The twenty-nine catnc unsolicited yesterday from a Jeweller, who notified Police Headquarters through his attorney that lie had been holding the gems on memo randum for client, not suspecting they were stolen goods. The Jeweller said he accepted custody of thirty of the Kerns and sold one of them for a client for $1,009. The others are In a safe deposit vnult and will be turned over to the pollco to-morrow.

The Identity of the Jeweller was withheld by the pollco. It Is said he Identified as his client James E. Foyc, former Blltmore room clerk, who was arrested Wednesday. The Identification was mode In the presence of Detectives McCoy and Gcgan from a photograph. Foye spent the day In his cell without event except for the visit of his attorney, Frederick McN'Ish, a former Assistant District Attorney.

Both he and promised a statement after the Interview, but It was not forthcoming. The Identification of the nine pearls previously recovered was confirmed yesterday by Mrs. Mlllhlser, according to the detectives. The theft of the Mlllhlser Jewels occurred In June, 15-19, while Foye was a room clerk at the Hotel Blltmore. Foye's police record Is said to cover something like ten years and Includes a number of swindling deals which have made htm almost an International promoter, when ho was arrested Friday, he represented that he had at one time been a private secretary of John Gates.

A Saks announced yesterday that Sales now at Broadway and Thirty-fourth street, have leased tho entire block on tho east side of Fifth avenue between Forty-ninth and Fiftieth streets, with tho exception of tho space occupied by the National Democratlo Club, for a period of 105 years. A modern department store will be erected on thU property, and Saxs Co. will pay rentals during that period totalling Sales Co. have leased the property from tho Gcorgo Kemp Realty Company, whose negotiations were conducted by Stephen Tyng.

Elijah SnlfTen and Henry Mandcll represented Saks Co. In tho negotiations. Attorneys for Saks Co. are Felner Moaas. John Lar- kln is attorney for the Gcorgo Kemp Realty Company.

Tho Buckingham Hotel, one of the oldest hotels In New York, will have to go as a result of tho transaction. The hotel was built In 1S76. Tho Belgravla property Is also In the Mock. Saks Co. have been In their cresent site since 1S02.
