for a meeting with a like I committee trom the house and that he believed this would be the best plan The senate agreed with him as the I motion to reconsider was lost i INVITATION ACCEPTED I The following selfexplanatory invitation was read I Salt Lake City Jan Resolution Ariona Anexaton esoluton Goes Through Bills Introduced A Measure to Repeal the Mortgage Tax Practice of Medicine Payment of Bounties I I The lower house of the legislature I yesterday afternoon hastened to remove I all obstacles from the pathway I of the Oregon Short Line and prompt passed the railway incorporation bill the The measure had previously passed I senate and new goes to the governor This act will make Utah the home of one of the most important railway systems in the west a company capitalized at 60000000 and operating 1500 miles of road in five states The importance of the measure to the commercial interests of the state is not I fully realized The bill passed yesterday authorizes the incorporation of I companies organized for the purpose of purchasing railroad property which I may have been sold under judicial proceedings sale and to ceedings or at private I acquire the capital stock of any other railroad corporation whose lines are I within or without this state The old I statutes only authorized the incorporation tion of companies organized for the purpose of constructing and operating As the railroads within th state reorganized Short Line company proposes to purchase a railroad already constructed and in operation some I new legislation was made necessary The bill was passed by a vote of 40 to 3 i the negative being Romney Slepard and Wilson Mr Romney explained that he voted no because the bill contained no provision prohibiting the acquisition or absorption by a of competitive lines railway company compettve lnes and not through any opposition to the general purpose of the measure ELECTION OF SENATOR Mr Kenner from the committee on elections presented an adverse report on Taylors resolution providing for the manner of electing a United States senator The committee recommended a substitute providing that at 3 oclock this afternoon the hnuse proceed by viva voce vote vote for candidates for United States senator and that while the vote is being cast all persons except the members and officers of the house and representatives of the press be excluded from the floor of the house The hour was changed from 3 to 4 oclock and the resolution adopted Mr Hardy presented a petition signed by 75 citizens of Sanpete county I asking that officers of banks be required to give bonds sufficient to I protect depositors from loss Referred to committee on judiciary ARIZONA ANNEXATION Mr Sloan from the committee on public lands presented a favorable report on the Arizona annexation resolution authorizing the governor to appoint commissioners to negotiate with the Arizona legislature for the cession to Utah of that portion of the territory lying north of the Colorado river In explanation Mr Sloan stated that this tract was the rendezvous of cattle thieves and outlaws who jade frequent raids into Washington and Kane counties committing depredations upon the settlers and escaping capture by retreating across the line Arizona did not care much about this tract and the territorial legislature now in session might be Induced to cede it to Utah Mr Robinson of Kane and Mr 111 Dutfin of Washington supported the resolution and stated that nearly all of the live stock in the desired territory was owned by Utah citizens 11 Kenner denied that the legislature of Arizona had any authority whatever to cede any portion of the territory to Utah that power being vested in congress The resolution was passed THE RAILROAD BILL Mr Kimball called up the special order of the day the railroad incorporation bill and upon Mr Kenners motion the senate bill upon the same Subject was substituted for tie house bill billMr OBrien offered an amendment to the last section prohibiting any railroad company from purchasing the stock of any other company owning a competitive line Mr Romney earnestly urged the adoption of the amendment While the passage of the bill was desirable it wa the duty of the legislature to safeguard the interests of the people Unless restrained any large railroad company could strangle competition by buyIng up all competitive lines Mr Thoreson remarked that this subject was fully covered by the consti uticn and Mr Romney asked why then was objection raised to its incorporation corporation in the bill I Mr Sloan called attention to the importance of the speedy passage of the Jill Many prominent citizens had appeared in its behalf and urged speedy action and the interests of the state acton demanded its passage without unnecessary delay He opposed the amendment because it was unnecessary and would delay final action Mr Roylance Mr Bennion and Mr Kimbal of Cache opposed the amendment as a useless waste of time The amendment was defeated and the bill passed by a vote of 40 to 3 A communication was received from the governor transmitting the report of the state board of land commissioners I The senate announced the passage of senate bill No3 fixing the salaries of I officers and members The speaker announced the appointment of the committee on enrollment and engrossment as follows Forshee Hopkins Bennion Kenner A So reason The house then adjourned BILLS INTRODUCED Several Important Measures Presented in the House Yesterday House bill No 19 introduced by Mr Bennion by request provides for the protection of the bee industry and protecting bees from the foulbrood disease I requires the appointment of three inspectors of bees by the commissioners of each county at a salary of 53 per day for the time actually employed ployedMORTGAGE MORTGAGE TAX REPEAL Mr Dotson introduced a bH No 20 repealing that provision of the revenue law which directs the taxation of mortgages and deeds of trust This measure will he strongly supported by the banking and loan interests and opposed by certain elements PRACTICE DF MEDICINE Mr Kenner of Salt Lake introduced a bill No 22 regulating the practice of medicine and surgery I authorizes the governor to appoint aboard of seven medical examiners who shall be graduates of a legally chartered medical college or college in good standing I Is made unlawful for any person to practice medicine surgery or obstetrics without first hav surgeI frst I ing obtained a certificate from this 1 I board and no person is entitled to a certificate who Is not a graduate of a legally chartered medical school or college recognized by the American med ical homgopathic or eclectic associations Any person practicing medicine without complying with the provisions of this act shall be deemed guilty of a misdemeanor Any physician who is addicted to intemperance may be cot plained against before the courts and any physician convicted of immoral or unprofessional conduct shall be fined not less than 550 nor more than 5200 PAYMENT OF BOUNTIES 11 Cook of Box Elder introduced a bill No 21 amending the present act in relation to the payment of bounties for the destruction of certain animals and birds I so changes the statutes as to leave I discretionary to the county commissioners whether such bounties shall be paid the statutes now making such payments mandatory upon the petition of a certain number of residents
